FINANCIAL IMPACT: None. • RECOMMENDATION: Staff recommends that the City Council adopt the attached Resolution Authorizing the Extension of the Alameda County Abandoned Vehicle Abatement Program Submitted By Reviewed By Budget Manager/ Assistant City Manager Assistant to the City Manager DESCRIPTION: In 1990, the California State Legislature enacted legislation allowing for the creation of county- based vehicle abatement authorities, pursuant to the provisions of Section 22710 of the Vehicle Code. In 1993, the Alameda County Abandoned Vehicle Abatement Authority (AVA) was formed and imposed a one dollar ($1.00) annual vehicle registration fee on vehicles registered to an owner with an address in the County of Alameda. Vehicle registration fees are collected by the Department of Motor Vehicles and allocated by the State Controller to the AVA on a quarterly basis pursuant to Section 9250.7 of the Vehicle Code. Fees are then allocated to the AVA participating members based on an adopted formula that accounts for percentage of vehicles abated, population, and land area, in relation to the totals • for these factors in the AVA as a whole. The current participating agencies are the County of Page 1 of 2 ITEM NO. 4.2 Alameda, and all of the Alameda County Cities with the exception of Albany and Emeryville. Since the inception of the program almost twenty years ago, the AVA has received approximately $22.8 million, which has allowed the participating agencies to abate approximately 363,000 abandoned vehicles. As an example, the City of Dublin has averaged, over the past four years, approximately 440 vehicle abatements and has received approximately $32,000 annually. The current program is set to expire in May 2013. New legislation allows the local abatement authorities to extend the program every ten (10) years with the approval of the County (by 4/5’s vote) and a majority of the cities comprising a majority of the population of the unincorporated areas. The adoption of the attached resolution is the first step toward the extension of this important program. NOTICING REQUIREMENTS/PUBLIC OUTREACH: Not applicable. ATTACHMENTS: 1. XX - 11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN * * * * * * * * * * * EXTENSION OF THE ABANDONED VEHICLE ABATEMENT PROGRAM UNTIL MAY 31, 2023 WHEREAS, the Alameda County Abandoned Vehicle Abatement Authority was formed in 1993; and WHEREAS, since 1993, the Alameda County Abandoned Vehicle Abatement Authority and Program has provided approximately $22.8 million in county-wide which has supported the participating agencies in the abatement of approximately 363,000 abandoned vehicles in Alameda County; and WHEREAS, the Alameda County Abandoned Vehicle Abatement Program is set to expire May 31, 2013; and WHEREAS, new legislation allows for an extension of the Program with the approval of the County and a majority of the cities comprising a majority of the population of the incorporated areas; and WHEREAS , it is desirable to the City of Dublin to have the program continue. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin supports the extension of the Alameda County Abandoned Vehicle Abatement Program until May 31, 2023.
