FINA~CIAL STATEMENT: $62,540 to be assessed to property owners for 1989-90 landscaping and lighting maintenance costs. No cost to the City. This proposed assessment will cover just the estimated cost of maintenance and incidentals for FY 1989-90, and no budget has been included to increase the reserve fund, which is estimated at $4,043. DESCRIPTION: The City formed Landscaping and Lighting Assessment District No. 1983-2 for maintenance of landscaping within Tract 4719 (Stagecoach Road slopes, the "interior" landscaped slopes, and the Stagecoach Mini-Park) at the request of the developer as an alternative to a combined homeowners' association. The cost of maintenance of the Stagecoach Road landscaping and Stagecoach Park is spread 60% to the Amador Lakes development and 40% to the Dublin Hills Estates Development (divided evenly among the 150 single-family lots). All of the Dublin Hills Estates interior slopes (Coral Way and Agate Way) maintenance cost is spread to the Dublin Hills Estates lots. The District Diagram remains the same as last year, which includes all of the original Tract 4719. The proposed assessment this year is $62,540. This is $2,734 more than last year's estimated expenditures of $59,806 because of projected increased maintenance costs for the Stagecoach Road and interior slopes, as well as for Stagecoach Park. The assessment to the single-family property owners in the Beck development will increase by $6.00 per lot over the 1988-89 assessment ($212 per lot vs. $206 per lot last year). The assessment to the Amador Lakes property owners will increase by $934 ($30,740 vs. $29,806 for last year). Staff conducted a neighborhood meeting on July 12 to discuss this year's assessment levy and answer questions. Approximately 16 property owners attended the meeting, including two representatives of Rafanelli and Nahas and Amador Lakes. A number of questions and concerns were discussed; a copy of the meeting notes is attached as Exhibit 1. Staff recommends that the City Council conduct a public hearing and adopt the resolution approving the Engineer's report, confirming the diagram and assessment, and ordering levy of assessments. ITEb[ NO. ! ~.~ COPIES TO' Amador Lakes Associates STAGECOACH ROAD ASSESSMENT DISTRICT INFORMATIONAL MEETING 3uly 12, 1989 The following questions and concerns were expressed by persons attending the meeting: 1) Why are water and electricity more for the Stagecoach slopes than for the other maintenance areas (park and interior slopes)? The Stagecoach slope area totals 4.35 acres. The interior slope area totals 1.92 acres. The park is approximately .75 acre. 2) Concerns expressed by several residents regarding the Work Alternative Program - the types of "crimes" committed, language used by workers, crew not doing any work, throwing things into yards, supervision procedures, etc. The Work Alternative crews typically consist of people with serious driving offenses, such as DUI's. These inmates pay a fee to be allowed to do public service work in lieu of jail time. One City (MCE) maintenance person supervises the Work Alternative crew. There is no charge to the Assessment District for the inmate labor; there is a charge for the supervisor's time at the regular hourly rate (not overtime rate). The Maintenance Superintendent has determined that an adequate job of weeding and cleanup is being done by the Work Alternative crew. The other option for doing the work would be to use regular City (MCE) maintenance people at their regular hourly rate, which would then be assessed to the residents. It is anticipated that the Work Alternative crew would not work as intensely as a crew that was hired and paid to do the work. It may not always be possible to control the language used by the crew; however, any problems that occur should be called to the attention of the supervisor, who is identified by the words "CITY OF DUBLIN MAINTENANCE DEPT. MCE CORPORATION, CONTRACTOR" on his orange shirt. He is also the person that drives the white MCE truck. Residents may also call the City offices on the following Monday to report problems. The Sheriff's Department has very specific rules regarding treatment of the inmates. The City (MCE) supervisor is not allowed to restrain or discipline the inmates. If a problem occurs, the supervisor is required to notify the Sheriff's Department, and the inmate will be picked up and transported to Santa Rita, which has been done on occasion. If the supervisor is not visible at a given time, it may be because he is transporting inmates to use the restroom. 3) Why are Incidental Costs charged to the property owners and not paid by the City? The Incidentals (cost of preparing report, cost of collection by the County, delinquencies, and reserve) are part of the cost of operating the Assessment District. Stagecoach Road Assessment District Informational Meeting - July 12, 1989 Page 2 4) Why is the cost of maintaining Stagecoach Park paid for by the Assessment District when maintenance of all other parks in the City are paid for by the City? Is the maintenance cost per acre higher for Stagecoach Park? Stagecoach Park was originally placed in the District by the developer. It is a very small, .75-acre neighborhood park without a parking lot, and it was felt that it would primarily serve the residents of the Stagecoach Road area, whereas the other City parks are considerably larger (3 to 6 acres) and intended for use by residents from all areas of the City. The cost per acre is higher for Stagecoach Park than for other City parks because it is more intensely planted. Larger parks contain'large areas of turf. 5) Why do the Stagecoach slopes look better than the interior slopes? There are more trees on the Stagecoach slopes. The plant material on the Stagecoach slopes is two to three years older and is more established. The trees on the interior slopes have been spaced according to their mature dimensions. Some of the trees on the Stagecoach slopes have already been removed and others may need to be removed later. 6) Concern regarding irrigation system service to system. perceived lack of irrigation, Vandalism to irrigation systems on the slopes and in the park is the worst in the City. The average irrigation repair involves 20 heads per week, which are either stolen or broken. Repair/replacement costs are charged to the District. Residents are encouraged to notify Dublin Police Services (462-1212) if vandals are observed. Neighborhood Watch groups have been helpful in other areas. 7) Questions regarding the Dougherty Open Space proposed park. weed control, squirrels, Firebreak behind homes was done by mowing rather than discing. The 90-acre open space is disced. Late rains after the mowing was done caused some additional growth. Maintenance Superintendent will check into grass that was cut but not removed. The area along Amador Valley Boulevard was disced. The Maintenance Superintendent will check into an area between Topaz and Quartz that may not have been mowed. The City anticipates being able to clear some trails for hiking in the open space this fiscal year. Further improvements to the Dougherty Open Space are not budgeted in the current five-year Capital Improvement Program. The Park Masterplan shows proposed eventual improvements, but there will be further discussion at Park and Recreation Commission and City Council meetings prior to implementation. Residents that are interested in attending these meetings should contact the City Recreation Department (829-4932). The work is proposed to be done in August. 8) Specific area complaints or questions: a) Check bare area next to Lot 80 Jade Circle - appears to be within maintenance easement. b) 7356 Quartz Circle: Gazanias coming from Stagecoach slope under fence into resident's yard. I do hereby assess the net amount to be assessed upon all assessable lots or parcels of land within said landscaping maintenance assessment district by apportioning that amount among the several lots or parcels in proportion to -2- the estimated benefits to be received by each such lot or parcel from the maintenance of said improvements, and more particularly set forth in the list hereto attached and by reference made a part hereof. Said assessment is made upon the several lots or parcels of land within said landscaping maintenance assessment district in proportion to the estimated benefits to be received by said lots or parcels respectively from the maintenance of said improvements. The diagram and assessment numbers appearing herein are the diagram numbers appearing on said diagram, to which reference is hereby made for a more particular description of said property. Each lot or parcel of land assessed is described in the assessment list by reference to its parcel number as shown on the Assessor's Maps of the County of Alameda for the fiscal year 1989-1990 and includes all of such parcel excepting .those portions thereof within existing public roads or right-of-way to be acquired in these proceedings for public road purposes. For a more particular description of said property, reference is hereby made to the deeds and maps on file and of record in the office of the Coun~ty Recorder of said County. Because the names of the several owners are unknown to me, I hereby place the word "Unknown" opposite the number of each lot or parcel of land assessed, the amount assessed thereon, and the number of the assessment. The balance of this annual cost has been divided equally among Lots 1 through 150, inclusive, of Tract 4719. The cost of maintaining the excavated slopes and concrete culverts together with its landscaping on the interior slopes of the single-family area (excluding those slopes and concrete culverts adjacent to Stagecoach Road), shall be evenly spread over Lots 1 through 150 of Tract 4719. Lots 152 and 153, being park and open space, shall have a zero assessment. 154 and 155, being public agency owned, shall have a zero assessment. Lots -5- SCOPE OF WORK The scope of work shall be the maintenance of landscaping and irrigation within the road right-of-way and within a public easement along Stagecoach Road between the limits of Amador Valley Blvd. and Alcosta Blvd. and maintenance of all facilities within Stagecoach Park on ~6~ 152 of Tract 4719.
