FINANCIAL STATEMENT:
$47,000 to be assessed to property owners for 1988-89
landscaping and lighting maintenance costs. No cost
to the City.
DESCRIPTION:
As part of the review and approval of the 145-unit single family
development (Village VI) and the other, multi-family Villages, certain
landscaping and open space maintenance was made a condition of approval.
maintenance assessment district provides funds for this work. The City
Council approved formation of the District on November 10, 1986, with the
initial assessment in the 1987-88 tax year.

The County Assessor collects these monies for the City for the
maintenance of landscaping and irrigation systems, right-of-way fencing, walls
and entrance signs, trash removal, and maintenance of the open space lots
(firebreaks, weed abatement, slope drainage, and slope stability repair). The
open space parcel maintenance will be charged to the District for three years
only, similar to the agreement made for Tract 4719. The District's boundaries
include all of Tract 5511, excluding Villages IV and V, which are proposed to
be annexed as they develop.
On April 25, 1988, the City Council authorized preparation of the
Preliminary Engineer's Report which is attached to this agenda statement.
Staff plans to hold an informational meeting with interested property owners
on May 19th in order to explain the scope of work and answer any questions.
Adoption of the resolutions approves the Preliminary Engineer's Report and
sets a date (June 13, 1988) for a protest hearing for the Assessment. Staff
recommends that the City Council adopt the resolutions.
This past year (1987-88), the only expenses incurred by the City were
the Engineer's Report and administration (approximately $2,000) and weed
abatement along the open hills (approximately $3,850). This allows an
estimated carryover reserve, including interest, of $48,610.
The assessment per single family lot last year was $120. This year's
assessment is proposed to be $96.46, as maintenance is expected to begin
September 1st, thus only incurring costs for 10 months.

ASSESSMENT
WHEREAS, on April 25, 1988, the City Council of the City of Dublin, California,
pursuant to the provisions of the Landscaping and Lighting Act of 19?2, adopted its
Resolution Directing Preparation of Annual Report for Maintenance Assessment District
for the maintenance of improvements more particularly therein described~ and
WHEREAS, said Resolution directed the undersigned to prepare and file a report
pursuant to Section 22565, et. seq. of said Act~
NOW, THEREFORE, the undersigned, by virtue of the power vested in me under said
Act and the order of the Council of said City, hereby make the following assessment
to cover the portion of the estimated cost of the maintenance of said improvements
and the cost and expenses incidental thereto, to be paid by said District.

As required by said Act, a diagram is hereto attached showing the exterior
boundaries of said landscaping maintenance assessment district and also the lines and
dimensions of each lot or parcel of land within said landscaping maintenance
assessment district as the same existed at the time of the passage of said
resolution, each of which lots or parcels having been given a separate number upon
said diagram.
I do hereby assess the net amount to be assessed upon all assessable lots or
parcels of land within said landscaping maintenance assessment district by
apportioning that amount among the several lots or parcels in proportion to the
estimated benefits to be received by each such lot or parcel from the maintenance of
said improvements, and more particularly set forth in the list hereto attached and by
reference made a part hereof.

Said assessment is made upon the several lots or parcels of land within said
landscaping maintenance assessment district in proportion to the estimated benefits
to be received by said lots or parcels respectively from the maintenance of said
improvements. The diagram and assessment numbers appearing herein are the diagram
numbers appearing on said diagram~ to which reference is hereby made for a more
particular description of said property.
Each lot or parcel of land assessed is described in the assessment list by
reference to its parcel number as shown on the Assessor's Maps of the County of
Alameda for the fiscal year 1988-19~9 and includes all of such parcel excepting those
portions thereof within existing public roads or right-of-way to be acquired in these
proceedings for public road purposes. For a more particular description of said
property~ reference is hereby made to the deeds and maps on file and of record in the
office of the County Recorder of said County. Because the names of the several
owners are unknown to me~ I hereby place the word "Unknown" opposite the number of
each lot or parcel of land assessed~ the amount assessed thereon, and the number of
the assessment.

SCOPE OF WORK
The following areas are to be maintained by this Maintenance Assessment
District:
1) The median and roadside landscaping (north side of street) along the length
of Willow Creek Drive.
2) Roadside landscaping along Shady Creek Drive within Lots 1, 2, 3, 4, 5, 6,
15, 16, 37, and south of Lot 145, all within Tract 5511.
3) Roadside landscaping, wall, fence, and pathway improvements along Dougherty
Road between Wildwood Road and Amador Valley Boulevard, and along Amador Valley
Boulevard between Dougherty Road and Wildwood Road.
4) Roadside landscaping, fence, and pathway improvements along the west side
of Wildwood Road.
5) Roadside landscaping, wall, fence, and pathway improvements along the west
side of Wildwood Road.
6) Cutting of firebreaks, maintaining slope drainage, and slope stability
repair along the open space Lots A and D of Tract 5511 and Parcel A of Tract 5780.
The maintenance within item number 6 is limited to three years~ the City will assume
cost of maintenance after three years.

METHOD OF APPORTIONING
Each single-family lot (Lots 1 - 145) has been assessed at a value of
$96.46 per year. Each approved multi-family village has been assessed at the
following percentage rates based on units of approved density. Lots A through D and
H~ being creek~ park~ and open space have been assigned a zero assessment. The ratio
of assessments is as follows:

A RESOLUTION APPROVING PRELIMINARY ENGINEER'S REPORT,
CONFIRMING DIAGRAM AND ASSESSMENT

MAINTENANCE ASSESSMENT DISTRICT 86-1
WHEREAS, by its Resolution No. 60-88, a Resolution Directin§
Preparation of Annual Report for Maintenance Assessment District, City of
Dublin Landscaping and Lighting Maintenance Assessment District, 86-1 (the
"district"), this Council designated the City Engineer, as Engineer and
ordered said engineer to make and file a report in writing in accordance with
and pursuant to the Landscaping and Lighting Act of 1972; and
WHEREAS, said Engineer of Work has made and filed with the City
Clerk a preliminary report in writing as called for in said Resolution No.
60-88 and under and pursuant to said Act, which report has been presented to
this Council for consideration; and
WHEREAS, said Council has duly considered said report and each
and every part thereof, and finds that each and every part of said report is
sufficient; and that said report, nor any part thereof requires or should be
modified in any respect;
NOW, THEREFORE, BE IT RESOLVED
a) that the Engineer's estimate of the itemized and total costs
and expenses of maintaining said improvements and of the incidental expenses
of maintaining said improvements and of the incidental expenses in connection
therewith, as contained in said report be, and each of them are hereby
preliminarily approved.
b) that the diagram showing the assessment district, description
of the improvements to be maintained, and the boundaries and dimensions of the
respective lots and parcels of land within said district, as contained in said
report be, and it is hereby preliminarily approved.
c) the assessment of the total amount of the cost and expenses of
the proposed maintenance of said improvements upon the several lots and
parcels of land in said District in proportion to the estimated benefits to be
received by such lots and parcels, respectively, from said maintenance, and of
the expenses incidental thereto, as contained in said report be and they are
hereby preliminarily approved.

IN RELATION TO PROPOSED ASSESSMENTS

MAINTENANCE ASSESSMENT DISTRICT 86-1
WHEREAS, by its Resolution No. 60-88, a Resolution Directing
Preparation of Annual Report for Maintenance Assessment District, City of
Dublin Landscaping and Lighting Maintenance Assessment District 86-1 (the
"District") this Council designated the City Engineer as Engineer and ordered
that engineer to make and file a report in writing in accordance with and
pursuant to the Landscaping and Lighting Act of 1972; and
WHEREAS, said Engineer of Work has made and filed with the City
Clerk a preliminary report in writing as called for in said Resolution No.
60-88, and under and pursuant to said Act, which report has been presented to
this Council for consideration; and
WHEREAS, said Council has duly considered said report and each
and every part thereof, and finds that each and every part of said report is

NOW, THEREFORE, BE IT RESOLVED that on June 13, 1988, at the hour
of 7:30 p.m. in the regular meeting place of said Council, Dublin Library,
7606 Amador Valley Blvd., Dublin, California, be, and the same are hereby
appointed and fixed as the time and place when and where it will consider and
finally act upon the Engineer's Report.
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to
give notice of said hearing once a week for two weeks in the local newspaper
published and circulated in said City, and by conspicuously posting a notice
thereof at public locations, and not less than three in all; said posting and
first publication to be had and completed at least ten (10) days before the
date herein set for hearing of protests.
BE IT FURTHER RESOLVED that said notices shall be headed "Notice
of Assessment" and shall, in legible characters, state the fact and date of
the passage of this Resolution and approving the preliminary Engineer's Report
and of the date, hour, and place set for the hearing of said protests, and
briefly describe the assessments proposed to be made, and refer to said
Resolution and report for further particulars.
