HERITAGE AND CULTURAL ARTS COMMISSION
MEETING DATE: December 10, 2009
SUBJECT: Dublin Transit Center Public Art Project-Update

RECOMMENDATION: Recommend the following action to the City Council:
1) Accept offer from Avalon Bay Development to contribute
$50,000 for artwork for the median strip adjacent to Campbell
Green;
2) Direct Staff to include conditions related to the artwork
contribution in the Development Agreement for the Avalon Bay
Site C project; and
3) Prepare an amendment to the Agreement with artist Cliff Garten
to delete the requirement to prepare a design for the median strip
adjacent to Campbell Green.
FINANCIAL STATEMENT: $250,000 is available in the City's Public Art Fund from the
Alameda County Surplus Property Authority for public art at the
Dublin Transit Center.
DESCRIPTION: One of the Fiscal Year 2009-2010 City Council High Priority Goals
for Heritage and Cultural Arts is to: Work with the developer to locate significant works of art in two key
places of the Dublin Transit Center, the Campbell Green and the Iron Horse Plaza.
On August 18, 2009, the City Council authorized Staff to enter into an Agreement with artist Cliff Garten
to provide concept designs for artwork at two locations at the Dublin Transit Center. The first artwork site
is the median strip adjacent and to the east of Campbell Green, off of Martinelli Way (owned by Avalon
Bay). The second artwork site is the median / pedestrian island at the intersection of DeMarcus
Boulevard and Iron Horse Parkway between the BART Station entrance and a future residential
development (owned by the City of Dublin). The sites can be seen on Attachment 1.
On Saturday, October 24, 2009, a site visit with artist Cliff Garten was conducted at the Transit Center. In
attendance was Staff, Art Consultant Chandra Cerrito, members of the Art Selection Committee including
Jeff White of Avalon Bay Development and Pat Cashman of the Alameda County Surplus Property

Authority (ACSPA), and several members of the Heritage and Cultural Arts Commission. During the site
visit, after much discussion amongst the participants, it became apparent that the ACSPA funds would be ►
better spent providing artwork solely at the BART Station location. This would provide for an impressive
artwork that is at the appropriate scale to compliment the height of the surrounding light poles and other
structures. The consensus of those at the site visit was that rather than compromise the significance of the
BART Station artwork by splitting part of the budget to do artwork at the second location, that the funds
be used for only one artwork at the BART Station location.
During the site visit, Jeff White indicated that Avalon Bay Development might be interested in providing
artwork at the median strip adjacent to Campbell Green. On October 30, 2009, Avalon Bay Development
confirmed that they would be willing to commit $50,000 for artwork; the details of which would be
worked out as part of the Avalon Bay Site C project.
Based on this new information, Staff recommends that consideration be given to Avalon Bay
Development's offer to provide $50,000 for the artwork at the median strip adjacent to Campbell Green
and target the ACSPA funds of$250,000 for artwork at the BART Station location. This decision would
allow for more total funds for artwork at the Dublin Transit Center and for a more appropriate scale of
artwork at the BART Station location. If approved by the City Council, it should be noted that both
artworks will not be completed at the same time. The Bart Station artwork under design by artist Cliff
Garten will be completed in approximately December of 2010. The artwork for the median strip adjacent
to Campbell Green will be completed when the buildings and garage for Avalon Bay Site C are completed
and reach first occupancy. It should be further noted that Avalon Bay would be under no obligation to
utilize the services of artist Cliff Garten.
RECOMMENDATION: Staff recommends that the Heritage and Cultural Arts Commission
receive the report and recommend the following action to the City Council:
1) Accept offer from Avalon Bay Development to contribute $50,000 for artwork for the
median strip adjacent to Campbell Green;
2) Direct Staff to include conditions related to the artwork contribution in the Development
Agreement for the Avalon Bay Site C project; and
3) Prepare an amendment to the Agreement with artist Cliff Garten to delete the requirement
to prepare a design for the median strip adjacent to Campbell Green.
