SUBJECT: Agreement for Construction Management Services for Maintenance Yard Facility
and Public Safety Complex

EXECUTIVE SUMMARY:
On March 20, 2012, the City Council approved the Consulting Services Agreement for
construction management services with Bovis Lend Lease. Since that time, the Consultant
submitted a written request to be released from the Agreement due to staffing availability. Staff
solicited new proposals from other qualified firms for replacement and is recommending
approving an Agreement with Mack 5 for similar construction management services.
FINANCIAL IMPACT:
The total available project budget, as approved in the 2012 -2017 (CIP# 930010) Maintenance
Yard Facility Improvements, is $8,662,480 of which $247,330 is identified for construction
management services. The total available project budget as approved in the 2012 -2017 (CIP#
930016) Public Safety Complex is $2,758,420 of which $164,020 is identified for construction
management services. Sufficient funding is available in the project budget to approve the
Agreement with Mack 5 in the amount of $404,250.
RECOMMENDATION:
Staff recommends the City Council adopt the Resolution approving the Agreement with Mack 5
and accept the withdrawal request from Bovis Lend Lease.

DESCRIPTION:
On December 5, 2012, Staff received a written request from Bovis Lend Lease requesting to be
released from the Consultant Services Agreement for Construction Management Services on
both of the City's joint -use projects with Alameda County (Attachment 2). The request does not
adversely impact the project or the budget as no funds have been expended for this work.
As a result Staff prepared a Request for Proposals (RFP) for a new construction management
firm for both projects. Three firms supplied proposals by the deadline of December 21St
including Mack 5, O'Connor Construction Management, and PMA Consultants. Of the three,
Mack 5 provided the most comprehensive proposal that meets the City's needs for these
projects.
Attachment 1 is a Resolution releasing Bovis Lend Lease from the Agreement and approving an
Agreement with Mack 5 for the construction management services.
The Consultant is prepared to begin work as soon as possible. Authorization to bid for
construction of both sites is anticipated to be considered by City Council in March 2013.
NOTICING REQUIREMENTS /PUBLIC OUTREACH:
A copy of this Staff Report was sent to Mack 5.

APPROVING CONSULTANT SERVICES AGREEMENT FOR CONSTRUCTION
MANAGEMENT FOR THE CITY OF DUBLIN / ALAMEDA COUNTY JOINT USE
MAINTENANCE FACILITY AND THE CITY OF DUBLIN / ALAMEDA COUNTY JOINT
USE PUBLIC SAFETY FACILITY
WHEREAS, on March 20, 2012, the City Council authorized an agreement for
construction management services with Bovis Lend Lease for the City's Maintenance
Yard Facility and Public Safety Complex; and
WHEREAS, the consultant has requested release from the contract; and
WHEREAS, City staff finds this request to be acceptable; and
WHEREAS, the project still requires professional services for the work and three
qualified firms were contacted to provide proposals; and
WHEREAS, Mack 5 provided the most qualified proposal and is able to perform
the work; and
NOW, THEREFORE, be it resolved by the City Council of the City of Dublin that
the City Council does hereby approve the Agreement with Mack 5 for Construction
Management Services, and authorizes the City Manager to execute the Agreement.
PASSED, APPROVED AND ADOPTED this 5th day of February, 2013, by the
