2012 Notice of Required Amendments to Conflict of Interest Code

EXECUTIVE SUMMARY:
This item is a notice to the City Council that an amendment to City’s Conflict of Interest Code is
required.

RECOMMENDATION:
Staff recommends that the City Council direct Staff to prepare an ordinance amending the City’s
Conflict of Interest Code.

DESCRIPTION:
The Political Reform Act requires every local government agency to review its Conflict of
Interest Code biennially to determine whether amendments to the Code are required. (See Cal.
Gov’t Code § 87306.5). The City’s Conflict of Interest Code is located in Chapter 2.24 of the
Municipal Code. The last ordinance amending the City’s Code was adopted on December 21,
2010.
The City Council is the code reviewing body for City agencies. Pursuant to Government Code
Section 87306.5, city departments must determine whether amendments to the Code are
necessary and notify the City Council by October 1, 2012 whether or not such amendments are
required. (See Cal. Gov’t Code § 87306.5).
This Staff Report serves as notice to the City Council that amendments to the City’s Conflict of
Interest Code are necessary in order to update the list of designated positions within the City
which are required by state law to disclose financial interests, and to ensure that those positions

are given the appropriate disclosure category. Upon the City Council’s direction, Staff will draft
an ordinance amending the City’s existing Conflict of Interest Code to include the changes
described above. After the revisions are complete, Staff will bring the ordinance to the City
Council for review and approval within ninety (90) days of today’s date. The City’s amended
code will not be effective until it has been adopted by the City Council. (See Cal. Gov’t Code §
87303).
Staff recommends that the City Council direct Staff to draft an ordinance amending the City’s
Conflict of Interest Code in accordance with the changes described above, and further direct
Staff to bring the ordinance back to the City Council for review and approval within ninety (90)
days of today’s date.
