HomeMy WebLinkAboutPC Reso 89-060 PA89-127 EneaTPMRESOLUTION NO. 89 - 060 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 89-127 ENEA TENTATIVE MAP NO. 5783 WHEREAS, Ron Archer Civil Engineer, Inc., on behalf of Enea Plaza, a California Partnership, has requested approval of a Tentative Map to create two parcels within the Dublin City limits; and ~EREAS, the State of California Subdivision Map Act and the adopted City of Dublin Subdivision Regulations require that no real property may be divided into two or more parcels for the purposes of sale, lease or financing unless a Tentative Map is acted upon and a Final Map is approved consistent with the Subdivision Map Act and City of Dublin Subdivision Regulations; and ~EREAS, the Planning Commission held a public hearing on said application on December 4, 1989; and ~JHEREAS, proper notice of said public hearings was given in all respects as required by law; and ~ER~AS, this application has been reviewed in accordance with t~e provisions of the California Envirop~ental Quality Act, and has been found to have no significant environmental impact. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission finds that: 1. approves PA conditions: Tentative Map No. 5783 will not have substantial adverse effects on health or safety, or be substantially detrimental to the public welfare, or be injurious to property or public improvements. The proposed Tentative Map is consistent with the City's General Plan and City Zoning, related ordinances, and the Downto~n Specific Plan. The Tentative Map is consistent with street patterns, rights-of- way, utilities and public facilities planned for the area. Areas'proposed to be dedicated for public purposes will conform to minimum improvement standards so as not to be a future burden upon the community. The Tentative Map will not have a significant envirop~enta! impact. The site is physically suitable for the proposed development, in that a soils investigation report has been prepared and includes recommendations to insure site will be suitable for com_~ercia! development, This project will not cause serious public health problems in than all necessary utilities are, or will be, required to be available and Zoning, Building, and Plumbing Ordinances control the type of development, and the operation, of the uses to prevent health problems after development. BE IT FJRTHER RESOLVED THAT THE City of Dublin Planning Cor~ission 89-127, Enea Tentative Map No. 5783, subject to the following CONDITIONS OF APPROVAL Unless otherwise specified, the following conditions shall be comDlied with prior to the recordation of the Final Map. Each item is subiect to review and aoDroval by the Planning Department unless otherwise specified. GENERAL PROVISIONS The design and improvements of Enea Tentative Map No. 5783 shall be in conformance with the design and improvements indicated on the map labeled Attachment 1 on file with the Dublin Planning Department (PA 89-127) unless otherwise conditioned below. 2 An encroachment permit shall be obtained for any driveways for the lot. Address numbers for all development shall be visible from the street per Dougherty Regional Fire Department requirement. The Applicant shall provide DSRSD with plans showing the water and sewer services to the lots. If, during construction, archaeological remains are encountered, construction in the vicinity shall be halted, an archaeologist consulted, and the City Planning Department notified. If, in the opinion of the archaeologist, the remains are significant, measures, as may be required by the Plananing Director, shall be taken to protect them. DEDICATIONS A~YD PUBLIC IMPROVEMENTS 6. Prior to recordation of the final map, the final location of proposed sanitary sewer water lines shall be reviewed and approved by the Dublin San Ramon Services District. The applicant shall provide documentation that all Ordinance requirements of the District have been, or will be satisfied, prior to the issuance of building permits. 7. Prior to recordation of the final map, the proposed on-site drainage layout shall be redesigned so that it will not cross the future street righn-of- way. Each lot shall be graded as not to drain on any other lot or adjoining property prior to being picked up by an'approved drainage system. Any relocation of improvements or public facilities (with the exception of the future street) shall be accomplished at no expense to the City. DUST 10. Areas undergoing grading, and all other construction activities, shall be watered, or other dust-pallative measures used to prevent dust, as conditions warrant. 11. Dust control.measures, as approved by the City Engineer, shall be fo!!o~ed at all times during grading and construction operations. EASEMENTS 12. Existing and proposed access and utility easements shall be submitted for review and approval by the City Engineer prior to Final Map approval. These easements shall allow for practical vehicular and uciliny servic~ access for all areas. 13. A 10-foot public utility easement shall be sho,~n along all street frontages. Ail existing easements shall be shown on the Final Map unless evidence is furnished to the City showing that all parties having a right, title, or interest in a specific easement agree to its abandor~ent. 15. Required parking for this project is determined through a shared parking program for the existing and future developments on APN 9&1-1500-~0 & 38-1. Prior to recordation of the final map, a joint parking, maintenance and access agreement acceptable to the City Attorney and Public Works Director shall be recorded as a separate document prior to, or be recorded with the final map. -2- MISCELLANEOUS 16. Except as specifically altered by the above Conditions of Approval, development of the project site shall comply with the conditions established for Planned Development District zoning PA 87-178, PA 87-018 and PA 89-028 (Site Development Review for Enea Plaza ti). 17. Copies of the Final Map and improvement plans, indicating all lots, streets, and drainage facilities within the subdivision shall be submitted at 1" - 400 feet scale and 1" - 200 feet scale for City mapping purposes, one mylar copy and one blackline copy of the Final Map shall be delivered to the City after the map has been recorded. Three copies of the signed improvement plans shall be delivered to the City for inspection purposes. One reproducible and one blackline print of the improvement plans shall be delivered after "as-built" conditions have been incorporated. 18. The developer shall keep adjoining public streets free and clean of project dirt, mud, materials, and debris during the construction period, as is found necessary by the City Engineer. 19. Ail improvements within the public right-of-way, including curb gutter, sidewalks, driveways, paving, and utilities, must be constructed in accordance with approved standards and/or plans. 20. The developer will comply with all zoning provisions, including Zoning Ordinance and rezoning Conditions of Approval. 21. The applicants shall be advised that substantial modification to the approved Site Development Review application, PA 89-023, or filing a new application for Site Development Review on the project site may result in a condition requiring a new subdivision of the subject property or a lot line consolidation of said property.
