rr-FINANCIAL STATEMENT: The fiscal impacts of this project were addressed as part of a fiscal
analysis performed for the project. The City Council reviewed the fiscal analysis as part of the PD Rezone and
Development Agreement applications in January of 1995. In summary, the fiscal analysis concluded that this
project is consistent with the fiscal policies in relation to provision of infrastructure and public services of the
City's General Plan and the Eastern Dublin Specific Plan and General Plan Amendment.
DESCRIPTION:
This is an application for Site Development Review for a new Applebee~s Restaurant. The restaurant is proposed
to be located in the Hacienda Crossings Commercial Center in the southeast portion of the site (Attachment 1).
The proposal consists of a 5,500 sq.ft. restaurant on a 1.32+ acre pad, located in the 53 acre Commercial Center.
A project site plan, floor plans, landscape plans, and building elevations are located on Attachment 1 ..
BACKGROUND:
The Santa Rita Commercial Center project (now referred to as Hacienda Crossings) has included a PD Rezone
to a General Commercial Planned Development, a Development Agreement between the City of Dublin,
Alameda County and Opus Southwest (originally Hornart), and three parcel maps. On January 23, 1995, the
City Council approved a Mitigated Negative Declaration for the Project. On January 31, 1995, the City Council

frontage on the primary frontage, to a maximum of 100 square feet. Additionally the Sign Program provided a
sign allotment of ½ square foot of signage per linear square foot of seconda~ business frontage, to a maximum
~ of 50 square feet. The maximum allowable area for all signs on the property is 200 square feet.
The applicant has proposed two signs each on the three elevations. One sign depicts "Applebee's" in white neon
with an apple logo above with an acrylic red face; the second sign depicts "Neighborhood Grill and Bar" in cursive
style lettering formed in white tubed neon.. The "Applebee~s" sign is 43.5 square feet 'and the "Neighborhood Grill
and Bar" sign is 44.5 square feet, which total 88 square feet per frontage (for a total of 264 square feet). The
maximum sign square footage allowed on two of the three elevations is 50 square feet. To observe the maximum
sign area set froth in the Master Sign Program, staff recommends on the east elevation that either the "Applebee's"
sign or the 'Neighborhood Grill and Bar" sign, be eliminated and the remaining sign be centered over the widows.
A recommended condition of approval would require the applicant to submit a detailed sign plan which observes
the signage guidelines set forth in the Master Sign Progrin for Hacienda Crossings and incorporates one of the
above options. :
Landscaping:
The, landscaping for the restaurant has been designed to accent and compliment the architecture. Chinese
Hackberry and Flowering Pears as well as a nice palette of shrubs will accent the building and blend it with the
Center.
Consistency with the General Plan, Eastern Dublin Specific Plan and Zoning Ordinance:
-.The proposed Site Development Review application is ~onsistent-with the City of Dublin General Plan, the
(./"~','~ern Dublin Specific Plan and General Plan Amendment 'and Zoning Ordinance. Development of the
proposed shopping center and' associated restaurants will implement goals of the Dublin General Plan and
Eastern Dublin Specific Plan. The process of Site Development Review is consistent with the requirements of
the Zoning Ordinance and Eastern Dublin Specific Plan. Additionally, requirements of the Eastern Dublin
Specific Plan for design review will be satisfied by this review of the design of the Project by the City Council.
Environmental Review:
The project is a component of a larger_ project ("the Santa Rita Commercial Center Project"), which also
includes a rezoning and a Development Agreement that the City previously appro~ed on January 31, 1995. The
Santa Rita Commercial Center Project, in ram, was within the scope of the Eastern Dublin Specific Plan and
General Plan Amendment, for which a Program EIR was previously certified (SCH No. 91103064). A
Mitigated Negative Declaration (SCH 94113020) already has been approved for the Santa Rita Commercial
Center Project which, together with the Program EIR, adequately describes this project for the purposes of
CEQA. Since the. Mitigated Negative Declaration was. adopted, the City has identified no changes in the Santa
Rita Commercial Center Project or in the circumstances under which the Santa Rita Commercial Center Project
is to be undertaken or any other new information which requires revisions to the Mitigated Negative Declaration
or to the Program EItL Additionally, the project meets the criteria to be Categorically Exempt from the
requirements of the California Environmental Quality Act pursuant to Section 15332 of the 1998 CEQA
Guidelines, because it entails the construction of restaurant that is characterized as in-fill development with no

Conclusion:
The City Council's approval this evening would allow for the development of Applebee's as part of the Hacienda
Crossings Commercial Center. The restaurant's design and theme would further complement the Hacienda
Crossings Center as a destination entertainment and retail center.
RECOMMENDATION:
Staff recommends that the City Council receive Sis presentation and public input, deliberate, and adopt the
Resolution approving the Site Development Review for the Applebee's Restaurant at Hacienda Crossings.

ARCHITECTURAL STATEMENT
This application proposes to construct an "APPLEBEE'S - NEIGHBORHOOD GRILL & B.&R"
restaurant. A restaurant consisting of 5,316 square feet of building area and containing a total of 198
interior dining seats. The proposed hours of operation will be 11:00 am - 9:00 pm Sunday through
Thursday and 11:00 am through 12:00 am Friday and Saturday. This restaurant will employ a total of 50
full time employees.

APPROVING PA 99-031, APPLEBEE'S
SITE DEVELOPMENT REVIEW, A PORTION OF THE
HACIENDA CROSSINGS COMMERCIAL CENTER
V~rHEREAS, Apple-Bay East, Inc., has requested approval of a Site Development Review
application for a restaurant on Parcel Number 2 at Hacienda Crossings; and
WHEREAS, the Planned Development that was approved for this site requires that the application
for Site Development Review be approved by the City Council at a public meeting; and
WHEREAS, the project is a component of a larger project C'the Santa Rita Commercial Center
Project"), which also includes a rezoning and a Development Agreement that the City previously
approved on January 31,. 1995. The Santa Rita Commercial Center Project, in turn, was within the scope
of the Eastern Dublin Specific Plan and General Plan Amendment, for which a Program EIR was
previously certified (SCH No. 91103064). A Mitigated Negative Declaration (SCH 94113020) already

Mitigated Negative Declaration or to the Program EIR; and
WHEREAS, a restaurant is a permitted use under the Planned Development District for this site;
and
WHEREAS, the City Council held a public meeting on said application on September 21, 1999;
and
WHEREAS, proper notice of said public meeting and a ten day public review period was given in
all respects as required by law; and
WHEREAS, the staff report was submitted recommending the City Council approve the Site
Development Review application subject to Conditions of Approval prepared by Staff; and
WHEREAS, the City Council did hear and use their independent jud~m-nent and considered all said
reports, recommendations and testimony hereinabove set forth.

NOW, THEREFOE, BE IT RESOLVED that the City Council of the City of Dublin does hereby find
that:
The approval of this application (PA 99-03 1) is consistent with the intent/purpose of
Section 8-104 (Site Development Review) of the Zoning Ordinance.
The approval of this application, as conditioned, complies with the policies of the General
Plan; with the Eastern Dublin Specific Plan; and with Planned Development Regulations
for PA 94-001 which would allow a restaurant as a permitted use at this location.
The approval of this application, as conditioned, is consistent with the design review
requirements in the Eastern Dublin Specific Plan and the City of Dublin Zoning Ordinance.
The approval of this application, as conditioned, is in conformance with the Mitigation
Monitoring Program for the Santa Rita Commercial Center Project Mitigated Negative
Declaration.
The approval-of this application, as conditioned, is in conformance with regional
transportation and growth management plans.
The approval of this application, as conditioned, is in the best interests of the public health,
safety and general welfare as the development is consistent with all laws and ordinances
and implements the Eastern Dublin Specific Plan.
The proposed site development, including site layout, vehicular access, circulation and
parking, setbacks, h~ight, walls, public safety and similar elements, as conditioned, has
been desig'ned to provide a desirable environment for the development.
Architectural considerations, including the character, scale and quality of the design, the
architectural relationship with the site and other buildings, signs, building materials and
colors, screening of exterior appurtenances, exterior lighting and similar elements have
been incorporated into the project and as conditions of approval in order to insure
compatibility of this development with the development's design concept or theme and the
character of adjacent buildings and uses. Modifying the color and material of the awnings
would enhance the compatibly of the proposed structure with the existing shopping center.
Landscape considerations, including the locations, type, size, color, texture and coverage of
plant materials, provisions and similar elements have been considered. to insure visual
relief and an attractive environment for the public.
BE IT FLIRTHER RESOLVED THAT THE Dublin City Council does hereby approves PA 99-
03 1 Site Development Review for Applebee's, a portion of the Hacienda Crossings Commercial Center,
as generally depicted by materials labeled Attachment 1 of the Staff Report, as well as the color
elevations, displays, model, perspectives and material board, stamped approved and on file with the
Dublin Planning Department, except as modified herein and subject to the following conditions:

21, 2000. If construction has not
commenced by that time, this approval shall
be null and void. The approval pedod for the
Site Development Review may be extended
six (6) additional months (Applicant must
submit a written request for the extension
prior to the expiration date of the permit) by
the Community Development Director upon
the determination that the conditions of
approval remain adequate to assure that the
above stated findings of approval will
continue to be met.
11. The permit shall be revocable for cause in
accordance with Section 8-961 of the Dublin

14. The applicant shall submit a revised detailed
sign plan which is in accordance with the
Hacienda Crossings approved Master Sign
Program.
UTILITIES
15. Developer shall be on notice that all
conditions from TPM 7375 shall apply with
relation to utilities and water, as well as
other improvements.
16. The restaurant shall institute a solid waste
recycling program. The Developer shall
comply with the City's solid waste
management and recycling requirements.
17. The refuse collection service provider shall
be consulted to ensure that adequate:space

parking plan shall be submitted.
23. Drive aisles and sidewalks of the site shall
be configured to maximize safety,
circulation, convenience and sight distance
per the City of Dublin Zoning Ordinance,
standard plans and details, and current
policies of the Public Works Department.

24. Public parking spaces shall be double-
striped with 4-inch wide stripes set
approximately 2 feet apart as shown on the
'Typical Parking Striping Detail" available in
the Planning Department. Handicapped,

49. Employee exit doors shall be equipped with
180 degree viewers if there is not a burglary
resistant window panel in the door.
50. Exterior lighting shall be provided and shall
be of a design and placement so as not to
cause glare onto adjoining properties or onto

52. Prior to issuance of the Building Permit, the
Developer shall provide a minimum one foot
wide raised curb or equivalent on landscape

Public Works Criteria (Attachment A). In the event of a
conflict between the Public Works Criteria and these

2. Fees. Applicant/Developer shall pay all applicable fees in Various

by the Director of Public Works.
14. ADA Requirements/Handicap Ramps. All handicap PW
ramps shall comply with all current State ADA
requirements and City of Dublin Standards.
15. Storm Drain Subdrains. Street and parking areas PW
designed with sump areas shall have a curb inlet at the low
spot and two additional inlets shall be installed in street
areas within 50 feet of the low area.
16. Roof Drains. The roof drains shall empty directly into the PW
storm drain system. Applicant/Developer shall comply
with all NPDES regulations and requirements at all times
during construction.
17. Street and Parking Storm Drains. Applicant/Developer PW
shall tie all subdrains into storm drain catch basins or
manholes at the downstream end of the subdrain. There
shall be a cleanout at the upper end of all subdrains.
] 8. Public Street Storm Drains. All public streets shall drain PW
into storm drain systems before being discharged into
established drainage channels.
19. Pre-Treatment of Storm Water. A structural control, PW
such as an oil/water separator, sand filter, or approved
equal, may be required to be installed onsite to intercept
and pre~treat storm water prior to discharging to the storm
drain system. The design, location and a maintenance
schedule shall approved by the Director of Public Works.
20. Landscaped Median Island Storm Drain Subdrains. PW

25. Landscaping at Aisle Intersections. Landscaping at

pavement and designated on the parking plan.
31. Bicycle Parking. Applicant/DeVeloper shall provide
bicycle parking near the building entries to the satisfaction
of the Director of Public Works and the Director of

32. Pedestrian Circulation. Applicant/Developer shall
provide a final pedestrian circulation plan (when the
Center Site Plan has been ~nalized) to the satisfaction of

Doors. Exterior doors which are located at the rear, or side, or away from the
primary entrance shall be solid doors with no glazing and shall be installed in
metal frames. Exterior wood doors shall be solid wood construction ! 3/4"
thick or hollow metal doors.
Locking devices. Exterior swinging doors which are exit doors as setforth in
Chapter 33 shall have cylinder dead-bolt locks which shall be openable without
the use of key, special effort, or knowledge. In Group B occupancies, a double
cylinder dead-bolt lock may be used on the main exit door if there is a readily
visible, durable sign on, or adjacent, to the door stating, "this door to
remain unlocked during business hours." The sign shall be in letters not less
than ! inch high on contrasting background. When unlocked the single door and
both leaves of a pair of doors shall be free to swing without operation of any
!atching device, Doors which are not exit doors shall have the inactive leaf
secured with flush-bolts at the top and bottoms. The bolts shall be hardened
steel 1/4" minimum diameter and shall engage a metal strike plate to, a minimum
depth of 3/8 inch.
The dead bolts shall be hardened steel and shall have a minimum of a one inch
fnrow. If the cylinder of the lock protrudes from the face of the door it
shall be fitted with a cylinder ring geared so that it cannot be griped with
pliers or other wrenching devices.
Vehicle door, overhead doors, and sliding doors shall be secured with metal to
metal locking devices which prevent the door from opening.
3. Strike plates. Strike. plates for wood jambs shall be the high security tB~e
and shall be secured with a minimum of two wood screws 3" long ~nich shall
engage the door studs.
4. Jambs. Inswinging doors with wood jambs shall have rabitted ja~OS. The ja~DS
on the strike side shall have solid shims above and below the strike plates and
fne opposite jamb shall have solid shims at the level of the strike plate.
Both door studs shall be reinforced with horizontal solid blocking at the
approximate height of strike.
5. Hinges. Exterior doors shall have non-removable hinge pins.
S!idinm E!ass doors. Sliding glass doors shall comply with Chapter 54.
Sliding glass doors shall be fitted with a locking device that shall engage the
strike sufficiently to prevent its being disengaged by any possible movement of
the door within the space or clearances provided for installation and
operation. The bolt and strike shall be reinforced by hardened material so as
to prevent their separation by pulling, prying or similar attack. An au}riiiary
locking device shall be installed on the door which may be a pin, lock, or
similar device of not less than 1/4" diameter. Tne pin shall be of hardened

material and engage the metal portion of the sliding door. The primary locking
device shall be operable by a keyed or code lock inside. Doors with 2 slid~
panels shall be locked at the meeting rails and shall have an auxiliary lock~
device as described above.
Windows. All accessible windows which are not located at the front or main
entrance side of a non-residential building shall be made secure as follows:
a) Sliding glass windows shall be secured on the inside with a 1pcking device
capable of withstanding prying or wrenching. An auxiliary lock shall be
installed on each sliding window that prevents movement in the sliding
track.
b) Louvered windows shall not be used within eight feet of ground level,
adjacent structures, or fire escapes.
c) Casement type windows shall be secured with ~ netal to metal loc,~ing ~ev~ce
contacting both frames of the window at the meeting edge. Auxiliary locks
such as a pin that penetrates both frame stzu-tures shall be installed on
casement and double hung windows·
d) WindOws shall not 5e!ocated within 40 inches of the locking device of any
door not located on the main entrance side of the non-residential building
unless the windows are glazed with 1/4" tempered glass.
Openable transoms. All exterior openable transoms exceeding 8 x 12 which are
not located on the front or main entrance side of a non-residential building
shall be protected with a steel grill and 1/4" minimum bars not more than 2"'~M
center or by a screen with 1/8" diameter wire mesh not more than 2" on center
mounted on the inside.
Roof oDehints. All skylights on the roof of a non-residential building shall
be protected by:
a) iron bars 1/2 inch minimdm diameter not more than.8" on center
b) A screen with 1/8" ~iameter wire mesh not more than 2" on center.
All roof access hatches of non-residential building shall be protected as
fQ!!ows:
a) if the hatchway is of wooden material, it shall be covered on the inside
with at least 16 gauge sheet steel or its equivalent attached with screws at
6" o.c.;
b) The hatchway shall be secured from the inside with a slide bar or slide
bolts;
c) Outside hinges on all hatchway openings shall be provided with non-remov~o!e
pins when using pin-type hinges.
All air duct or air vent openings exceeding 8" x !2" on the roof or exterior
walls of any building or premise used for business purposes shall be secured~
covering the same with eitherof the following:
a) Iron bars of at least 1/2" round or 1" x 1/4" flat steel material, spaced no
more than 8" o.c. apart and securely fastened.
10. Exterior ladders. Exterior ladders to the roof are not permitted.
