SUBJECT: Acceptance of Landscape Improvements for Tract 6765, Schaefer Ranch
(Schaefer Ranch Holdings, LLC, a California Limited Liability Company)

EXECUTIVE SUMMARY:
Discovery Builders, dba Schaefer Ranch Holdings, LLC, has completed the landscape
improvements in accordance with the Landscape Improvement Agreement for Tract 6765. It is
now appropriate for the City to accept these improvements.
FINANCIAL IMPACT:
The City will incur maintenance costs for these improvements, estimated to be $47,133.57
annually, for landscape maintenance of the center island medians along Dublin Boulevard and
Schaefer Ranch Road. The project entry and other common landscaping areas will be
maintained by the Schaefer Ranch Homeowner's Association.
RECOMMENDATION:
Staff recommends that the City Council adopt the resolution for the Acceptance of Landscape
Improvements for Tract 6765, Schaefer Ranch (Schaefer Ranch Holdings, LLC).

Schaefer Ranch Holdings, LLC, has completed landscape improvements along Dublin
Boulevard, Schaefer Ranch Road, the project entry areas, and common areas of Tract 6765.
This work was governed by an Improvement Agreement executed on February 20, 2007, via
City Council Resolution No. 17 -07.
Since the landscape improvements have been constructed pursuant to the Landscape
Improvement Agreement and to the satisfaction of the City Engineer, it is appropriate for these
improvements to now be accepted by the City, with ongoing maintenance to be performed by

the City for the center island medians along Dublin Boulevard and Schaefer Ranch Road and by
the Schaefer Ranch Homeowner's Association for the project entry and common areas.
At the time that the City and Schaefer Ranch Holdings, LLC, executed the Landscape
Improvement Agreement, the developer provided a Performance Bond and a Labor and
Materials Bond, each in the amount of $1,365,900.00 (Bond No. 10457060), to guarantee
performance of the work. Now that the work is complete, these bonds may be released in
accordance with the authority contained in §66499.7 of the Government Code.

RESOLUTION NO. - 12
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTANCE OF LANDSCAPE IMPROVEMENTS FOR
TRACT 6765, SCHAEFER RANCH ( SCHAEFER RANCH HOLDINGS, LLC)
WHEREAS, Schaefer Ranch Holdings, LLC, the developer of Tract 6765, previously
entered into a Landscape Improvement Agreement dated February 20, 2007, Resolution No.
17 -07, with the City of Dublin, to complete improvements associated with Tract 6765, in
accordance with plans on file with the City Engineer; and
WHEREAS, said Landscape Improvement Agreement was secured by faithful
performance and payment bonds each in the amounts of $1,365,900.00 (Bond No. 10457060);
and
WHEREAS, the improvements are complete in accordance with said plans, and any
approved modifications thereto, to the satisfaction of the City Engineer; and
WHEREAS, the original bonds that guaranteed the improvements can be released, in
accordance with the authority contained in §66499.7 of the Government Code;
NOW, THEREFORE, BE IT RESOLVED that:
1. The landscape improvements completed within Tract 6765 are hereby accepted;
and
2. All deficiency items have been addressed and no new items are anticipated; and
3. The original Performance Bond issued by The Travelers Casualty and Surety
Company of America (Bond No. 104757060) in the amount of $1,365,900.00 be
released; and
4. The original Labor and Material Bond issued by The Travelers Casualty and
Surety Company of America (Bond No. 104757060) in the amount of
$1,365,900.00 be released.
PASSED, APPROVED AND ADOPTED this 17th day of July, 2012, by the following
