(The All Seal Kompany) $28,250 B.U.R. Services $29,786 The second bid received is within the revised budget that was approved at the September 5m City Council meeting. DESCRIPTION: At the September 5, 2000, meeting, the City Council awarded Contract 00-11, Fire Station Surface Sealing, to The All-Seal Kompany (T.A.S.K.) and approved a revision to the adopted budget. T.A.S.IC has advised Staff that it will not be able to meet the requirements of the specifications and has therefore declined to sign the agreement. T.A.S.K. has performed other work for the City in a satisfactory manner but has experienced some recent difficulties, and it appears that it is in the best interests of both paxties to release T.A.S.K. and award the contract to the second bidder, B.U.R. Services. B.U.R. is currently working on the Civic Center Roof Repair project and is able to meet all the terms and conditions associated with the waterproofing project. The scope of work includes sealing of building envelope surfaces and epoxy sealing of an exterior metal staircase which is beginning to rust. B.U.R. 's bid is approximately $1,600 higher than the bid submitted by T.A.S.K., but is still within the revised budget that was approved by the City Council at the September 5th meeting. Staff recommends that the City Council adopt the resolution rescinding the award of bid to T.A.S.K. and awarding Contract 00-11 to B.U.R. RESOLUTION NO. -00 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN RESCINDING AWARD OF CONTRACT 00-11 FIRE STATION SURFACE SEALING TO T.A.S.K., INC. AND AWARDING CONTRACT TO B.U.R. SERVICES, INC. WHEREAS, the City of Dublin did, on August 22, 2000, publicly open, examine, and declare all sealed bids for doing the work described in the approved Plans, Specifications, and Modifications for Contract 00-11, Fire Station Surface Sealing, which Plans, Specifications, and Modifications are hereby expressly referred to for a description of said work and for all particulars relative to the proceedings under the request for bids; and WHEREAS, on September 5, 2000, the City Council awarded Contract 00-11 to the low bidder, T.A.S.K., Inc.; and WHEREAS, T.A.S.K., Inc. is unable to fulfill the terms and conditions of the specification; and WHEREAS, it is in the best interests of the City to rescind the award to T,A.S.K., Inc., and award Contract 00-11 to the second low bidder, B.U.R. Services; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby rescind the award of Contract 00-11 to T.A.S.K., Inc. and award City of Dublin Contract 00-11 to the lowest responsible bidder therefor, to wit B.U.R. Services, Inc., with a bid of Twenty-Nine Thousand Seven Hundred Eighty Six Dollars ($29,786), the particulars of which bid are on file in the Office of the City Engineer.
