Location Map RECOMMENDATION: 1. Receive Staff Presentation 2. Adopt Resolution determining that the proposed street vacation is in conformance with the General Plan pursuant to Government Code §65402 DESCRIPTION: According to Government Code §65402, the Planning Commission must report conformance with an adopted General Plan for any street vacation or abandonment. The City has recently been asked by the Alameda County Surplus Property Authority (ACSPA) to vacate the portion of Dublin Boulevard that originally extended along the southern boundary of the Parks RFTA property as it approached Arnold Road. Staff is thus requesting this determination of conformity from the Planning Commission. BACKGROUND: After the Eastern Dublin Specific Plan was adopted in 1994, the City Council adopted a new right-of--way line for Dublin Boulevard from Iron Horse Parkway to Hacienda Drive (Attachment 2) to better accommodate development of the Santa Rita property. This new alignment for Dublin Boulevard was required both by the Eastern Dublin Specific Plan and by an Eastern Dublin General Plan Amendment. To formalize the change in alignment, Parcel Map 7395 (Attachments 3 and 4) was approved in 2000 that designated the former alignment of Dublin Boulevard Parcel C and the new alignment Parcel D. According to Community Development Director Resolution No. 04-99 for Parcel Map 7395, the owner of Parcel D, ACSPA, is required to grant Parcel D to the City when the Dublin Boulevard extension is completed between DeMarcus Boulevard and Arnold Road. The Resolution also required the City to abandon Parcel C so that it could be merged with atriangular-shaped parcel (Parcel 3) and made available for development by ACSPA. Since the construction of Dublin Boulevard along the new alignment is nearly complete per the approved plans, the existing segment of Dublin Boulevard between Iron Horse Parkway and Arnold Road (Parcel C) must now be abandoned. Government Code §65402 states that "If a General Plan..... has been adopted,..... no real property shall be vacated or abandoned,..... until the location, purpose, and extent of such...... street vacation or abandonment..... have been submitted to and reported upon by the Planning Agency as to conformity with said adopted General Plan.....". If said finding is made by the Planning COPIES TO: In House Distribution Project Manager -Public Works ITEM NO. q. I Commission, the City Council can then adopt a Resolution of Intent to Vacate Right-of--Way, thus notifying interested parties. A public hearing can then be conducted so the City Council can hear testimony related to said vacation. Finally, the City Council can adopt a Resolution Vacating Right-of- Way, if appropriate, and execute the necessary deed transferring the property to ACSPA. As part of the vacation of Parcel C, the City will reserve a 75 foot-wide storm drain easement over the existing open channel that extends along the Parks RFTA boundary. The City will also reserve the existing 10 foot-wide Public Service Easement (PSE) and Sidewalk Easement (SWE) granted across the southern property line where the parcel abuts Dublin Boulevard, and the 12 foot-wide PSE and SWE across the eastern property line where the parcel abuts Arnold Road. ANALYSIS: The new right-of--way of Dublin Boulevard conforms with the Land Use and Circulation (Section 5) of the General Plan, and the Traffic and Circulation (Section 5) of the Eastern Dublin Specific Plan because it follows the new alignment adopted by the Planning Commission on July 3, 1995. The Planning Commission, via Resolution Nos. 95-21, 95-22 and 95-23, found that the establishment of the new right- of-way is consistent with the Dublin General Plan and the Eastern Dublin Specific Plan in regard to location, purpose and extent. This new section of Dublin Boulevard was required to connect the developed area of the City of Dublin with the approved Eastern Dublin Specific Plan. ENVIRONMENTAL: The proposed right-of--way vacation is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15312 of the CEQA Guidelines. This exemption pertains to surplus government property. In compliance with the CEQA Guidelines, the right-of--way proposed to be vacated does not have significant value for wildlife habitat or other environmental purposes. RECOMMENDATION: Staff recommends that the Planning Commission determine that the vacation of a portion of Dublin Boulevard identified as Parcel "C" of Parcel Map 7395 and situated just west of Arnold Road is in conformance with the City of Dublin General Plan pursuant to Government Code §65402. C:1Documents and SettingslmarialLocal Settings\Temporary Internet Files10LK7F1PCagenda street vacation.doc RESOLUTION NO. 03 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN FINDING THE PROPOSED ABANDONMENT OF A PORTION OF DUBLIN BOULEVARD TO BE IN CONFORMANCE WITH THE DUBLIN GENERAL PLAN WHEREAS, Dublin Boulevard originally extended along the Parks RFTA boundary east of Arnold Road in anticipation of further development of the Santa Rita property; and WHEREAS, the new alignment for Dublin Boulevard from Iron Horse Parkway to Hacienda Drive was required by the Eastern Dublin Specific Plan and the Eastern Dublin General Plan; and . WHEREAS, the new alignment for Dublin Boulevard from Iron Horse Parkway to Hacienda Drive conforms with the Eastern Dublin Specific Plan and the Dublin General Plan; and WHEREAS, the establishment and determination of conformity of the new alignment for Dublin Boulevard from Iron Horse Parkway to Hacienda Drive was adopted by the Planning Commission Resolution Nos. 95-21, 95-22 and 95-23 on July 3, 1995; and WHEREAS, the approval of Parcel Map 7395 required,dedication and improvement of Dublin Boulevard along a new right-of--way line adopted by the City Council via Ordinance No. 8-95 on August 22, 1995, and required the former alignment to be vacated upon completion of Dublin Boulevard along this new alignment; and WHEREAS, the former alignment of Dublin Boulevard was identified as Parcel C on Parcel Map 7395, and the new alignment was identified as Parcel D; and WHEREAS, the City of Dublin proposes to vacate Parcel C in exchange for the Alameda County Surplus Property Authority (ACSPA) granting the right-of--way for Parcel D to the City; and WHEREAS, the improvements along the new Dublin Boulevard alignment (Parcel D) provides for public access, and is consistent with City standards; NOW, THEREFORE, BE IT RESOLVED that the City of Dublin Planning Commission finds that the abandonment of the segment of Dublin Boulevard identified as Parcel C on Parcel Map 7395 and situated just west of Arnold Road is in conformance with the City of Dublin General Plan pursuant to Government Code §65402.
