HomeMy WebLinkAbout4.07 Sale of Surplus Property CITY OF DUBLIN AGENDA STATEMENT City Council Meeting Date: April 27, 1987 SUBJECT: Sale of Surplus Property to The Fishery EXHIBITS ATTACHED: RECOMMENDATION: 1) Resolution of Intention to Sell City Property and Setting Hearing Date 2) Plat Map 3) Legal Description of the Property  ~Adopt Resolution of Intention to Sell City Property and Setting of Hearing Date FINANCIAL STATEMENT: A value of $31,204 has been negotiated for the sale of this property based on 3,671 square feet at $8.50 per square foot. DESCRIPTION: At the City Council meeting of December 22, 1986, Staff was given approval to begin negotiations for the sale of a small piece of surplus right-of-way on the west side of San Ramon Road, just north of Amador Valley Blvd. Thi~ property fronts the parcel owned by the developers of The Fishery Restaurant, who requested to be allowed to purchase the property. Staff has notified five housing and park and recreation agencies as required by the Government Code, and has received responses declining interest in this property from four of them. The State Resources Agency did not respond within the required 60-day time period; therefore, the next step in the process may be taken. In order to proceed with the sale, the City Council must adopt a resolution of intention to sell City property which additionally sets a time and date for a public hearing regarding the sale. A minimum ten- day notice is required. If no protests are received at the hearing, or if any protests are overruled by a four-fifths vote, the sale may proceed. Staff recommends the City Council adopt the resolution of intention to sell City property and setting a hearing date of May 11, 1987, at 7:30 p.m. in the Dublin Library. ITEM NO. Ron Rivers PG & E, Pacific Bell, DSRSD, Viacom 7400 San Ramon Road RESOLUTION NO. -87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN STATING INTENTION TO SELL CITY PROPERTY AND SETTING HEARING WHEREAS, The Fishery requested the City to enter into negotiations to sell approximately .086 acre of City property adjacent to San Ramon Road north of Amador Valley Blvd., and more particularly described in "Exhibit A" attached hereto, in conjunction with development of a restaurant on and adjacent to the subject property; and WHEREAS, on December 22, 1986, the City Council adopted Resolution No. 143-86 establishing said property as surplus and directSng Staff to notify appropriate agencies; and WHEREAS, said housing and park and recreation agencies have declined interest in purchasing said property; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin finds that it is in the public interest and convenience to sell the subject property, and that the City Council intends to sell said property, and that the City Council hereby fixes May 11, 1987, at 7:30 p.m., in the Meeting Room, Dublin Library, 7606 Amador Valley Blvd., Dublin, CA, as the time and place for hearing protests to the proposed sale. BE IT FURTHER RESOLVED that the City Council directs Staff to publish notice of said hearing one time in The Herald and to post notice of said hearing in at least three conspicuous places on or before May 1, 1987.
