HomeMy WebLinkAboutReso 102-96 Caltrans/I-680 agmtRESOLUTION NO. 102 - 96 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING MODIFICATION TO THE FREEWAY AGREEMENTS BETWEEN THE STATE OF CALIFORNIA AND THE CITY OF DUBLIN DATED OCTOBER 30, 1964, RELATING TO THAT PORTION OF STATE HIGHWAY ROUTE 680 (FORMALLY KNOWN AS ROUTE 107) BETWEEN THE SOUTH CITY LIMITS AND THE CONTRA COSTA COUNTY LINE WHEREAS, the State of California and the County of Alameda have entered into a Freeway Agreement dated October 30, 1964, relating to that portion of State Highway Route 680 (formally known as Route 107) between the South City Limits and the Contra Costa County line; and WHEREAS, the City of Dublin has subsequently annexed certain areas including portions of such freeway covered by said Freeway Agreement dated October 30, 1964, with the County of Alameda; and WHEREAS, studies show that it is necessary to construct a direct connector ramp and local access ramps to reduce traffic congestion for existing conditions and planned future growth; and WHEREAS, the cost of construction of said connector and ramps shall be borne by the Alameda County Transportation Authority; and WHEREAS, the plan map marked Exhibit A of the Freeway Agreement 'has been prepared by the Department of Transportation showing said construction of the connector and ramps as it affects streets of the City; and WHEREAS, the State of California, through its Department of Transportation, requests that the City (by resolution) approve said connector and ramps construction, make changes affecting City streets as shown on the map marked Exhibit A of the Freeway Agreement; and WHEREAS, said condition and revisions as shown on the plan map marked Exhibit A of the Freeway Agreement have been reviewed and approved by the Director of Public Works of the City of Dublin, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin hereby approves the modification to the Freeway Agreement dated October 30, 1964, to revise the freeway plan as shown on the map marked Exhibit A of the Freeway Agreement to construct connector and access ramps between the South City Limits and the Contra Costa County Line. BE IT FLIRTHER RESOLVED that the City of Dublin agrees and consents to accept control and maintenance over each of the relocated or reconstructed City streets and the frontage roads, and other State constructed local roads upon receipt of written notice to the City from the State that the work ~""'thereon has been completed. BE IT ALSO FLIRTHER RESOLVED that the City Council does hereby approve the "Freeway Agreement" for the above street connections and authorizes the Mayor of the City of Dublin to execute said Agreement on behalf of the City of Dublin. Mayor K2/8-13-96/reso-fwy. doc g:agenmisch'esofwy 2 04-Ala-680-KP R32.5/R35.2 (PM R20.2/R21.9) In Dublin between the South City Limits and the Contra Costa County Line FREEWAY AGREEMENT THIS AGREEMENT, made and entered into on this day of ,19 , by and between the STATE OF CALIFORNIA acting by and through the Department of Transportation (herein referred to as "STATE"), and the City of Dublin (herein referred to as "CITY"), WITNESSETH: WHEREAS, the highway described above has been declared to be a freeway by resolution of the California Transportation Commission on April 27, 1960; and WHEREAS, STATE and COUNTY have entered into a Freeway Agreement dated October 30, 1964, relating to that portion of State Highway Route 680 (formally Route 107) between Arroyo Mocho and the Contra Costa County line; and WHEREAS, CITY has subsequently annexed certain areas including portions of such freeway covered by said Freeway Agreement dated October 30, 1964 with the County of Alameda; and WHEREAS, a revised plan map for such freeway has been prepared showing the proposed plan ~f the STATE as it affects streets of the CITY; and WHEREAS, it is the mutual desire of the parties hereto to enter into a new Freeway Agreement in accordance with the revised plan of said freeway; and NOW, THEREFORE, IT IS AGREED: 1. This Agreement supersedes that portion of said Freeway Agreement dated October 30, 1964, in Dublin between the South City Limits and the Contra Costa County line. 2. CITY agrees and consents to the closing of CITY streets, relocation of CITY streets, construction of frontage roads and other local roads, and other construction affecting CITY streets, all as shown on the plan map attached hereto marked Exhibit A and made a part hereof by this reference. 3. STATE shall, ip. construction of the freeway and at STATE'S expense, make such changes affecting CITY streets in accordance with the plan map attached hereto marked Exhibit A. 4. STATE agrees to acquire all. necessary fight of way as may be required for construction, reconstruction, or alteration of CITY streets, frontage roads, and other local roads, and CITY hereby authorizes STATE to acquire in its behalf all such necessary fight of way. 5. It is understood between the parties that the fight of way may be acquired in sections or units, and that both as to the acquisition of fight of way and the construction of the freeway projects, the obligations of the STATE hereunder shall be carried out at such time and for such unit or units of the projects as funds are budgeted and made lawfully available for such expenditures. 6. CITY will accept control and maintenance over each of the relocated or reconstructed CITY streets, and the frontage roads, and other STATE constructed local roads on receipt of written notice to CITY from STATE that the work thereon has been completed, except for any portion which is adopted by STATE as part of the freeway proper. CITY will accept title to the portions of such roads lying outside the freeway limits upon relinquishment by STATE. 7. This Agreement may be modified at any time by the mutual consent of the parties hereto, as may become necessary for the best accomplishment, through STATE and CITY cooperation, of the whole freeway project for the benefit of the people of the STATE and of the CITY.
