Positano Hills Park — Consultant Services Change Order

EXECUTIVE SUMMARY:
On January 18, 2011, the City Council approved an Agreement with MPA Design to complete
design services for Positano Hills Park. Staff is proposing additional consulting services through
the construction phase of the project.
FINANCIAL IMPACT:
On January 18, 2011, the City Council awarded an agreement, in the amount of $142,300, to
MPA Design for the design of the Positano Hills Park project (CIP #950013). This agreement
excluded construction period services. The additional cost of Construction Services is $25,542,
for a total agreement cost of $167,842. The total project budget will be updated based upon the
new Five Year Capital Improvement Program to be presented to the City Council in June. Given
that only one month remains in the current Fiscal Year, the majority of the costs will be incurred
in Fiscal Year 2012/2013.
RECOMMENDATION:
It is Staff's recommendation that the City Council approve Change Order #1 for MPA Design in
the amount of $25,542, to provide services during the construction period.

On January 18, 2011, the City Council approved an Agreement with MPA Design to complete
design services for Positano Hills Park. The original scope of work included design related
services through the project's bidding process and the scope excluded Construction Period
Services.

Staff is seeking approval of an amendment to the costs allowed under the original design
agreement to provide additional services through the construction phase of the project. This will
provide to allow for project continuity and quality control during construction which began in May
and will conclude in November 2012. The scope of services during construction that MPA
Design will provide include; site visits, attendance at project meetings, responding to requests
for information and review of submittals to ensure design intent is met. Further detail is provided
in the proposal submitted by MPA Design (Attachment 1) and a Change Order has been
prepared (Attachment 2).
