Thompson, Public Works Director ATTACHMENTS: 1) 2) Resolution Agreement with Jennifer Lin RECOMMENDATION:/C/f Adopt Resolution Approving Agreement FINANCIAL STATEMENT: This agreement provides that Jennifer Lin will pay the cost of the preparation of the Project Report and Environmental Document for interchange improvements at the 1-580/Fallon Road interchange. The estimated cost is $430,000. This includes $30,000 for project management services by Eric Cordoba, $10,000 for Staff review, $388,500 for Engineering Services, and $1,500 for contingencies. The Developer will receive a credit against payment of the future Eastern Dublin Traffic Impact Fees (TIF) in an amount equal to funds advanced for this work. TIF Credit will only be given after the cash deposits have been received by the City. The use of this credit is to be defined in the Development Agreement for each project and used according to the established TIF policy at the time of development. DESCRIPTION: Improvement of the 1-580/Fallon Road Interchange is a required mitigation measure for the Dublin Ranch Areas A-E Development. The City Council previously approved the preparation of a Project Study Report for the Improvement of the 1-580/Fallon Road Interchange, and this report is currently nearing completion. An Agreement for funding the Project Report and Environmental Document is the next step after the Project Study Report. The previously approved Development Agreement with Jennifer Lin for the Dublin Ranch Areas A-H projects provides for payment of costs related to preparation of the Project Report and Environmental Document forthe 1-580/Fallon Road interchange improvements. A separate item on this agenda provides for the City's Agreement with CCS Planning and Engineering for .. preparation of the Project Report and Environmental Docuriaent. The City Council previously approved .4 an agreement with Eric Cordoba of Cordoba Consulting, Inc., for project management and coordination services related to improvement of several interchanges, including this project. Staff recommends that the City Council adopt the resolution approving this Agreement. -2- RESOLUTION NO. ~ 99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING AGREEMENT WITH JENNIFER LIN REGARDING PROJECT REPORT and ENVIRONMENTAL DOCUMENT FOR 1-580/FALLON ROAD INTERCHANGE WHEREAS, a part of the mitigation for the Dublin Ranch development requires improvement of the 1-580/Fallon Road Interchange; and WHEREAS, the City and Jennifer Lin have agreed to the preparation of certain preliminary reports related to this interchange; and WHEREATS, a credit against payment of future Eastem Dublin Traffic Impact Fees will be provided to offset Jennifer Lin's pa~,ment of costs related to the project report and environmental document; NOW, THEREFORE, BE IT RESOLVED that the City Council approves the agreement with Jennifer Lin regarding preparation of project report and environmental document for the 1-580/Fallon Road interchange; BE IT FURTHER RESOLVED that the Mayor is authorized to execute the agreement. AYES: NOES: ABSENT: ABSTAIN: ATTEST: City Clerk g: ldevelopffnterchangeslFallon PRIresolinj'aln Mayor AGREEMENT BETWEEN JENNIFER LIN AND CITY OF DUBLIN REGARDING PROJECT REPORT and ENVIRONMENTAL DOCUMENT FOR 1-580/FALLON ROAD INTERCHANGE THIS AGREEMENT is entered into this 2nd day of November, 1999, between the City of Dublin, a municipal corporation ("City") and Jennifer Lin ("Lin"). RECITALS Lin owns approximately 1,333 acres of land located within the area generally known as Eastern Dublin. Some of Lin's property is within the City of Dublin and the remainder of Lin's property is within the City's sphere of influence. City has adopted a traffic impact fee (Eastern Dublin Traffic Impact Fee) to pay for road improvements necessary in Eastern Dublin. City's Eastern .Dublin Specific Plan ("Specific Plan") designates land uses for Lin's property. Lin will be required to pay an Eastern Dublin Traffic Impact Fee when Lin develops her property. A project report or "PR" and Environmental Document or "ED" is required by Caltrans in connection with improvements to the Fallon Road/I-580 interchange. Lin has agreed to advance funds to City for retention of a consultant to prepare a PR and ED as provided in this agreement and City has agreed to provide Lin a credit against payment of future Eastern Dublin Traffic Impact Fees in an amount equal to the funds advanced. AGREEMENT Now, therefore, City and Lin agree as follows: 1. Consultant City will retain a consultant to prepare a PR and ED for the Fallon Road/l-580 interchange. City intends to enter into an agreement with a consultant within 30 days of this agreement. 2. Payment Lin has paid an initial deposit of $250,000 to City contemporaneous for the execution of this agreement to be used by City to cover City's costs of the PR and ED as set forth in paragraph I above. Any funds remaining shall be returned to Lin following completion of the PR and ED. Lin shall deposit additional funds when requested by the City's Public Works Director but not to exceed an additional $180,000 for a total contribution of $430,000. 3. Credit Aclainst TIF City shall provide a credit to Lin in the amount of Lin's payment for the PR and ED. The amount of the credit shall not be increased for inflation nor shall interest accrue on the amount of the credit. The credit may be used in the manner and subject to the provisions of City's administrative guidelines including any amendments to such resolution for use of TIF credits. 4. No Oblic!ation to Approve Proiect This agreement shall not be construed as providing Lin with any assurance that any application for a land use entitlement will be granted by City for Lin's property.
