It is now appropriate for the City to accept these improvements. FINANCIAL IMPACT: Discovery Builders has provided a warranty bond (Bond No. 1090078W), in the amount of $64,875.00 issued by Lexon Insurance Company, to guarantee the landscape improvements associated with Tract 8000 for one year. Upon acceptance of the landscape improvements, the project entry and other common landscaping areas within the public right -of -way will be maintained by the Schaefer Ranch Homeowner's Association. There will be no future maintenance costs to the City. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution accepting the Landscape Improvements for Tract 8000 — Schaefer Ranch, Unit 2. Submitted By Director of Public Works DESCRIPTION: �?14 Reviewed By Assistant City Manager Schaefer Ranch Holdings, LLC, has completed landscape improvements along Dublin Boulevard and the project entry and common areas within the public right -of -way associated with Tract 8000, Schaefer Ranch Unit 2. This work was governed by a Landscape Improvement Agreement executed on October 2, 2012 via City Council Resolution No. 173 -12. Page 1 of 2 ITEM NO. 4.3 Because the landscape improvements have been constructed pursuant to the Landscape Improvement Agreement and to the satisfaction of the City Engineer, it is now appropriate for these improvements to be accepted by the City. In accordance with the "Agreement for Long Term Encroachment for Landscape and Decorative Pavement Maintenance at Schaefer Ranch Tract 6765 and Schaefer Ranch Unit 2, Tract 8000" executed on May 21, 2013 (City Council Resolution No. 61 -13), maintenance of landscape improvements within the public right -of -way associated with Tract 8000 will be the responsibility of the Schaefer Ranch Homeowner's Association. At the time that the City and Schaefer Ranch Holdings, LLC, executed the Landscape Improvement Agreement, the developer provided a Performance Bond and a Labor & Materials Bond, each in the amount of $259,500.00 (Bond No. 1090078), to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in §66499.7 of the Government Code. Discovery Builders has provided a Warranty Bond (Bond No. 1090078W) in the amount of $64,875.00 issued by Lexon Insurance Company. The Warranty Bond amount is equal to twenty five percent (25 %) of the full cost to construct the landscape improvements and guarantees against construction defects for a one -year period. NOTICING REQUIREMENTS /PUBLIC OUTREACH: A copy of this staff report has been sent to Schaefer Ranch Holdings, LLC. ATTACHMENTS: 1. Location Map 2. Resolution Accepting the Landscape Improvements for Tract 8000 — Schaefer Ranch, Unit 2 Page 2 of 2 9 �i RESOLUTION NO. - 13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING THE LANDSCAPE IMPROVEMENTS FOR TRACT 8000 — SCHAEFER RANCH, UNIT 2 WHEREAS, Discovery Builders, dba Schaefer Ranch Holdings LLC, the developer of Tract 8000, previously entered into a Landscape Improvement Agreement dated October 2, 2012, Resolution No. 172 -12, with the City of Dublin, to complete Landscape Improvements associated with Tract 8000, in accordance with plans on file with the City Engineer; and WHEREAS, said Landscape Improvement Agreement was secured by Faithful Performance and Labor & Materials bonds, each in the amount of $259,500.00 (Bond No. 1090078); and WHEREAS, the improvements are complete in accordance with said plans, and any approved modifications thereto, to the satisfaction of the City Engineer, and WHEREAS, the original bonds that guaranteed the improvements can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California, "Manner of Release of the Security," and replaced with a Warranty Bond to guarantee the completed work for a one -year period; and WHEREAS, Schaefer Ranch Holdings, LLC, has provided a warranty bond in the amount of $64,875.00 issued by Lexon Insurance Company (Bond No. 1090078W) to guarantee the improvements for a one -year period; NOW, THEREFORE, BE IT RESOLVED that: 1. The Landscape Improvements for Tract 8000 are hereby approved and accepted subject to a one -year guarantee period; and 2. The original Faithful Performance Bond issued by Lexon Insurance Company (Bond No. 1090078) in the amount of $259,500.00 for the Landscape Improvements be released; and 3. The original Labor & Materials Bond issued by Lexon Insurance Company (Bond No. 1090078) in the amount of $259,500.00 for the Landscape Improvements be released. 1 vote PASSED, APPROVED AND ADOPTED this 20th day of August, 2013, by the following AYES: NOES: ABSENT: ABSTAIN: ATTEST: City Clerk Mayor
