HomeMy WebLinkAboutItem 3.2 Fallon Vlg Jordan Rch Tr 8074STAFF REPORT DISTRICT CLERK File #600-60 FALLON VILLAGE GEOLOGIC HAZARD ABATEMENT DISTRICT DATE:July 17, 2012 TO: Honorable President and Board of Directors FROM: Joni Pattillo, City Manager, City of Dublin SUBJECT: Resolution Approving Agreement for Long Term Encroachment for Landscape Features with Tract 8074, within the Jordan Ranch Annexation to the Fallon Village Geologic Hazard Abatement District Prepared by Mark Lander, City Engineer for the City of Dublin EXECUTIVE SUMMARY: Mission Valley Properties, dba BJP-ROF Jordan Ranch LLC, has filed a Final Map for Tract 8074, Jordan Ranch, to create 129 individual lots for the construction of homes. The Agreement for Long Term Encroachment for Landscape Features with Tract 8074 provides for the -related landscape features within GHAD property, including trees, shrubs, and irrigation. FINANCIAL IMPACT: There will be no cost to the GHAD. Maintenance of landscape improvements within GHAD RECOMMENDATION: It is recommended that the Board of Directors adopt the Resolution Approving the Agreement for Long Term Encroachment for Landscape Features with Tract 8074, Jordan Ranch. Exhibit "A" to the Resolution, Agreement for Long Term Encroachment for Landscape Features within Tract 8074, Jordan Ranch Page 2 of 2 RESOLUTION NO. __-12 RESOLUTION OF THE BOARD OF THE FALLON VILLAGE GEOLOGIC HAZARD ABATEMENT DISTRICT * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * APPROVING AGREEMENT FOR LONG TERM ENCROACHMENT FOR LANDSCAPE FEATURES WITH TRACT 8074, JORDAN RANCH WHEREAS, a Vesting Tentative Map for Tract 8024 for Fallon Village was approved by City of Dublin Planning Commission Resolution No. 10-25 on May 11, 2010, with Conditions of Approval; and WHEREAS, said Conditions of Approval required the developer to construct project- related landscape features within the project; and WHEREAS, portions of these landscape improvements will be located within property owned by the Fallon Village Geologic Hazard Abatement District; and WHEREAS, maintaining landscaping improvements within District property, including irrigation; and WHEREAS, the developer has executed and filed with the City of Dublin a Tract Improvement Agreement to improve required Tract improvements, including said landscape features; and WHEREAS, the developer has executed and filed with the Fallon Village Geologic Hazard Abatement District an Agreement for Long Term Encroachment for Landscape Features with Tract 8074, Jordan Ranch. NOW, THEREFORE, BE IT RESOLVED that said Agreement is hereby approved. BE IT FURTHER RESOLVED that the District Manager is hereby authorized by the Board of Directors to execute the Agreement. BE IT FURTHER RESOLVED that the Clerk of this District is hereby directed to transmit said Agreement to the County Recorder for filing.
