City Council Resolution No. 19-11 Amending and Restating the Rules for the Conduct of Meetings of the City Council Receive report None DESCRIPTION: At the March 8, 2012 meeting of the Heritage and Cultural Arts Commission, Commissioner Steve Minnear asked Staff to present to the Commission with a review of the process to place items on the Heritage and Cultural Arts Commission agendas. Placing Items on the Agenda Per the City Clerk, since the process for a Commissioner to place an item on the Agenda is not addressed in the Bylaws and Rules of Procedure for the Heritage and Cultural Arts Commission (Attachment 1), the Commission will follow the process used by City Council for items and issues within the Commission's purview. In City Council Resolution No. 19-11 (Attachment 2), Amending and Reinstating the Rules for the Conduct of Meetings of the City Council, Section 9.b. states, "When an item not on an agenda is raised by a member of the public, the City Council may briefly respond, may ask questions for clarification, provide a reference to Staff or other resources, or request Staff to report back at a subsequent meeting. Furthermore, a member of the City Council may take action to place a matter of business on a fufure agenda." An action to place a matter of business on a future agenda may be made by a Commissioner during the "Other Business" section of the Heritage and Cultural Arts Commission Agenda, for items within the Commission's purview. Staff would then prepare a report and presentation to the Commission on the item of interest. The timing of the report and presentation would depend on the complexity of the issue, if additional resources are needed to prepare the report, and its urgency in relation to other established priorities. During her visit she interviewed Staff, stakeholders and volunteers. She studied the collections storage and exhibit areas. Following her visit, she compiled a final report (Attachment 1). Overall, her assessment recognized the work being done by the Staff and Volunteers. In her wrap up interview with Staff, Ms. Olsen conveyed that Staff is doing a remarkable job in managing the collection. In the report, she also emphasized that "they (Staff and Volunteers) should have confidence in their work and keep developing skills." The benefit of this peer review process is that it provides an outsider's perspective on the practices and procedures of the City's program. The risk with this process is that the findings are not measured or standardized. As compared to the two prior MAP assessments, the findings in the Phase-III report were not fact-checked. As a result, the report includes a considerable number of inaccurate and subjective observations. Many of the issues included in the narrative were already complete at the time of the Survey, or well on their way to completion. Staff has prepared a table summarizing Ms. Olsen's recommendations with clarifications and Staff's proposed implementation plan (Attachment II). As part of the implementation stage, Staff requests the Commission's input on the draft implementation plan to complete the MAP process. The Commission's input will be shared with the City Council. RECOMMENDATION: Staff recommends that the Heritage and Cultural Arts Commission receive the report and provide input on the draft implementation plan. 2 of 2 r CITY OF D UI3LIN IIERITAGE AND.CULTURAL ARTS COMMISSION B ALA ~'S AND R ULES Off' PROCED URE CjL'NERAL PROVISIONS A. These Rules of Procedure sha[I be known as the Bylaws and Rules of Procedure of the Heritage and Cultural Arts Commission of the City of Dublin. A copy of these Rules and amendments thereto, shall be filed in the offices of the City Clerk for examination by the public. B. These Rules and any amendments hereto shall be effective on the date of the adoption hereof, and shall govern the meetings and activities of the Commission. I I . COMMISSION COMPOSITION AND METHOD OF APPOINTMENT A. The Heritage and Cultural Arts Commission shall be composed of seven (7) members. B. The Mayor shall make all appointments to the Commission, with the approval of the City Council. When making appointments to the Commission, consideration shall be given to members of the Dublin Fine Arts Foundation and Dublin Histol-ical Preservation Association (or similar groups) and to persons who are specifically qualified by reason of training, experience, .interest or involvement in arts and/or heritage, particularly as related to artistic and cultural activities in the. City. C. All members shall be residents of the City and shall be committed to furthering public art, and historical and cultural life in the community. - D. Commission members may resign at any time by giving written notice to the Mayor and -City Clerk. III. TERM OF OFFICE AND REMOVAL A. Commission members shall be appointed for terms which run four (4) years beginning in December of even numbered years and ending in December of an even numbered year. At the end of a Commissioner member's- term, the Commission member may be reappointed to the Commission in the same manner as the initial appointment. Commission members shall be eligible to serve a maximum of eight (8) years with two (2) 4-year terms. B. Any member of the Commission may be removed from office by the Mayor, with the approval of a majority of the City Council. Removal and appointment of Commissioners shall be made only at a regularly scheduled meeting of the City Council. C. Commission members must attend 75%~of all regular and special meetings in a 12 month period. The Secretary to the Commission shall provide the Mayor with monthly attendance reports and a quarterly overview of attendance by Commission members. The Secretary to the Commission shall notify the Mayor if a Commission member is absent from three consecutive meetings. The Commission member shall also be notified that they may be removed from the Commission. D. If a Commission member ceases to reside in the City of Dublin, said Commissioner's office shall be declared vacant. Election and Term of Office. The Chairperson and Vice Chairperson are elected by the majority of the Commission fora 1-year term and hold office until their successors are elected, or until their terms as members of the Commission expire.- The officers are elected at the first meeting of the Commission in January of each year. Elections, whether regular or to fill vacancies shall be held only if a simple majority of the Commission members are present. The Commission shall, unless no Commissioners meet the criteria, elect Commissioners to the positions that have not previously served in the position and that have not declined the appointment, with the intent that no on should serve in the position for two consecutive years. The secretary to the Commission will be the City Manager or his/her designee. B. Vacancies. In case of any vacancy in the Office of Chairperson or Vice Chairperson, the vacancy shall be filled by an election held at the first regular meeting after the occurrence of such vacancy. The person so elected shall serve the balance of the term. C. Duties of Officers. The Chairman performs the following duties: 1. Presides at all meetings of the Commission. 2, Appoints committee and chairpersons of committees as necessary. 3. Signs correspondence on behalf of the Commission. 4. Represents the Commission before the City Council. 5. Performs other duties necessary or customary to the office. In the event of the absence of the Chairperson or his/her inability to act, the Vice-Chairperson presides in place of the Chairperson. In the event of the absence of or the inability to act of both the Chairperson and the Vice-Chairperson, the remaining members shall elect one of their members to act as temporary Chairperson. D. The Committees. The Commission or the Chairperson, upon direction of the Commission, may appoint several of its members, but less than a quorum, to serve as a Committee. On certain occasions, such as when a particular kind of expertise or public representation is desirable, the Commission may appoint non-members to the Committee. Committees make recommendations directly to the Commission. A Committee may not represent the Commission before the Council or other bodies unless it has first received the authorization of the Commission to do so. V I. lt~"FF~'~1'JGS' A. The Commission shall -hold regular meetings at least once per month at a designated time and place, which shall be fixed and determined by the Commission and entered upon its minutes. Ail meetings of the Commission shall be open to the public. Special meetings of the Commission may be called by a majority of the members thereof, or by the Chairperson thereof. Notice of any such special meeting shall be given as required by law. B. A majority of the voting members of the Commission shall constitute a quorum for the purpose of transacting business. The Commission shall consider and make recommendations, as it deems necessary to the City Council in all matters pertaining to: The restoration, maintenance and operation of the Heritage Park & Museums. Such recommendations would include, but are not limited to the following: recommendations for the development, improvement and/or modification of Heritage Park & Museums facilities or programs; recommendations for policies on heritage preservation, artifact acquisition, conduct of persons using the Heritage Park & Museums facilities; and rules for the use of the Heritage Park & Museums by the public. 2. The promotion and support of the arts within the community. Such recommendations would include, but are not limited to the following: recommendations on art in public places including City facilities and new developments within the City; exhibits at the Civic Center, Heritage Park & Museums and Public Art Venue; and recommendations for policies on art, cultural activities and facilities. VIII. D UTIE.S ®F ~`Q~IG~1~I~,SI®N ~'® ,~~' ~D ~"~~~ ~' ®1~I~ Y A. The Commission shall be an advisory body to the City Council. Nothing herein contained shall be construed as a (imitation on the power of the City Council or the Administrative Staff of the City or any other agency in their supervision, or authority over property or personnel which are under their respective jurisdictions. Ix. ~'TAFE~~SrsTAI'~CE A. The City Manager shall provide the Commission with such information and Staff assistance as the Commission may, from time to time request, subject to the limitations imposed by the-City Council. (REPLAdC!!VG RES~t_UT!®N !V®. 25-Q8) WHEREAS, from time to time, the City Council amends and restates the Rules for the Conduct of Meetings of the City Gouncil ("the Rules"}, and the Rules were last restated by Resolution Na. 25- 08; and. WHEREAS, the City Cauncif wishes to review, amend and restate the Rules of Conduct of 11~eetings of the City Council folla~ving each General Municipal Election, and, fallowing the November 2Q10 General Election, the City Counci! at its meeting an February 15, 2011 revsewed the Rules and hereby restates the Rules with revisions proposed by staff. Three Regular meetings of the City Council shah be held an the first and third Tuesday of each month at the hour of 1:00 p.m., except that Closed Ses'sian Items shall be held at 6:30 p.m. Whenever the day fixed for any regular meeting of the City Council falls upon a day designated as a holiday, such meeting wilt be held at the same hour on the next succeeding day not a holiday. b. Place Alf regular meetings of the City Gouncil shall be held at the Civic Center, as designated by Ordinance. c. Public All meetings of the City Council shall be open to the public; provided, however, the City Counci[ may hold closed sessions as provided by the laws of the State of California. 2, SPECIAL, II~EE T l~4GS A special meeting may be ordered at any time by the h~ayor whenever in his/her opinion the public business may require it or upon the written request of any three members of the City Councii. Whenever a special meeting shah be called, written notice of such meeting she{l be delivered personally ar by any other means by the City Clerk to each member of the City Cauncif and to each fool newspaper of general circulation and radio/television station requesting notice in writing. Such notice must be delivered at least-twenty-four (24) hears before the time of such meeting as .specified in the notice.' The notice shall specify the time and place of the special meeting and the business to be transacted or discussed-: f~a other business shall be considered at such meetings by the City Gouncil. AC~ItII~r~k In order to facilitate the orderly conduct of the business of the City Council, the City Glerk shah be notified no later than 11:00 a.m., on the Tuesday immediateEy preceding a regular City Council meeting of all reports, communications, ordinances, resalutians, contract documents or other €~atters to be submitted to the City Council at such meeting. Immediately thereafter, the City Cleric shall arrange an agenda of such matters according to the order of business and furnish each merr~ber of the City Cauncii, the City Manager, City Attorney, City Department F-ieads and Staff with a copy of the agenda packet prior to the City Cocancil meeting and as far in advance ofi the meeting as time for preparation will permit. The agenda prepared by the City Clerk shall, at a minimum, include: a. The date of the meeting b. The time of the meeting ' c. -The location of the meeting d. A brief geneeal description of each item of business to be transacted or discussed at the meeting e. Specified period of time for rreembers of the public to address the Gity Council on items of interest to the public that are within the }urisdictian of the City Council, including a provision that no person may speak longer than three (3) minutes, and including language that the Gity Council can only briefly respond with questions, refer to Staff, or place on a future agenda ~ ~ - f. At least seventy-two (72) ha~srs before each regular meeting, the City Clerk shall post a copy of the. agenda in the Kiosk in front of the Civic Cerster located at 100 Civic Plaza, Dublin, California. The City Clerk shall execute a declaration of posting which shall be filed in the Office of the City Cleric. The Gity Clerk shall so mark ar~ denote "Consent Galendar" items on the agenda to identify those items on the agenda which can reasonably be expected to generate no discussion by €nembers of the City Council, City StafF or interested persons in the audience. The City Council shall Gansider all of the items on the Consent Calendar portion of the agenda at one time by a vote after a motion has been duly made and secc3nded. If aE( members are absent from any regular or acfjoumed regular meeting, the City Clerk may declare the meeting adjourned to a stated time and place. if he/she does, he/she shalt cause written notice of the adjournment to be given in the same manner as provided for special meetings.
