EXECUTIVE SUMMARY:
Staff is requesting that the City Council reaffirm their authorization to initiate a General Plan and
Eastern Dublin Specific Plan Amendment Study to change both the General Plan and Eastern
Dublin Specific Plan land use designations for a 14.32 acre parcel at the southwest corner of
Dublin Boulevard and Hacienda Drive from Campus Office to General Commercial /Campus
Office.
FINANCIAL IMPACT:
No financial impact to the City. All costs associated with preparing the General Plan and
Eastern Dublin Specific Plan Amendment Study, if authorized by the City Council, would be
borne by the Applicant.
RECOMMENDATION:
Staff recommends that the City Council: 1) Receive Staff presentation; 2) Take testimony from
the property owner and the public; 3) Deliberate; and 4) Adopt a Resolution approving the
initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study to change the
land use designation for a 14.32 acre parcel at the southwest corner of Dublin Boulevard and
Hacienda Drive from Campus Office to General Commercial /Campus Office.

Caruso Affiliated decided not to proceed with the acquisition of the property, and the Alameda
County Surplus Property Authority later entered into a Purchase and Sale Agreement with
Regency Centers. The Alameda County Surplus Property Authority has requested that the City
Council confirm their desire to initiate a General Plan and Eastern Dublin Specific Plan
Amendment Study (Attachment 3).
ANALYSIS:
It is the City Council's policy to initiate all General Plan and Specific Plan Amendment Studies
prior to Staff accepting an application and beginning work on such projects. The City Council
approved Resolution 164 -11 on September 20, 2011, which authorized a General Plan and
Eastern Dublin Specific Plan Amendment Study to begin on Site 16A. Staff has begun:
1. Determining the associated impacts from the land use change;
2. Conducting the appropriate level of environmental review and documentation;
3. Performing any additional studies that may be required; and will soon
4. Prepare an analysis for consideration by the Planning Commission and the City
Council.
Work on the General Plan and Eastern Dublin Specific Plan Amendment Study would be
completed concurrently with processing any other entitlements that are requested by the
Applicant, including a Planned Development Rezone and Site Development Review for the
proposed retail center. Once the General Plan and Eastern Dublin Specific Plan Amendment
Study is complete, Staff would then bring the application to the Planning Commission for their

recommendation to City Council. The project would then move forward to the City Council for
their consideration.
The City Council previously approved the initiation of a General Plan and Eastern Dublin
Specific Plan Amendment Study for this site. This subsequent action is being requested as a
formality by the property owner. Therefore, Staff prepared the attached Resolution approving
the initiation of a General Plan /Specific Plan Amendment Study for the City Council's
consideration (Attachment 4).
NOTICING REQUIREMENTS /PUBLIC OUTREACH:
Public noticing is not required to review a request to initiate a General Plan Amendment Study.
Although not required, the City mailed notices to all property owners and tenants within 300 feet
of the subject property. A notice was also published in the Valley Times and posted in the
designated posting places. A copy of this Staff Report was distributed to the Applicant and
Property Owner.
ENVIRONMENTAL REVIEW:
Staff recommends that the project be found exempt from the California Environmental Quality
Act (CEQA) under Section 15306, Class 6 of the State CEQA Guidelines because initiation of a
General Plan Amendment study, in and of itself, will not result in disturbance to an
environmental resource.

14.3 acre parcel currently owned by the Alameda County Surplus Property Authority,
located at the southwest corner of Dublin Boulevard and Hacienda Drive, from
"Campus Office" to "General Commercial/Campus Office ". The Amendment Study
was requested by me, as the property owner representative, and by Caruso Affiliated,
the proposed purchaser of Site 16A, in order to permit Caruso to develop the Site for
a retail project.
As you are aware, Caruso decided not to proceed with the purchase earlier this year
and the Surplus Property Authority issued a Request for Proposal for a retail
developer to proceed with a retail project at this location, resulting in the selection of
Regency Centers.
We thought it prudent, regardless of the selected retail developer, to confirm
ACSPA's desire, as the property owner, for the City to proceed with the previously
proposed amendments to the General Plan and Eastern Dublin Specific Plan to permit
retail uses on Site 16A, as we have discussed for some time with City staff
