Foss, Assistant City Manager EXECUTIVE SUMMARY: The City Council will consider a $10,000 donation to the American Red Cross to support the relief efforts for the victims of Hurricane Sandy. FINANCIAL IMPACT: In order to appropriate funds for this expenditure the City Council can consider a transfer from the contingency line item, in the General Fund Budget. The impact of using $10,000 from the budgeted contingency for this donation is shown on the Budget Change Form. RECOMMENDATION: Staff recommends that the City Council consider the $10,000 appropriation and authorize the Budget Change. Submitted By Assistant City Manager DESCRIPTION: At the City Council meeting of November 6, 2012, Mayor Sbranti asked that Staff prepare an item for the City Council’s consideration that would provide $10,000 to the American Red Cross to support the relief efforts for the victims of Hurricane Sandy. The City has provided similar assistance in the past. The City provided financial assistance for the victims of the South Asia tsunami in 2004 ($10,000), the victims of the September 11, 2001 attacks ($10,000), and the victims of Hurricane Katrina in 2005 ($20,000). The California Constitution prohibits the gift of public funds, however, an expenditure is not considered a “gift” if it serves a public purpose. If a City Council makes a determination that it does constitute a public purpose, courts have in the past supported this type of determination. As it relates to the recovery efforts from Hurricane Sandy, Staff believes that the City Council ITEM NO. ___8.3______ Page 1 of 2 can find that the donation would serve a public purpose by creating an atmosphere of reciprocal good will and that, should the City of Dublin or the Bay Area face a major catastrophe, the City might expect to receive similar donations from other communities.
