DESCRIPTION: At the meeting of August 22, 1988, the City Council adopted a resolution of intention to abandon the stub end of Rolling Hills Drive east of Creekside Drive. In accordance with the Government Code, Staff has published and posted copies of the resolution of intent and has provided notice to utilities in order that any utility company with existing facilities may request reservation of an easement. The only utility requesting an easement is DSRSD; copies of letters from all utilities are attached. At the time that Tract 4991 (a part of the Kaufman and Broad single- family homes) was developed, Rolling Hills Drive was perceived as being a through street that would cross Creekside Drive into Tract 5402, the Dolan School Site. Therefore, a stub end of Rolling Hills Drive was accepted as part of Tract 4991, as shown on Exhibit 3 attached. When Tract 5402 (the "Dolan Site") was developed as Vista Green Terrace by Castle Construction, Rolling Hills Drive was not extended. The street system was established using Iglesia Drive, which intersects south of the location originally anticipated. The stub end of Rolling Hills Drive is not needed for public street purposes, and the public rights to it should be abandoned. Staff recommends that the City Council conduct a public hearing and adopt the resolution abandoning the stub end of Rolling Hills Drive east of Creekside Drive and reserving the blanket easement requested by the Dublin San Ramon Services District. ITEM NO. ; m< '� COPIES TO: Kaufman & Broad RESOLUTION NO. -88 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN A RESOLUTION VACATING A PUBLIC STREET (ROLLING HILLS DRIVE EAST OF GKEEKSIDE DRIVE) Recitals The City Council of the City of Dublin on August 22, 1988, passed its Resolution of Intention No. 113-88 to vacate a portion of Rolling Hills Drive, a public street in the City of Dublin as hereinafter described. A public hearing was set for October 10, 1988, at which time any person objecting to such vacation was given the opportunity to appear and show cause why such vacation should not be ordered, and notice of such meeting was duly published and posted. Such hearing was held by the City Council on October 10, 1988, and the City Council at the time of such hearing determined that said portion of Rolling Hills Drive was unnecessary for present or prospective public use. NOW, THEREFORE, the City Council of the City of Dublin does resolve as follows: Section 1. That a portion of Rolling Hills Drive located within the City of Dublin, Alameda County, California, is unnecessary for present or prospective public use and said portion of Rolling Hills Drive is hereby vacated and abandoned, reserving and excepting therefrom easements and rights of way to construct, maintain, operate, replace, remove, renew and enlarge sanitary sewers and potable water facilities now existing in said area, including all necessary and convenient appurtenant structures and incidental purposes thereto, including access; said portion of Rolling Hills Drive is more particularly described as follows: Real property in the City of Dublin, County of Alameda, State of California, described as follows: THAT CERTAIN REAL PROPERTY SITUATED IN THE CITY OF DUBLIN, COUNTY OF ALAMEDA, STATE OF CALIFORNIA, DESCRIBED AS FOLLOWS: BEING A PORTION OF ROLLING HILLS DRIVE AS SAID STREET IS SHOWN ON THE FINAL MAP OF TRACT 4991, RECORDED IN BOOK 147 OF MAPS AT PAGE 75 ALAMEDA COUNTY RECORDS, MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE SOUTHERLY LINE OF SAID ROLLING HILLS DRIVE, AT THE MOST NORTHEASTERLY CORNER OF PARCEL A OF SAID TRACT 4991, SAID POINT BEING THE TRUE POINT OF BEGINNING: THENCE NORTH 2° 39' 37" WEST 58.01 FEET TO THE NORTHERLY LINE OF SAID ROLLING HILLS DRIVE; THENCE SOUTH 86° 21' 00" WEST EXHIBi'i 1 35.57 FEET; THENCE NORTH 48° 39' 00" WEST 28.28 FEET; THENCE SOUTH 3° 39' 00" EAST 98.00 FEET; THENCE NORTH 41° 21' 00" EAST 28.28 FEET, THENCE NORTH 86° 21' 00" EAST 34.56 FEET TO THE TRUE POINT OF BEGINNING. It is the intention of the City Council to vacate a portion of Rolling Hills Drive. Said Rolling Hills Drive is a public street in the City of Dublin, Alameda County, California, officially known and designated as such. Reference is hereby made to a map of said proposed vacation entitled "Vacate Rolling Hills Drive" dated August 15, 1988, on file in the Office of the City Clerk for particulars as to the proposed vacation. Notice~is hereby given that on October 10, 1988, at 7:30 p.m. at the Dublin Library, 7606 Amador Valley Boulevard, Dublin, California, any and all persons having any objections to the proposed vacation may appear before said Council and show cause why said proposed vacation should not be ordered. ' The City Clerk shall cause this Resolution of Intention to be posted in at least three (3) public places in the City of Dublin in accordance with Section 36922 of the Government Code. Said posting shall be not less than fourteen days prior to the date of hearing. This resolution shall be posted conspicuously along the line of said street to be vacated at least fourteen days before the date of hearing. Such resolution shall be posted not more than 300 feet apart, but at least three shall be posted, in accordance with Streets and Highways Code Section 8323. Notice in accordance with Streets and Highways Code Section 8322 shall be published for at least two succ6ssive weeks in a newspaper published in Alameda County. It is not known at this date whether additional District facilities will be constructed on the property or whether the existing water main will be relocated. Therefore, as you suggested, a blanket easement appears to be the most appropriate action at this time.
