The City's agreement with Washington Infrastructure Services, Inc. (WIS) contract for the Dublin Boulevard Widening project was for design and construction services. The construction services are provided on an on -call basis, as determined by the City. Due to the complexity of the project, the not -to -exceed time and materials fee has been exhausted. Staff is recommending a budget change to add $50,000 to fund WIS' work through the end of the project. DESCRIPTION: During construction of the Dublin Boulevard Widening project, WIS has responded to Contractor's requests for information and structural design clarifications at the City's request. Amendment No. 3 added a not -to -exceed amount of $50,000 for construction support services, but due to the complexity of the project, the contracted not -to -exceed time and materials fees have been exhausted. This is primarily due to unforeseen structural design changes and issues raised by the Contractor regarding the Alamo Canal Bridge. The bridge is being widened to six lanes as part of the road widening project and is only partly finished. To continue to respond timely to any further structural design clarifications it is necessary to add to WIS' contract an extension of their construction support services. The consultant has prepared a scope of work, and the compensation associated with the expanded scope of services is proposed at an amount not to exceed $50,000. Staff recommends that the City Council adopt the resolution approving Amendment No. 4 to the agreement with Washington Infrastructure Services, Inc., to expand the scope of work as described in WIS' letter dated February 11, 2003. --------------------------------------------------------- - - - - - - COPIES TO: James H. (FORMERLY MK CENTENNIAL), FOR CONSULTING SERVICES FOR THE WIDENING OF DUBLIN BOULEVARD FROM VILLAGE PARKWAY TO SIERRA COURT WHEREAS, the City Council of the City of Dublin approved an agreement for Preliminary Engineering and Environmental Services with Washington Infrastructure Services, Inc., for the Dublin Boulevard project from Village Parkway to Sierra Court, on November 16, 1999; and WHEREAS, the City of Dublin amended the agreement on July 18, 2000, to extend the scope of services to include the preparation of Plans, Specifications and Estimates for the said project with an additional compensation in the amount of $267,000 for a total aggregate amount of $411,000; and WHEREAS, the agreement was further amended on November 20, 2001, to expand the Scope of Work to include additional right-of-way survey work, bike path wall and creek slope protection design, additional landscaping and signal interconnect design, other miscellaneous work, and design services during construction at a cost of $139,164; and WHEREAS, the agreement was further amended on July 16, 2002, to expand the Scope of Work to include design services during construction at a cost of $30,000; and WHEREAS, it is proposed to amend the agreement to expand the Scope of Work to allow the consultant to respond to additional requests from the contractor performing the construction of said project for information and design clarification at a not-to-exceed amount of $50,000; NOW, THEREFORE, BE IT RESOLVED that the City Council o£the City of Dublin does hereby approve Amendment No. 4 to the agreement with Washington Infrastructure Services to expand the scope of work, as described in Exhibit "A", which is attached to this resolution. The design services during construction (DSDC) will be billed on a time and lnaterials basis. We will need to include time and materials for our subconsultants, Chaudhary & Associates and Haygood & Associates since these subconsukants are not included in your on-call service contracts that you have for the other subconsultm~ts used in design, Kleinfelder and Fehr & Peers Associates We xvill be amending their contracts accordingly based on receipt of an executed contract from the City or an authorization letter. We request the City send us an attthorization letter that approves the above work and authorization to proceed with DSDC pending an executed amendment for desigu service during construction. The design service during consn-action schedule will anticipate beghming February 11, 2003 and contimfing through construction. Construction is anticipated to be complete by September 30, 2003. 1. Design Services During Construction (DSDC) The CONSULTANT will provide design services during consmictions that include response to request for informatio.n (RFIs) and response to contract change orders (CCOs). These services will be provided on a t~me and material Basis during construction and are estimated to be $30,000. These services do not include inspection services, construction quality control services, utility coordination, as-buiks drawings (record drawings), record of survey or right-of-way record maps. Design services during construction for subconsultants will be limited to ser~dces by Chaudhary and Associates and Haygood and Associates. Their services will be provided on a time a material basis and are included in the estimated $30,000. No other subconsultants are included in these design services during construction, as the City will contract with the other subconsulants m~der separate contract.
