SUBJECT: Acceptance of In -Tract Improvements, Acceptance of Off -Site Improvements on
Tassajara Road and Fallon Road, Acceptance of Traffic Signals and Approval of
Regulatory Traffic Control Devices for Tract 7540 — Silvera Ranch, Phase 4 (KB
Home South Bay, Inc.)

EXECUTIVE SUMMARY:
KB Home South Bay, Inc. has constructed improvements for Tract 7540, Silvera Ranch —
Phase 4, in accordance with their Tract Improvement Agreement. It is now appropriate for the
City to accept these improvements and approve the regulatory traffic control devices.
FINANCIAL IMPACT:
KB Home South Bay, Inc. has provided Warranty Bonds in the amounts of $58,409.25 and
$112,384.00 (Bond Nos. CMS256290 and CMS256289), both issued by RLI Insurance
Company, to guarantee the improvements associated with the in -tract and off -site
improvements, respectively, for Tract 7540 for one year.
Upon acceptance of the improvements, the City will incur annualized maintenance costs
estimated to be $52,900 for traffic signals, street sweeping and street lighting (monthly), slurry
seal (every five years) and asphalt concrete pavement overlay (every 20 years).
RECOMMENDATION:
Staff recommends that the City Council adopt the Resolution accepting the In -Tract
Improvements, accepting the Off -Site Improvements on Tassajara Road and Fallon Road,
accepting Traffic Signals and approving the Regulatory Traffic Control Devices for Tract 7540 —
Silvera Ranch, Phase 4.

DESCRIPTION:
KB Home South Bay, Inc. (KB Home) entered into a Tract Improvement Agreement with the City
of Dublin on November 16, 2010, for the construction of street and other tract improvements
associated with Tract 7540, also known as Bella Monte of the Silvera Ranch Phase 4
development. These improvements included construction of the streets internal to Tract 7540,
as well as improvements on Tassajara Road and Fallon Road.
KB Home provided Faithful Performance Bonds and Labor & Materials Bonds to guarantee the
construction of the improvements. Separate bonds were provided for in -tract improvements
($233,637) and off -site improvements on Tassajara Road and Fallon Road ($449,536).
The in -tract and off -site improvements are now complete and the developer is requesting that
the bonds for this work be released and the improvements accepted.
KB Home has provided Warranty Bonds issued by RLI Insurance Company in the amounts of
$58,409.25 (Bond No. CMS256290) and $112,384.00 (Bond No. CMS256290) for the in -tract
and off -site improvements, respectively. The Warranty Bonds amounts are equal to twenty five
percent (25 %) of the full cost to construct the improvements and guarantee against construction
defects for a one -year period.
The following regulatory traffic control devices will be accepted and approved as part of this
project and added to the City of Dublin Traffic Code:
A. Traffic Signal at Fallon Road and Tassajara Road
B. Traffic Signal at Fallon Road and Silvera Ranch Drive
C. Traffic Signal at Fallon Road and Cydonia Court

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTING THE IN -TRACT IMPROVEMENTS, ACCEPTING THE OFF -SITE
IMPROVEMENTS ON TASSJARA ROAD AND FALLON ROAD, ACCEPTING TRAFFIC
SIGNALS AND APPROVING THE REGULATORY TRAFFIC CONTROL DEVICES FOR
TRACT 7540 — SILVERA RANCH, PHASE 4
WHEREAS, KB Home South Bay, Inc., the developer of Tract 7540, previously entered
into a Tract Improvement Agreement dated November 16, 2010, Resolution No. 162 -10, with
the City of Dublin, to complete in -tract and off -site improvements with Tract 7540, in
accordance with plans on file with the City Engineer; and
WHEREAS, the developer provided Faithful Performance and Labor & Materials Bonds,
each in the amount of $233,637.00 for in -tract improvements to guarantee the construction of
these improvements; and
WHEREAS, the developer provided Faithful Performance and Labor & Materials Bonds,
each in the amount of $449,536.00 for off -site improvements on Fallon Road and Tassajara
Road to guarantee the construction of these improvements; and
WHEREAS, the improvements are complete in accordance with said plans, and any
approved modifications thereto, to the satisfaction of the City Engineer, and
WHEREAS, the traffic signal installations at the intersections of Fallon Road and
Tassajara Road, Fallon Road and Silvera Ranch Drive, and Fallon Road and Cydonia Court
are complete in accordance with said plans and any approved modifications thereto, to the
satisfaction of the City Engineer; and
WHEREAS, the Faithful Performance Bonds and Labor & Materials Bonds for the in -tract
and off -site improvements of Tract 7540 can be released, in accordance with the authority
contained in §66499.7 of the Government Code of the State of California, "Manner of Release
of the Security," and replaced with Warranty Bonds to guarantee the completed work for a one -
year period; and
WHEREAS, KB Home South Bay, Inc., has provided Warranty Bonds in the amounts of
$58,409.25 and $112,384.00, issued by RLI Insurance Company (Bond Nos. CMS 256290 and
CMS 256289) to guarantee the in -tract and off -site improvements, respectively, for a one -year
period;
NOW, THEREFORE, BE IT RESOLVED that:
1. The in -tract improvements for Tract 7540 are hereby approved and accepted
subject to a one -year guarantee period; and

2. The submitted Warranty Bond issued by RLI Insurance Company (Bond No.
CMS256290) in the amount of $58,409.25 for the in -tract improvements for Tract
7540 be accepted as security for the aforesaid one -year warranty period, said
period to commence on this date and terminate on the 16th day of July, 2014; and
3. The original Faithful Performance Bond issued by RLI Insurance Company (Bond
No. CMS256290) in the amount of $233,637.00 for the in -tract improvements be
released; and
4. The original Labor & Materials Bond issued by RLI Insurance Company (Bond No.
CMS256290) in the amount of $233,637.00 for the in -tract improvements be
released; and
5. The off -site improvements on Fallon Road and Tassajara Road constructed with
Tract 7540 are hereby approved and accepted to a one -year guarantee period;
and
6. The submitted Warranty Bond issued by RLI Insurance Company (Bond No.
CMS256289) in the amount of $112,384.00 for the off -site improvements for Tract
7540 be accepted as security for the aforesaid one -year warranty period, said
period to commence on this date and terminate on the 16th day of July, 2014; and
7. The original Faithful Performance Bond issued by RLI Insurance Company (Bond
No. CMS256289) in the amount of $449,536.00 for the Fallon Road Improvements
be released; and
8. The original Labor & Materials Bond issued by RLI Insurance Company (Bond No.
CMS256289) in the amount of $449,536.00 for the Fallon Road Improvements be
released; and
9. The traffic regulatory devices installed by the developer within the City's right -of-
way are hereby included in the City of Dublin Traffic Code, and said regulatory
devices include the following:
A. Traffic Signal at Fallon Road and Tassajara Road
B. Traffic Signal at Fallon Road and Silvera Ranch Drive
C. Traffic Signal at Fallon Road and Cydonia Court
