FINANCIAL STATEMENT: No cost to City.
DESCRIPTION:
In the attached letter, the City of Pleasanton requests that the City of Dublin
grant a three-foot-wide easement adjacent to a proposed retaining wall adjacent to
Scarlett Court. The retaining wall is part of the next phase of the Hopyard/I-580
Interchange project. The wall is needed for the proposed reconstruction of the
westbound 1-580 off-ramp to Dougherty Road.
Pleasanton's letter states, "The purpose of this easement is to protect the
integrity of the aggregate base foundation material from future encroachment by
utilities, road excavation, etc., or any encroachment that might cause differential
settlement of the retaining wall." The easement would be granted to the State of
California.

WHEREAS, the City of Dublin is the owner of Scarlett Court; and
WHEREAS, the State of California needs a permanent three-foot-wide
easement along a portion of Scarlett Court; and
WHERFAS, this easement is needed for the proposed reconstruction of the
westbound 1-580 offramp to Dougherty Road; and
WHEREAS, the City of Pleasanton has requested that Dublin grant this
easement to the State;
N(7~, THEREFORE, BE IT RESOLVED that the Dublin City Council does hereby
approve this grant of easement to the State of California.

CONCRETE FOOTING
FOR VALUABLE CONSIDERATION, receipt of which is hereby
acknowledged, the CITY OF DUBLIN, a municipal corporation, hereby
grants to the STATE OF CALIFORNIA, an easement for the extension
of a concrete footing and aggregate base on the following
described real property in the County of Alameda, State of
California, described in Exhibit "A", attached hereto and
incorporated herein by this reference, and entitled "Legal
Description of An Easement For Extension of a Concrete Footing
from the City of Dublin."

LEGAL DESCRIPTION
OF AN EASEMENT FOR THE
EXTENSION OF A CONCRETE FOOTING
FROM THE CITY OF DUBLIN
All that real property situate in the City of Dublin, County of Alameda,
State of California, described as follows:
Being a portion of Scarlett Court as said Scarlett Court is described in the
instrument recorded August 4, 1965 in Reel 1566 at Image 620, Official Records
of Alameda County, more particularly described as follows:
BEGINNING at the northwesterly end of the course described as "N 61° 40' 00" W
748.24'" in said instrument of Scarlett Court, said point being at the
beginning of a non-tangent curve concave to the northeast having a radius of
628.00 feet and to which point a radial line bears S 38° 34' 18" W; thence
northwesterly 15.78 feet along said curve through a central angle of
1° 26' 24" to a point on said curve to which a radial line bears
S 40° 00' 42" W; thence leaving said curve S 61° 40' 00" E 498.85 feet;
thence S 28° 20' 00" W 3.00 feet to the general southerly line of said
Scarlett Court, said point being on the general northerly line of Interstate
Route 580; thence northwesterly along the general southerly line of Scarlett
Court and the general northerly line of said Interstate Route 580,
N 61° 40' 00" W 483.35 feet to the point of beginning.
Containing 1473.812 square feet, more or less.

Re: Easement
Dear Mr. Thompson:
The next phase of construction on the Hopyard/I-580
interchange project is scheduled to begin in an early
June. As you know, reconstruction of the westbound 580
off-ramp to Dublin Boulevard is included in the
interchange improvements. This ramp reconstruction
requires the placement of a retaining wall adjacent to
Scarlett Court. Caltrans has requested the city of
Pleasanton to obtain a permanent easement from the City
of Dublin for a 3-foot wide strip adjacent to the new
retaining wall. The attached construction drawings
show the specific location of the necessary easement.
As you can see on Sheet RW-2, on the cross section
titled "Retaining Wall Special Excavation", this 3-foot
wide easement extends beyond the retaining wall
footing. The purpose of this easement is to protect
the integrity of the aggregate base foundation material
from future encroachment by utilities, road excavation,
etc., or any encroachment that might cause differential
settlement of the retaining wall.
We request that the City of Dublin grant to the State
of California a permanent easement for the purposes
described above. We would appreciate your expediting
this request through your City Council. We are
anticipating that Caltrans will issue an encroachment
permit to begin construction on Stage IB on May 15,
1986. Caltrans has informed us that all right-of-way
matters must be finalized by that date.
