AGENDA STATEMENT
CITY COUNCIL MEETING DATE: October 3, 2000
SUBJECT:
Request to waive the competitive bid process and authorization to solicit
and negotiate contractor bids to demolish the partially constructed
addition and to restore a single-family residence at 7957 Crossridge
Road to its original condition. Report Prepared by George Thomas,

RECOMMENDATION: 1.

Authorize the Building Official to distribute Requests for
Proposals to qualified California Licensed General Contractors and
determine associated costs and construction schedules for the
demolition of a partially constructed addition and restore the single-
family residence to its original condition.
Adopt the Resolution (Attachment 2) authorizing the Building
Official to negotiate an agreement with a California Licensed
General Contractor.
Instruct Staff to return with the selected contractor for award of bid
and necessary budget transfers.
FINANCIAL STATEMENT:
It will be necessary for the City to allocate general fund monies for the
abatement of the illegal addition. The associated abatement costs
including Staff and Attorney fees would be placed as a lien on the
subject property.
BACKGROUND:
During the City Council Meeting on September 19, 2000, City Staff identified the residence at 7957
Crossridge Road as substandard and dangerous. The addition that was started more than two and one-half
years ago and was never completed now constitutes a public nuisance. The City Council unanimously

agreed with the City Staff that the partially constructed addition needs to be immediately abated to reduce
the safety hazards to the neighborhood and building occupants. The lack of weather-protection of the
"open" addition and residence increases the need for timely action from the City to avoid further
deterioration of the residence. The City Council instructed staff to proceed with obtaining contractor bids
and complete the restoration as soon as possible.
Typically, the City' s Municipal Code Ordinance requires that major purchases or contracts for services be
subject to the competitive bid process. However, the Ordinance provides that the competitive bid process
may be waived under any of the following circumstances that apply to this situation:
· Contracts involving the acquisition of professional or specialized services;
· When an emergency requires that an order be placed with the nearest source of supply;
· For maintenance and repair of buildings and facilities
City staff is recommending that the City Council waive the requirement for competitive bids based on all
of the above listed circumstances. Waiving the competitive bid requirements should reduce the time
needed to make the necessary safety repairs to the residence and would result in reducing the risk to the
public and building occupants. Timely repair may also reduce the further deterioration of the structure
due to the current lack of weather protection.
CONCLUSION:
Staff will solicit bids from qualified license contractors, determine the best bids and negotiate an
agreement with the selected contractor when the best bid is established. Staff will return to the City
Council for award of bid and the necessary budget transfer. All costs associated with the contract
including Staff and Attorney fees will be tracked and an appropriate lien will be placed on the subject
property to insure that the City is reimbursed.
SCOPE OF WORK AT 7957 CROSSRIDGE ROAD
REQUIRING CONTRACTORS' BIDS
The scope of work involves demolishing a partially constructed addition and restoring the residence to its
original condition. The major items of work include:

Demolition of a partially constructed two-story framed addition of approximately 537 square feet.
The demolition would include removal of the partial roof framing and sheathing, removal of
sheared walls at the upper and lower stories, removal of the second floor flaming and sub-floor,
removal of interior framing for nonbearing walls and removal of the addition slab-on-grade
concrete foundation.
The scope of work would also include removal and replacement of any "original" structural and
nonstructural building components that might have been damaged as a result of the construction
work or lack of weather protection of the structure. Items such as warped, twisted and cut framing
members and weather exposed electrical components may require removal and replacement. Also,
wall and ceiling insulation and gypsum board may require evaluation, removal and replacement.
The residence will be restored to its "original" condition prior to the addition project (started under
Building Permit Number 97-997). The major items of work will include rebuilding the second
bedroom over the garage, rebuilding the roof area over the front of the residence, rebuilding the
roof area over the front entry (including replacing the front entry brick column) and residing the
house to match its original architectural appearance. The house will be restored to its original size
(approximately 1980 square foot) and configuration.
Finally, all work will be done under a new building permit and shall conform to the all applicable
and current codes and ordinances.
The scope of work will include all items to restore the residence to its "original" condition except the
following items:

The site will be let~ graded level but not planted or landscaped.
The work will not include interior painting, carpeting or finish work. The interior gypsum walls
and ceilings in both the rebuilt second story bedroom over the garage and within the first story
garage will be taped, topped and textured but not painted.
Window treatments and bedroom closet doors will not be part of this work.
Framing that was added or altered as part of the addition work and does not alter the building
configuration or reduce the building integrity will not be required to be removed. For example, the
double rim boards added above the garage wall and the additional floor/ceiling framing above the
existing garage could be let~ in place by the contractor.

RESOLUTION NO. - 2000
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
WAIVING THE COMPETITIVE BID PROCESS AND
AUTHORIZING STAFF TO OBTAIN BIDS FOR REPAIR OF THE SINGLE FAMILY
RESIDENCE LOCATED AT 7957 CROSSRIDGE ROAD
WHEREAS, the City Council Resolution Number 171-00 affirms the Chief Building
Official's determination that the single family residence located at 7957 Crossridge Road is
substandard and dangerous and declares the structure a public nuisance;
WHEREAS, the City Council Resolution Number 171-00 directs city staff to proceed with
the abatement of the substandard and dangerous residence by demolition of the partially completed
addition and repair of the residence to its original condition;
WHEREAS, Section 2.36.050(A)(1) of the Dublin Municipal Code provides that the
competitive bid process shall not apply when the City Council specifically waives the competitive
bid process and authorize staff to solicit and negotiate contracts involving the acquisition of
professional or specialized services, such as, services rendered by California Licensed General
Contractors specializing in residential demolitions and repairs;
WHEREAS, Section 2~36.050(A)(5) of the Dublin Municipal Code provides that the
competitive bid process shall not apply when the City Council specifically waives the competitive
bid process and authorizes staff to solicit and negotiate contracts involving emergencies, such as,
the need for abatement of an immediately dangerous structure;
WHEREAS, Section 2.36.050(A)(8) of the Dublin Municipal Code provides that the
competitive bid process shall not apply when the City Council specifically waives the competitive
bid process and authorizes staff to solicit and negotiate contracts involving the repair of buildings
and facilities; such as this substandard and dangerous residence;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin
pursuant to Section 2.36.050 of the Municipal Code (as amended); hereby waives the requirement
for a competitive bid and authorizes the Chief Building Official to solicit and negotiate an
agreement with a California Licensed General Contractor to demolish the partially completed
addition and restore the residence to its original condition.
BE IT FURTHER RESOLVED, that the Chief Building Official at the next City Council
Meeting will present the available Contractor bids and will also provide a recommendation to the
City Council to award the contract to the most favorable bidder.
