SUBJECT: Acceptance of Work — Contract No. 12 -02, Fiscal Year 2011 -2012 Annual
Sidewalk Safety Repair Program and Curb Ramp Installation

EXECUTIVE SUMMARY:
On April 3, 2012, the City Council approved an award of contract to AJW for Contract No. 12 -02,
Fiscal Year 2011 -2012 Annual Sidewalk Safety Repair Program and Americans Disabilities Act
Implementation (Curb Ramp Installation). The Contract was proposed to complete
improvements identified in two Capital Improvement Projects. The Annual Sidewalk Safety
Repair Program (CIP No. 949103) removed and replaced approximately 4,900 square feet of
sidewalk with offsets of 3/4 -inch or more that posed a tripping hazard. The Americans with
Disabilities Act (ADA) Transition Plan (CIP No. 939103) completed the installation of 10 new
curb ramps.
FINANCIAL IMPACT:
The amount authorized for expenditure under the contract awarded April 3, 2012 was $100,106.
The funding for the projects included both City General Funds and Congestion Management
Agency Funds. The General Fund Sidewalk project exceeded the authorized amount by
$1,650.75. There are funds remaining in the project budget to accommodate this additional
amount. The following table displays the expenditures compared to the

RECOMMENDATION:
Staff recommends that the City Council: 1) Accept the improvements under Contract No. 12 -02,
Fiscal Year 2011 -2012 Annual Sidewalk Safety Repair Program and Curb Ramp Installation; 2)
Approve an additional change order in the amount of $1,650.75 for General Fund Sidewalk
Repairs; and 3) Authorize the release of retention after 35 days if there are no subcontractor
claims.

The Annual Sidewalk Safety Repair Program (remove and replace) repairs sidewalk offsets of
3/4 -inch or more that may pose a tripping hazard. The remove and replace process is used in
locations where the offset is more significant or where tree roots are causing the offset. This
procedure requires the removal of the existing sidewalk and, in the case of root problems,
removal of the tree roots, and then replacement of the concrete sidewalk.
While maintenance of sidewalks and other frontage improvements is legally the responsibility of
the adjacent private property owner, the City Council has adopted a City- funded sidewalk repair
program on a year -by -year basis since 1983. The City Council extended funding for the City -
paid repair program for an additional year in the Fiscal Year 2011 -12 budget.
This year's Sidewalk Safety Repair Program removed and replaced approximately 4,900 SF
(Square Feet) of sidewalk with offsets of 3/4 -inch or more that were unsafe or posed a tripping
hazard. In addition, Congestion Management Agency Traffic Improvement Program (CMATIP)
grant funds were used to construct missing sidewalk on Sierra Court just north of Dublin
Boulevard. Although an amount was included for contingencies at the time of the bid award, the
number of locations requiring repair exceeded the contingency by $1,650.75. As part of the
acceptance of the work, the City Council is also requested to authorize an additional change
order in this amount. Funding is available in the project budget to accommodate this change.
ADA Curb Ramp Project (CIP #939103) included the construction of approximately ten (10)
pedestrian curb ramps. The ramps are funded by General Fund as identified in the ADA
Transition Plan.
Staff has reviewed the work performed under this contract and has determined that the work is
satisfactory and complete.
