SUBJECT: CONSENT CALENDAR: Determination of Conformity with the
City of Dublin General Plan for Union Pacific Right of Way
Acquisition (Parcel B)

EXECUTIVE SUMMARY:
In accordance with Government Code Section 65402, the Planning Commission shall consider
whether the subject property, which is proposed for acquisition by the City, is in conformance
with the General Plan.
FINANCIAL IMPACT:
No financial impact.
RECOMMENDATION:
Staff recommends that the City Council: 1) Accept the General Plan Conformance Report on
Union Pacific Right of Way Parcel B (Assessor Parcel Number 941-0550-023-04); and 2) Adopt
a Resolution Finding the Proposed Acquisition of Union Pacific Right of Way Parcel B to be in
conformance with the Dublin General Plan.

DESCRIPTION:
According to Government Code §65402, the Planning Commission must report conformance
with an adopted General Plan for any street vacation, abandonment, or the acquisition of real
property for any public purpose. The City has recently entered into a Purchase and Sale
Agreement with the agent for Union Pacific Railroad to acquire two parcels of land in Dublin.
Parcel A (Assessor Parcel Number 941-2768-006-02) is the 12.3 acre piece of property that the
Planning Commission considered at the September 10, 2013 meeting that is proposed to be
used for a future public park.
Parcel B (Assessor Parcel Number is a long and linear approximately 2.2-acre parcel that is
located south of Dublin Boulevard, adjacent to the Iron Horse Regional Trail and extends north
to Dublin Boulevard and south to the Dublin/Pleasanton BART Station near the east end of
Scarlett Court. The parcel is currently vacant.

The City's Maintenance Yard is to the
west of Parcel B, as are three other
parcels owned by Hacienda Auto Body,
` . Security Storage and Arlen Ness.

area. The power lines traverse a
portion of the subject property at the
southern end. Parcel B is zoned Light
CAMPBELL GNEEN
Industrial and has a General Plan land

- The Purchase and Sale Agreement
with Union Pacific's agent requires the
City to purchase Parcel A and Parcel B
as a package. Therefore, if the City
acquires the 12.25-acre Parcel A for
�t park and open space uses, the City
would also, by necessity, acquire
2.207-acre Parcel B. Approximately
0.2 acres of the site could be used to expand the City's Maintenance Yard and provide a
secondary emergency access point to the site from the BART property. For the remainder of the
parcel, Staff would explore options for uses compatible with the light industrial land use, which
may be limited due to the site characteristics. The City could also sell the remaining property as
conservation or mitigation space, or to the adjacent property owners for use in their businesses.
ANALYSIS:
Acquisition of Parcel B conforms with the Land Use and Circulation Element (Chapter 5) of the
General Plan in that any future uses of the property, whether public or private, will be in
compliance with the existing land use designation of Business Park/Industrial and Outdoor
Storage.

Staff is thus requesting this determination of conformity from the Planning Commission.
ENVIRONMENTAL REVIEW:
This conformity determination is a report by the Planning Commission, not a project
recommendation or approval, and is thus not a project as defined in CEQA Guidelines section
15378.
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
Findings of General Plan Conformance are not subject to a public hearing; therefore, a public
notice is not required.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
FINDING THE PROPOSED ACQUISITION OF UNION PACIFIC RIGHT OF WAY PARCEL B
TO BE IN CONFORMANCE WITH THE DUBLIN GENERAL PLAN
APN 941-0550-023-04, PLPA-2013-00044
WHEREAS, the City Council has entered into a Purchase and Sale Agreement to acquire
two parcels of land in Dublin: Parcel A (Assessor Parcel Number 941-2768-006-02) is a 12.3-
acre parcel that is intended for use as a future public park and Parcel B (subject parcel) is a 2.2-
acre parcel that is intended for use by the adjacent properties as continued light industrial/auto-
related uses; and
WHEREAS, the Planning Commission considered actions related to Parcel A on
September 10, 2013; and
WHEREAS, the acquisition and future use of Parcel B will be in compliance with the
existing General Plan land use designation of Business Park/Industrial and Outdoor Storage,
no land use changes are proposed; and
WHEREAS, in accordance with Government Code §65402, the Planning Commission
must report conformance with an adopted General Plan for any street vacation, abandonment,
or the acquisition of real property for any public purpose; and
WHEREAS, a Staff Report was submitted recommending that the Planning Commission
adopt a resolution finding the proposed acquisition of Union Pacific Right of Way Parcel B to be
in conformance with the Dublin General Plan.
NOW, THEREFORE, BE IT RESOLVED that the City of Dublin Planning Commission
finds that the proposed acquisition of Union Pacific Right of Way Parcel B to be in conformance
with the City of Dublin General Plan pursuant to Government Code §65402.
PASSED, APPROVED AND ADOPTED this 24th day of September 2013 by the following
