HomeMy WebLinkAboutReso 120-96 FMap Tr6822RESOLUTION NO. 120 - 96 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING FINAL MAP FOR TRACT 6822 AND ENTERING INTO AGREEMENT WITH ALAMEDA COUNTY FOR FUTURE PARKLAND DEDICATIONS (CALIFORNIA CREEKSIDE) WHEREAS, the Final Map for Tract No. 6822, in the incorporated territory of the City of Dublin, State of California, has been presented to this City Council for approval, all in accordance with the provisions of the Subdivision Map Act of the State of California and the City of Dublin Municipal Code; and WHEREAS, the Developer, Kaufman and Broad of Northern California, Inc., has executed and filed with the City of Dublin a contract to improve Tract No. 6822 in accordance with the Final Map of said Tract No. 6822, the Tract improvement plans and specifications attached thereto; and WHEREAS, said contract is secured by a bond in the amount of $4,416,700 conditioned upon faithful performance of said contract; and WHEREAS, said contract is secured by a bond in the amount of $2,208,350 for the benefit of laborers and materialmen upon the work and improvements, conditioned upon payment for labor performed or material furnished under the terms of said contract; and WHEREAS, as a condition of the Development between the City of Dublin, The Surplus Property Authority of the County of Alameda and Kaufman and Broad of Northern Califomia, Inc., recorded July 15, 1996, the Surplus Property Authority of the County of Alameda is to dedicate 3.69 acres of Parkland; and WHEREAS, The City of Dublin is not prepared at this time to identify the exact location of the Parkland dedication; NOW, THEREFORE, BE IT RESOLVED that said contract and bonds be and they are hereby .~pproved. Page 1 BE IT FURTHER RESOLVED that the Final Map of Tract 6822 be and the same is hereby approved; and that rights to areas marked as Dublin Boulevard, Hibernia Drive, Mangrove Drive, Fawn Way, Boxwood Way, Finch Way, Myrtle Drive, Hawk Way, Owl Court, Sparrow Court, Peacock Court, Pheasant Court, and Central Parkway, lots "BB", "CC" and "DD", Public Utility Easement (P.U.E.), Public Service Easement (P.S.E.), Emergency Vehicle Access Easement (E.V.A.E.), and Storm Drain Easement (S.D.E.), as offered for dedication to public use in conformity with the terms of dedication be, and they are hereby accepted; and that the Clerk of this City Council be and is hereby directed to transmit said Map to the County Recorder for filing; BE IT FURTHER RESOLVED that the City Council accepts the agreement between the City of Dublin and The Surplus Property Authority of the County of Alameda to dedicate 3.69 acres of Parkland to the City at a time and location to be determined by the City and that the Mayor is hereby authorized to sign the agreement on behalf of the City.
