HomeMy WebLinkAboutItem 4.07 Public Safety Complex Accpt Imprmt STAFF REPORT CITY CLERK File #600-35 CITY COUNCIL DATE:June 18, 2013 TO: Honorable Mayor and City Councilmembers FROM: Joni Pattillo, City Manager SUBJECT: Acceptance of Improvements for Public Safety Complex Demolition Project, Contract No. 13-02 Prepared by Herma Lichtenstein, Parks and Facilities Development Manager EXECUTIVE SUMMARY: Staff is seeking City Council authorization to accept the Public Safety Complex Demolition Project, Contract No. 13-02. FINANCIAL IMPACT: The total project budget identified in the 2012-2017 Capital Improvement Program (CIP), Public Safety Complex (Project No. 930016) includes a total of $2,758,420, available in Fiscal Year 2012-2013 of which $500,000 was anticipated for the demolition project. This project is funded by the General Fund. The following is a summary of the anticipated versus the actual improvement costs: Total Available Construction Budget $500,000 Construction Contract $336,868 Change Orders 1 and 2 $12,198 Total Project Cost $349,066 Remaining Construction Budget $150,934 RECOMMENDATION: Staff recommends the City Council adopt Resolution Accepting improvements to Public Safety Complex Demolition Project, Contract #13-02; and authorize Staff to accept a maintenance bond in the amount of $33,687. ITEM NO. 4.7 Page 1 of 2 Submitted By Reviewed By Reviewed By Parks and Community Administrative Assistant City Manager Services Director Services Director DESCRIPTION: On February 19, 2013, the City Council awarded the bid for demolition for the Public Safety Complex at 6363 Clark Avenue to Central Valley Environmental Group. The improvements included demolition of all existing interior improvements, selected site work, and installation of temporary maintenance facilities for the City of Dublin. The demolition was the first phase of the work to complete the overall Public Safety Complex project. Staff is requesting that the City Council authorize the City Manager to accept the improvements. The City presently holds a performance bond to provide the necessary security for the performance of the work involved. As the work is now complete, the performance security requirement can be reduced, in accordance with authority contained in Section 66499.7 of the Government Code, to an amount necessary to guarantee warranty of the work for a one-year period following acceptance of the work. The Contractor will provide a new maintenance bond in the amount of $33,687, which is 10% of the contract amount ($336,868), and is sufficient to cover the one-year guarantee period. NOTICING REQUIREMENTS/PUBLIC OUTREACH: A copy of the Staff Report was sent to the Contractor. Upon Acceptance a notice of completion will be filed with Alameda County. ATTACHMENTS: 1. XX - 13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN * * * * * * * * * * * ACCEPTING IMPROVEMENTS OF THE PUBLIC SAFETY COMPLEX DEMOLITION PROJECT, CONTRACT #13-02 WHEREAS, Central Valley Environmental Group entered into a contract with the City of Dublin for demolition and remediation of the first phase of the Public Safety Complex at 6363 Clark Ave in accordance with plans and specifications on file with the City Engineer; and WHEREAS, said improvements have been completed in accordance with said plans and specifications, and any approved modifications thereof, to the satisfaction of said City Engineer of the City of Dublin; and WHEREAS, as a condition of said contract, Central Valley Environmental Group is required to provide a warranty for the improvements for a period of one year following acceptance of the work by the City of Dublin; and WHEREAS , the improvements are now completed, and the original performance bond security requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California, to an amount found necessary to guarantee maintenance of the completed work for the aforesaid one-year period. NOW, THEREFORE,RESOLVE: the City Council of the City of Dublin does 1. To authorize the City Manager to approve and accept the improvements completed at 6363 Clark Ave, subject to the aforesaid one-year warranty; and 2. To reduce the aforesaid performance bond security requirement from the amount of $336,868 to the amount of $33,687 upon acceptance by the City Manager of the replacement maintenance bond as security for the aforesaid one-year maintenance period; and 3. To release upon acceptance of said warranty the said original performance bond posted in connection with the work involved in the construction of said Facility.
