FINANCIAL STATEMENT: None.
DESCRIPTION:
At the meeting of October 10, 1988, the City Council held public
hearings regarding the abandonment of the stub end of Rolling Hills Drive
(east of Creekside Drive) and the abandonment of Parcel A of Tract 4991. Both
items were continued in order to further research the City's control over the
construction and design of a proposed DSRSD pump station to be located on the
~.~~of_R°lling Hills Driv~.,and in order to investigate the subjects of
drainage an-~ weed abatement that were raised by the Council and the public.
As a brief review of the background of these items, at the time Tract
4991 (a part of the Kaufman and Broad single-family homes) was developed,
Rolling Hills Drive was perceived as being a through street that would cross
Creekside Drive and continue east into the yet-undeveloped Tract 5402 ("Dolan
School Site"). The City accepted the dedication of Rolling Hills, including
the stub end east of Creekside. Because the City felt that the street
connection might also be located elsewhere along Creekside Drive, the
developer was requested to offer the entire "Parcel A" for dedication;
however, "Parcel A" was not accepted at the time the Final Map was approved.
When the Tract 5402 was developed as Vista Green Terrace, Iglesia Drive
became the connector street. At the meeting of October 10th, the rejection of
a portion of Parcel A was rescinded and the portion of Iglesia Drive that
crosses Parcel A was accepted.
A number of questions and concerns were raised at the October 10th
meeting. Staff has addressed these questions and provides responses as
follows:

DSRSD Pump Station
Concerns raised by residents included possible noise, height, and
aesthetics of the proposed pump station. The City Attorney advises that if
the street right-of-way of Rolling Hills Drive is vacated but an easement is
reserved for water lines and appurtenant structures, DSRSD could use the
easement to construct the pump station. The City would not be able to control
the above aspects of the pump station if it were in place by virtue of an
easement. If the street right-of-way is not vacated, DSRSD .w__ould be required
to obtain A~ encroac~ent permit to construct the pump station, and the City
'wo-~u ~-~-Ave a certain amount of discretion to impose conditi-on~regarding noise
and height. The City would, however, have to continue to maintain the
remainder of ~ pu~ street, '~-n~--f~ Would have to remain open to the
PuB]Tic, The ~-i-f~"W-oh~i~'~I-~-~be subject to claims for any injuries occurring
on this stub street.
Staff met with Staff members of DSRSD regarding the proposed pump
station and determined that the only structure to appear above-ground would be
a couple of vent pipes and caps that would project about one foot above the
surface. The remainder of the pump station would be underground. Existing
pump stations were observed. The proposed pump station would be similar to
the one at Shannon Avenue. The pump stations appear to make very little noise
and were observed to be audible only if one stands right next to them.

questions that arise.
Maintenance of Open Space ,... ~ ~
Several residents commented on the condition of the open space portions
..................... 'of-~the~ Tract wt~ich,~ are~ to-be~i ~imate~-~-turnw~%'~ov-~r-'to- the-- homeowner~
association. The homeowners' association has hired the firm of Metro
Management to maintain this area when they receive it. The open space is part
of Bordeaux Estates and will be turned over once the landscaping in this open
space has been completed. The City Attorney feels that this property would
not be subject to the "Property Maintenance Ordinance" (Ordinance 13-88)
because of the definition of the word "property" within that ordinance.
However, weeds (as well as rubbish, refuse, and dirt) may be abated according
to the provisions of Government Code sections 39560 et. seq.
Currently, the Dougherty Regional Fire Authority conducts weed abatement
within the City of Dublin. This program has traditionally concentrated on
vacant lots and other property in the flatter areas of the City. Due to
growth occupancy in the hillside areas, the Fire Authority intends to expand
its inspection and abatement program to include areas which have been
designated as open space and other hillside areas. The Fire Authority is also
able to react to complaints regarding fire hazards due to weeds and other
materials.
A representative of the Fire Department will attend the meeting to
answer any questions that may arise regarding weed abatement.
Drainage
1) The Council asked Staff for a report on flooding that occurred
during the record storm of 1986. The holding sedimentation basin within the
Bordeaux Estates Phase 3 tract (5074) filled up and overflowed, carrying water
and silt down the north end of Creekside Drive. The first catch basin silted
up, causing water to overflow over the east side of Creekside and through the
then-undeveloped Dolan School Site. The problem was limited to the street
areas within Creekside Drive. After going through the Dolan site, the one
field inlet at the bottom corner of the site silted up and water overflowed
through two of the yards of homes fronting Castilian Road. Storm drains have
now been completed through the Dolan Site, and much of Bordeaux Estates has
been developed.
2) Also in relation to drainage, Mr. Walker of 8042 Iglesia Drive
commented that drainage structures both in his yard and on Creekside Drive
above him were clogged with sandbags and debris. The basin within Mr.
Walker's yard is on the City's Maintenance Department list for checking and
cleaning and for storm patrol, and the Maintenance Superintendent has reported

that the basins will be checked and cleaned by the time of the City Council
meeting. Tract 5402 is still under the developer's one-year warranty,
however, and Castle Construction has been asked to make repairs to Mr.
Walker's catch basin in order to minimize the possibility of future problems.
Recommendation
Parcel A is entirely within the control of the property owner, Kaufman
and Broad, insofar as maintenance is concerned. Parcel A was offered for
dedication as street right-of-way only and cannot be used by the City for any
other purpose. The City has no further need for the parcel as street right-
of-way. Adoption of the resolution abandoning Parcel A would negate the offer
of dedication.
The stub end of Rolling Hills Drive was accepted by the City as street
right-of-way but is not needed as a public street. DSRSD has requested
reservation of an easement for water lines and appurtenant structures. If the
City does not abandon this stub end of street right-of-way, there would be
some control over the construction of the pump station; however, the City
would then be obligated to maintain that piece of property and would be
subject to claims if any injuries were suffered on the property.
Staff recommends that the City Council conduct a public hearing and
adopt the resolutions abandoning the stub end of Rolling Hills Drive and
abandoning Parcel A of Tract 4991.

(ROLLING HILLS DRIVE EAST OF CREEKSIDE DRIVE)
Recitals
The City Council of the City of Dublin on August 22, 1988, passed its
Resolution of Intention No. 113-88 to vacate a portion of Rolling Hills Drive,
a public street in the City of Dublin as hereinafter described.
A public hearing was set for October 10, 1988, at which time any person
objecting to such vacation was given the opportunity to appear and show cause
why such vacation should not be ordered, and notice of such meeting was duly
published and posted.
Such hearing was held by the City Council on October 10, 1988, and
continued to October 24, 1988, and the City Council at the time of such
hearing determined that said portion of Rolling Hills Drive was unnecessary
for present or prospective public use.
NOW, THEREFORE, the City Council of the City of Dublin does
resolve as follows:
Section 1. That a portion of Rolling Hills Drive located within
the City of Dublin, Alameda County, California, is unnecessary for present or
prospective public use and said portion of Rolling Hills Drive is hereby
vacated and abandoned, reserving and excepting therefrom easements and rights
of way to construct, maintain, operate, replace, remove, renew and enlarge
sanitary sewers and potable water facilities now existing in said area,
including all necessary and convenient appurtenant structures and incidental
purposes thereto, including access; said portion of Rolling Hills Drive is
more particularly described as follows:

4991, offered for dedication as a public street in the City of Dublin as
hereinafter described.
A public hearing was set for October 10, 1988, at which time any person
objecting to such vacation was given the opportunity to appear and show cause
why such vacation should not be ordered, land notice of such meeting was duly
published and posted.
Such hearing was held by the City Council on October 10, 1988, and
hearing determined that said portion of Parcel A of Tract 4991 was unnecessary
for present or prospective public use.
NOW, THEREFORE, the City Council of the City of Dublin does
resolve as follows:

Dear Lee:
The District requests that a blanket easement be
established over the entire subject property. It is not
known at this date whether additional District facilities
will be constructed on the property or whether the
existing water main will be relocated. Therefore, as you
suggested, a blanket easement appears to be the most
appropriate action at this time.
