Conditional Use Permit to allow use of a glass recycling bin located within a parking area of an existing office complex. GENERAL INFORMATION PROJECT: Owens-Illinois, Inc.'s request for a Conditional Use Permit to allow use of a glass recycling bin within the parking area serving 6665 Amador Plaza Road, one of four two-story office buildings located at the southern terminus of Amador Plaza ~Road. The south side of the property adjoins the Alameda County Flood Control Channel and Freeway 580. The glass recycling bin has been placed in the southeastern most corner of the existing parking area. SURROUNDING LAND USE AND ZONING: / North - South - East - West - PD; Planned Development District-vacant Alameda County Flood Control Channel and Freeway 580 PD; Planned Development District - vacant C-2; General Commercial District - vacant and existing mixed use commercial structure ZONING HISTORY: 5/3/79 - A Parcel Map was approved to subdivide 21.8+ acres into five parcels. subject property is Parcel D of that Subdivision. The ITEM NO. 10/22/80 - A Site Development Review was approved by Alameda County to construct six office buildings on the subject property; only four structures were constructed under that entitlement. 4/2/81 - The site was rezoned along with the remainder of the original 21.8+ acres from C-2; General Commerical DistriCt to a Planned Development C-O; Administrative Office District allowing a racquetball club, gymnasium, restaurant and other C-l; Retail Business District uses that are compatible with C-O uses. 2/25/85 - A proposal to rezone the entire' original 21.8+ acres to apply a revised PD; Planned Development District to accomodate a Planned Development Master Plan Proposal was denied by the City Council. APPLICABLE REGULATIONS: .As indicated previously in this report, the property is zoned PD; Planned Development District. The zoning action applying the PD designation spells out within the permitted land uses those C-l; Retail Business District uses determined compatible with C-O uses. Recycling centers are allowed in C-i; Retail Business Districts if a Conditional Use Permit is secured pursuant to Section 8-94.0. Section 8-94.0 states that conditional uses must be 'analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or peformance standards established for the district in which it is located. Section 8-94.4 states the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptance and observance of specified conditions, including but not limited to the following matters: a) substantial conformity to approved plans and drawings; b) limitations on time of day for the conduct of specified activities; c) time period within which the approval shall be exercised and the proposed use brought into existence, failing which, the approval shall lapse an~ be void; d) guarantees as to compliance with the terms of the approval, including the posting of bond; e) compliance with requirements of other departments of the City/County Government. ENVIRONMENTAL REVIEW: Categorically exempt NOTIFICATION: Public Notice of the May 20, 1985, Public Hearing was published in the Tri-Valley Herald, mailed to adjacent property owners, and posted in public buildings -2- ANALYSIS: The location and use of a glass recycling center within the subject office complex will not adversely impact the operation of the complex. The proposed location is considered appropriate as regards both accessibility and visibility. Although the bin is situated at the southeastern edge of the property and adjoins the flood control channel and the westbound on-ramp for Highway 580, its visibility from off-site is minimized by the design and grade layout of the adjoining freeway interchange. Staff recommends that one adjoining parking space be ear- marked for the recycling operation. Specifically, Staff recommends that the immediately adjoining parking space be marked and maintained as a "No Parking" zone to facilitate access and use of the bin. RECOMMENDATION FORMAT: 1) 2) Open public hearing and hear staff presentation Take testimony from applicant and the public 3) Question staff, applicant and the public 4) Close public hearing and deliberate ACTION: 5) Adopt Resolution approving request Staff recommends that the Planning Commission adopt the attached Resolution (Exhibit A) approving Owens- Illinois, Inc.'s request (PA 85-027) for a Conditional Use Permit to allow location and use of a glass recycling bin within the parking area serving 6665 Amador Plaza Road. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 85-027, OWENS-ILLINOIS, INC., CONDITIONAL USE PERMIT REQUEST TO ALLOW A GLASS RECYCLING BIN LOCATED WITHIN THE PARKING AREA OF THE FOUR-BUILDING OFFICE COMPLEX AT THE SOUTHERN TERMINUS OF AMADOR PLAZA ROAD WHEREAS, Owens-Illinois, Inc. requests approval of a Conditional Use Permit to allow location and use of a glass recycling bin within the parking area serving 6665 Amador Plaza Road, one of four two-story office buildings located on a 6.9~ acre parcel situated at the southern terminus of Amador Plaza Road, more specifically identified as APN 941-1500-41; and WHEREAS, the subject property was rezoned to a PD; Planned Development District in 1981, which allowed among other uses, C-l; Retail Business District uses that are compatible with C-O; Administrative Office District uses; and WHEREAS, the adopted City of.Dublin Zoning Ordinance restricts the operation of a glass recycling bin in a C-l; Retail Business District until a Conditional Use Permit is secured; and WHEREAS, the Planning Commission did hold a public hearing on said application on May 20, 1985; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt; and WHEREAS, the Planning Commission finds that the Conditional Use Permit will not have a significant environmental impact; and WHEREAS, the Staff Report was submitted recommending that the Conditional Use Permit application be approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony herein above setforth; and WHEREAS, the proposed land use, if conditionally approved! is appropriate for the subject property in terms of being compatible to existing land uses in the area and will not overburden public services; NOW, THEREFORE, BE IT RESOLVED THAT THE Planning Commission finds: a) Location and use of the glass recycling bin are required, and serve, the public need in that its use will aid to reduce landfill problems, conserve raw materials, save on fuel and energy, facilitate the public's education that all glass recycles, and that proceeds generated from this center will aid a locally based non-profit group; b) The uses will be properly related to other land uses, and transportation and service facilities in the vicinity; DP 83-20 c) The uses will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met; d) The uses will not be contrary to the specific intent clauses or performance standards established for the District in which it is to be located, as the proposed uses will be compatible and adjoining office uses; e) The approval of the Conditional Use Permit will be consistent with the Dublin General Plan; BE IT FURTHER RESOLVED that the Planning Commission does hereby conditionally approve said application as shown by materials labelled Exhibit A and Attachement 3, on file with the Dublin Planning Department, subject to the following conditions: 1. Development shall be generally as shown on the site plan prepared by the Planning Department in conjunction with this application and as described by the applicant's written statements dated received by the Dublin Planning Department on March 28, 1985 and April 10, 1985. Use and operation of the glass recycling bin shall be subject to the conditions listed below. 2. The permit is issued to the applicant, Owens-Illinois, Inc. only, and shall not be transferable. 3. The permit shall be valid for a period of two (2) years, at which time it shall be necessary to apply for renewal. Failure to establish the use as conditioned by this permit within six months of the effective date of the permit will cause the permit to become hull and void. At any time during the effective period of this approval, the approval shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. 4. All signage, beyond the signage currently on the recyclying bin, shall be subject to review and approval by the Planning Director as regards size, location, copy, construction materials and design. No off-site signs shall be permitted in conjunction with this permit. 5. Use and location of the glass recycling bin shall be controlled so as not to create a nuisance to the existing and/or future tenants in the adjoining office complex or the general public utilizing the parking area or recycling bin. 6. The parking space immediately adjoining the recycling bin shall be striped as a "No Parking" zone to allow ease of access to and use of the recycling bin. 7. The use established under this permit shall be subject to review after the one-year anniversary of intitial occupancy to determine compliance with the above conditions or what additional requirements may be needed. The Planning Director may refer the matter back to the Planning Commission for disposition. PASSED, APPROVED AND ADOPTED this 20th day of May, 1985.
