HomeMy WebLinkAbout4.2 Tassajara Rd Accpt Imprvmtor 19 82 /ii � 111 DATE: May 7, 2013 TO: FROM: STAFF REPORT CITY COUNCIL Honorable Mayor and City Councilmembers Joni Pattillo City Manager""' CITY CLERK File #600 -60 SUBJECT: Acceptance of Improvements for Tassajara Road between North Dublin Ranch Drive and Shadow Hill Drive, Fallon Crossings, Tract 7617 (Standard Pacific) Prepared by Jayson Imai, Senior Civil Engineer EXECUTIVE SUMMARY: Standard Pacific Homes has constructed off -site improvements on Tassajara Road between North Dublin Ranch Drive and Shadow Hill Drive for the Fallon Crossings Development, Tract 7617, in accordance with their Improvement Agreement. It is now appropriate for the City to accept these improvements. FINANCIAL IMPACT: Standard Pacific Homes has provided a Warranty Bond issued by Berkeley Regional Insurance Company in the amount of $136,502.00 (Bond No. 0156326 -M), to guarantee the off -site street improvements on Tassajara Road associated with Tract 7617 for one year. Upon acceptance of the street improvements, the City will incur annualized maintenance costs estimated to be $5,500 for street sweeping, slurry seal (every five years) and asphalt concrete pavement overlay (every 20 years) of the additional pavement width on Tassajara Road. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution accepting the Off -Site Improvements on Tassajara Road between North Dublin Ranch Drive and Shadow Hill Drive for Fallon Crossings, Tract 7617. Submitted By Director of Public Works �?14 Reviewed By Assistant City Manager Page 1 of 2 ITEM NO. 4.2 DESCRIPTION: Standard Pacific Homes entered into an Improvement Agreement with the City of Dublin on December 20, 2011, for the construction of street and other tract improvements associated with the Fallon Crossings Development, Tract 7617 (City Council Resolution No. 208 -11). These improvements included the widening of Tassajara Road between North Dublin Ranch Drive and Shadow Hill Drive. Standard Pacific Homes provided Faithful Performance and Labor & Materials Bonds to guarantee construction of the Tassajara Road improvements. Separate bonds were provided for the in -tract grading and street improvements within Tract 7617. The improvements are now complete and the developer is requesting that the bonds for this work be released. Standard Pacific has submitted a Warranty Bond in the amount of $136,502 (Bond No. 0156326 -M), issued by Berkeley Regional Insurance Company, to guarantee against construction defects for a period of one year. The bond amount is equal to twenty five percent (25 %) of the full cost to construct the improvements. Resolution Accepting Improvements on Tassajara Road between North Dublin Ranch Drive and Shadow Hill Drive, Tract 7617, Fallon Crossings Page 2 of 2 VICINITY MAP NOT TO SCALE j RESOLUTION NO. - 13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING IMPROVEMENTS FOR TASSAJARA ROAD BETWEEN NORTH DUBLIN RANCH DRIVE AND SHADOW HILL DRIVE, FALLON CROSSINGS, TRACT 7617 WHEREAS, Standard Pacific Homes, the developer of Tract 7617, previously entered into a Tract Improvement Agreement for Tract 7617 with the City of Dublin, dated December 20, 2011, Resolution No. 208 -11, to improve said Tract including Off -site Tassajara Road Improvements in accordance with the plans and specifications on file with the City Engineer; and WHEREAS, Standard Pacific Homes originally provided Faithful Performance and Labor and Materials Bonds issued by Berkeley Regional Insurance Company of America, each in the amount of $546,009.00 (Bond No. 0156326), to guarantee said Tassajara Road Improvements; and WHEREAS, the roadway improvements associated with Tassajara Road between North Dublin Ranch Drive and Shadow Hill are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the Faithful Performance and Labor and Materials Bonds that guaranteed the Improvements can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with Warranty Bonds to guarantee the completed work for a one -year period following acceptance; and WHEREAS, Standard Pacific Homes has provided a Warranty Bond issued by Berkeley Regional Insurance Company in the amount of $136,502.00 (Bond No 0156326 -M) to guarantee the Improvements for a one -year period; NOW, THEREFORE, BE IT RESOLVED that: 1. The Tassajara Road Improvements between North Dublin Ranch Drive and Shadow Hill Drive completed with said project are hereby approved and accepted subject to a one -year guarantee period; and 2. The Labor and Materials Bond issued by Berkeley Regional Insurance Company of America in the amount of $546,009 for Tassajara Road improvements (Bond No. 0156326) be released in accordance with the Civil Code commencing with Section 8410; and 3. The Performance Bond issued by Berkeley Regional Insurance Company of America in the amount of $546,009 for the Tassajara Road improvements (Bond No. 0156326) be released.
