HomeMy WebLinkAbout4.05 Grafton St Tr 7641or 19 82 /ii � 111 DATE: TO: FROM: STAFF REPORT CITY COUNCIL October 16, 2012 Honorable Mayor and City Councilmembers Joni Pattillo City Manager""' CITY CLERK File # 600 -60 SUBJECT: Acceptance of Improvements for Grafton Street (Central Parkway to Gleason Drive) - Tract 7641 (Sorrento West), and Approving Regulatory Traffic Control Devices at Grafton Street (Sorrento at Dublin Ranch I LP, a California Limited Partnership) Prepared by Mark Lander, City Engineer EXECUTIVE SUMMARY: Sorrento at Dublin Ranch I LP, a California Limited Partnership (Toll Bros), has constructed the Grafton Street improvements for Tract 7641 Sorrento West in accordance with the Improvement Agreement for Tract 7641. It is now appropriate for the City to accept these improvements and approve the regulatory traffic control devices. FINANCIAL IMPACT: Sorrento at Dublin Ranch I LP, a California Limited Partnership, has provided a Warranty Bond issued by Safeco Insurance Company of America, in the amount of $293,000.00 (Bond No. 6321873M), to guarantee against any defects in the Grafton Street improvements for a one -year warranty period. The City will incur annualized maintenance costs for these improvements, estimated to be $31,500 for energizing and maintaining traffic signals, street sweeping, street lighting (monthly), slurry seal (every five years), median landscaping, tree maintenance, and asphalt concrete pavement overlay (every 20 years). The decorative pavement along Gleason Street and at the circular intersections, as well as the pedestrian bridge over the street, will be maintained by the Sorrento West Master Homeowner's Association. The sidewalks and planter strip landscaping along the west side of Grafton Street will be maintained by the Sorrento West Master Homeowner's Association. The planter strip landscaping along the east side of Grafton Street will be maintained by the Sorrento East Master Homeowner's Association. The sidewalks along the east side of Grafton Street will be maintained by the adjacent tract Homeowner's Association of Sorrento East. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution Accepting Improvements for Grafton Street (Central Parkway to Gleason Drive) — Tract 7641, and Approving Regulatory Page 1 of 3 ITEM NO. 4.5 Traffic Control Devices at Grafton Street (Sorrento at Dublin Ranch I LP, a California limited partnership) Submitted By Director of Public Works DESCRIPTION: �?14 Reviewed By Assistant City Manager Sorrento at Dublin Ranch I LP, a California Limited Partnership, entered into a Tract Improvement Agreement with the City of Dublin on April 4, 2006, for the construction of street and other tract improvements associated with Tract 7641 (City Council Resolution No. 35 -06), encompassing the Sorrento West development in Dublin Ranch. These improvements included construction of Grafton Street between Central Parkway and Gleason Drive. Originally, SR Structured Lot Options provided Faithful Performance and Labor and Materials Bonds, each in the amount of $1,171,000.00 (Bond No. 6321873) issued by Safeco Insurance Company of America, to guarantee construction of the Grafton Street improvements. On October 2, 2007, the City deemed construction of the Grafton Street improvements to be more than 75% complete, and approved partial release of securities provided for the Grafton Street improvements (City Council Resolution 178 -07). The developer provided a Decreased Rider for both their Faithful Performance and Labor and Materials Bonds, each in the amount of $293,000.00 (Bond No. 6321873) to guarantee the construction of the remaining improvements for Grafton Street. On June 17, 2008, the City approved the Resolution Accepting Improvements and Approving Regulatory Traffic Control Device for the Grafton Street and Central Parkway Traffic Signal, (Resolution No. 99 -08). The First Amendment to the Agreement for Long Term Encroachments for Landscape Features with Tracts 7641, 7642, 7643, 7644, and 7645 will add the pedestrian bridge at Grafton Street to the list of improvements to be maintained by the Master Homeowner's Association for Sorrento West. The developer has recently completed construction of the Grafton Street improvements, and has requested that Grafton Street be formally accepted by the City. The $293,000.00 security for these improvements is no longer needed for that purpose; the developer has submitted a Warranty Bond, in the amount of $293,000.00, issued by Safeco Insurance of America (Bond No. 6321873M), to guarantee against construction defects for a one -year period. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: A. No parking on both sides of Grafton Street between Central Parkway and Gleason Drive. B. Crosswalk on Grafton Street at south side of intersection of Gleason Drive. C. Crosswalks on Grafton Street at intersection of Palermo Way. D. Crosswalks on Grafton Street at intersection of Capoterra Way. Page 2 of 3 E. Crosswalk on Grafton Street at the north side of intersection of Central Parkway. F. Circular intersection at Grafton Street/Palermo Way intersection. G. Circular intersection at Grafton Street/Capoterra Way intersection H. Pavement markings at Grafton Street between Central Parkway and Gleason Drive. I. Resolution Accepting Improvements for Grafton Street (Central Parkway to Gleason Drive) - Tract 7642, and Approving Traffic Regulatory Control Devices at Grafton Street (Sorrento at Dublin Ranch I LP, A California Limited Partnership) Page 3 of 3 RESOLUTION NO. - 12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING IMPROVEMENTS FOR GRAFTON STREET (CENTRAL PARKWAY TO GLEASON DRIVE) — TRACT 7641, AND APPROVING TRAFFIC REGULATORY CONTROL DEVICES AT GRAFTON STREET (SORRENTO AT DUBLIN RANCH I LP, A CALIFORNIA LIMITED PARTNERSHIP) WHEREAS, Sorrento at Dublin Ranch I LP, a California Limited Partnership, the developer of Tract 7641, previously entered into a Tract Improvement Agreement for Tract 7641 with the City of Dublin, dated April 4, 2006, Resolution No. 35 -06, to improve said Tract in accordance with the plans and specifications on file with the City Engineer; and WHEREAS, Sorrento at Dublin Ranch I LP, a California Limited Partnership, originally provided Faithful Performance and Labor and Materials Bonds issued by Safeco Insurance Company of America, each in the amount of $1,171,000.00, to guarantee said Grafton Street Improvements; and WHEREAS, the original Faithful Performance and Labor and Materials Bonds each in the amount of $1,171,000.00, had been previously reduced to $293,000.00, on October 2, 2007, Resolution No. 178 -07; and WHEREAS, the City previously approved the Resolution Accepting Improvements and Approving Regulatory Traffic Control Device for the Grafton Street and Central Parkway Traffic Signal on June 17, 2008 (Resolution No. 99 -08); and WHEREAS, the First Amendment to the Agreement for Long Term Encroachments for Landscape Features with Tracts 7641, 7642, 7643, 7644, and 7645 will add the pedestrian bridge at Grafton Street; and WHEREAS, the roadway improvements associated with Grafton Street from Central Parkway to Gleason Drive, are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, certain traffic regulatory control devices have been installed as part of the Grafton Street Improvements; and WHEREAS, the reduced Faithful Performance and Labor and Materials Bonds that guaranteed the Improvements can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with Warranty Bonds to guarantee the completed work for a one -year period following acceptance; and WHEREAS, Sorrento at Dublin Ranch I LP, a California Limited Partnership, has provided a Warranty Bond to guarantee the Improvements for a one -year period; NOW, THEREFORE, BE IT RESOLVED that: 1. The Grafton Street Improvements between Central Parkway and Gleason Drive completed with said project are hereby approved and accepted subject to a one - year guarantee period; and 2. The Labor and Materials Bond issued by Safeco Insurance Company of America in the amount of $1,171,000 for Grafton Street improvements (Bond No. 6321873), reduced to the amount of $293,000, be released; and 3. The Performance Bond issued by Safeco Insurance Company of America in the amount of $1,171,000 for the Grafton Street improvements (Bond No. 6321873), reduced to amount of $293,000, be released; and 4. The submitted Warranty Bond issued by Safeco Insurance Company of America in the amount of $293,000.00 for the Grafton Street Improvements between Central Parkway and Gleason Drive (Bond No. 6321873M) be accepted as security for the aforesaid one -year warranty period, said period to commence on this date and terminate on the 16th day of October, 2013. 5. The traffic regulatory control devices installed as part of the Grafton Street Improvements are hereby included in the City of Dublin Traffic Code, and said regulatory devices to include the following: a) No parking on both sides of Grafton Street between Central Parkway and Gleason Drive. b) Crosswalk on Grafton Street at south side of intersection of Gleason Drive. c) Crosswalks on Grafton Street at intersection of Palermo Way. d) Crosswalks on Grafton Street at intersection of Capoterra Way. e) Crosswalk on Grafton Street at the north side of intersection of Central Parkway. f) Circular intersection at Grafton Street/Palermo Way intersection. g) Circular intersection at Grafton Street/Capoterra Way intersection. h) Traffic signal modifications at the intersection of Grafton Street and Gleason Drive. PASSED, APPROVED AND ADOPTED this 16th day of October, 2012.
