It is now appropriate for the City to accept these improvements and approve the regulatory traffic control devices. FINANCIAL IMPACT: BJP -ROF Jordan Ranch LLC has provided a Warranty Bond issued by International Fidelity Insurance Company in the amount of $498,635.00 (Bond No. 0571492), to guarantee against any defects in the off -site improvements for Tract 8024 for a one -year warranty period. The City will incur annualized maintenance costs for these improvements, estimated to be $17,800 for traffic signals, street sweeping, street lighting (monthly), slurry seal (every five years), median landscaping, tree maintenance and asphalt concrete pavement overlay (every 20 years). The Jordan Ranch Master Homeowner's Association will maintain the parkway landscape areas along the eastern side of Fallon Road, between Dublin Boulevard and Positano Parkway and the eastern side of Positano Parkway, from Fallon Road to the northern boundary of Tract 8024. The City will maintain the medians and median landscaping on Fallon Road, between Dublin Boulevard and Positano Parkway and on Positano Parkway from Fallon Road to the northern boundary of Tract 8024. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution accepting the Off -site Improvements for Tract 8024; accepting the Traffic Signal at Positano Parkway and Vinton Avenue; approving Traffic Signal Modifications at Fallon Road and Central Parkway; and Page 1 of 2 ITEM NO. 4.3 approving the Regulatory Traffic Control Devices installed with the Off -Site Improvements for Tract 8024 — Jordan Ranch, Phase One. Submitted By Director of Public Works DESCRIPTION: �?14 Reviewed By Assistant City Manager BJP -ROF Jordan Ranch, LLC entered into a Tract Improvement Agreement with the City of Dublin on December 6, 2011 (City Council Resolution No. 203 -11) for the construction of streets, sidewalks, medians, landscaping, joint trench, street lighting, traffic signal installation, traffic signal modification and other off -site improvements associated with the Jordan Ranch Development, Tract 8024, along Fallon Road between Dublin Boulevard and Positano Parkway and along Positano Parkway between Fallon Road and Vinton Avenue. BJP -ROF Jordan Ranch LLC provided Faithful Performance and Labor & Materials Bonds, each in the amount of $498,635 (Bond No. 0571492) issued by International Fidelity Insurance Company, to guarantee the construction of the of improvements along Fallon Road and Positano Parkway. Because the improvements were estimated to be more than seventy five percent (75 %) complete at the time the Tract Improvement Agreement was executed, the bond amounts were set at twenty five percent (25 %) of the total cost of the improvements. The improvements are now complete and the developer is requesting that the bonds for this work be released. BJP -ROF Jordan Ranch LLC has submitted a Warranty Bond in the amount of $498,635.00, issued by International Fidelity Insurance Company (Bond No. 0571492), to guarantee against construction defects for a one -year period. The bond amount is equal to twenty five percent (25 %) of the full cost to construct the improvements. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: A. Traffic signal at the intersection of Positano Parkway and Vinton Avenue B. Traffic signal modifications at the intersection of Central Parkway and Fallon Road C. "No Stopping Anytime" and "Do Not Pass" signing on Fallon Road between Dublin Boulevard and Positano Parkway. NOTICING REQUIREMENTS /PUBLIC OUTREACH: A copy of this staff report has been sent to BJP -ROF Jordan Ranch, LLC. ATTACHMENTS: 1. Location Map 2. Resolution accepting the Off -site Improvements for Tract 8024; accepting the Traffic Signal at Positano Parkway and Vinton Avenue; approving Traffic Signal Modifications at Fallon Road and Central Parkway; and approving the Regulatory Traffic Control Devices installed with the Off -Site Improvements for Tract 8024 — Jordan Ranch, Phase One Page 2 of 2 W ry O ry GV08 Nb'7000 W 3N171 /Wl7.1110 W O I W J I a a OVOY ONYVH0 73 N bbl /Spo, N077V-4 I Q o avod 3N/-,77 ; L-LJ z v o > Q Q U m � � z o � m z 0 OV08 b'YVPVSSVL � o� z o � � d1NVS LLJ � v RESOLUTION NO. -13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING THE OFF -SITE IMPROVEMENT FOR TRACT 8024; ACCEPTING THE TRAFFIC SIGNAL AT POSITANO PARKWAY AND VINTON AVENUE; APPROVING TRAFFIC SIGNAL MODIFICATIONS AT FALLON ROAD AND CENTRAL PARKWAY; AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES INSTALLED WITH THE OFF -SITE IMPROVEMENTS FOR TRACT 8024 JORDAN RANCH, PHASE ONE WHEREAS, RJP -ROF Jordan Ranch LLC, the Developer of Tract 8024, previously entered into a Tract Improvement Agreement, dated December 6, 2011, Resolution No. 203 -11, with the City of Dublin to complete improvements for Tract 8024, including off -site improvements along Fallon Road and Positano Parkway, traffic signal modifications at the intersection of Central Parkway and Fallon Road and traffic signal installation at the intersection of Positano Parkway and Vinton Avenue in accordance with plans and specifications on file with the City Engineer; and WHEREAS, RJP -ROF Jordan Ranch LLC originally provided Faithful Performance and Labor & Materials Bonds issued by International Fidelity Insurance, each in the amount of $498,635 (Bond No. 0571492), to guarantee said improvements; and WHEREAS, the off -site improvements along Fallon Road and Positano Parkway are complete in accordance with said plans and specifications and any modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the traffic signal modifications at the intersection of Central Parkway and Fallon Road are complete in accordance with said plans and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the traffic signal installation at the intersection of Positano Parkway and Vinton Avenue is complete in accordance with said plans and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, certain traffic regulatory devices have been installed as part of the off -site improvements; and WHEREAS, the Faithful Performance and Labor & Materials Bonds that guaranteed the off -site improvements for Tract 8024 can be released in accordance with the authority contained in §66499.7 of the Government Code of the State of California and replaced with a Warranty Bond to guarantee the completed work against any defects for a one -year period following acceptance; and 1 WHEREAS, BJP -ROF Jordan Ranch LLC, has provided a Warranty Bond in the amount of $498,635.00 issued by International Fidelity Insurance Company (Bond No. 0571492) to guarantee the improvements against defects for a one -year period; and WHEREAS, the traffic signal modifications at the intersection of Fallon Road and Central Parkway is a regulatory traffic control device; and WHEREAS, the traffic signal at the intersection of Positano Parkway and Vinton Avenue is a regulatory traffic control device; NOW, THEREFORE, BE IT RESOLVED that: 1. The off -site improvements for Tract 8024 are hereby approved and accepted subject to a one -year guarantee period; and 2. The submitted Warranty Bond issued by International Fidelity Insurance Company in the amount of $498,635 (Bond No. 0571492) for the off -site improvements for Tract 8024, including the traffic signal at the intersection of Positano Parkway and Vinton Avenue, and the traffic signal modifications at the intersection of Central Parkway and Fallon Road, be accepted as security for the aforesaid one -year warranty period, said period to commence on this date and terminate on the 16th day of July, 2014; and 3. The original Faithful Performance Bond issued by International Fidelity Insurance Company (Bond No. 0571492) in the amount of $498,635 for the off -site improvements for Tract 8024, be released; and 4. The original Labor & Materials Bond issued by International Fidelity Insurance Company (Bond No. 0571492) in the amount of $498,635.00 for the off -site improvements for Tract 8024, be released; and 5. The regulatory traffic control devices installed by the developer within the City's right -of -way are hereby included in the City of Dublin Traffic Code, and said regulatory devices include the following: • Traffic signal at the intersection of Positano Parkway and Vinton Avenue • Traffic signal modifications at the intersection of Central Parkway and Fallon Road • "No Stopping Anytime" and "Do Not Pass" signs along Fallon Road between Dublin Boulevard and Positano Parkway 2 PASSED, APPROVED AND ADOPTED this 16th day of July, 2013, by the following vote: AYES: NOES: ABSENT: ABSTAIN: ATTEST: City Clerk Mayor
