DESCRIPTION: The attorney for the developers of The Fishery Restaurant, which is to be constructed on the west side of San Ramon Road just north of Amador Valley Blvd., has submitted a letter requesting that the City begin proceedings to allow said developers to purchase excess right-of-way at the front of their property. The attached map indicates the location of the property, the exact dimensions of which will be determined prior to finalizing the sale. This transaction would be similar to the one conducted with the developers of Arbor Creek in the fall of 1984. Section 54222 of the Government Code requires that the City offer this property to any housing authorities, redevelopment agencies, park and recreation departments, and the State resources agency before committing to sell to a private party. If the property is declared to be surplus and Staff is authorized to enter negotiations with the applicant, these agencies will be notified in writing and will have 60 days to respond. If all agencies decline to purchase the property or do not respond after 60 days, a resolution of intent to sell may be adopted and a public hearing may be held subsequently for final action (Government Code Sections 37421 et. seq.). Staff recommends that the City Council authorize Staff to enter negotiations for the sale of the property and adopt the resolution declaring the property to be surplus. Box 2340 Dublin, CA 94568 Re: Dublin Fishery, 7400 San Ramon Road Dear Mr. Thompson: This letter is a formal request that the City of Dublin initiate the proceedings to enable the owners of the property, located at 7400 San Ramon Road, Dublin, California, to acquire that certain triangular strip of property presently owned by the City.as excess right of way on San Ramon Road 'and outlined in "red" on the site plan attached hereto. Your prompt attention to this matter will be appreciated. I am advised that for the first 60 days, the property must be offered for sale to your public and quasi public boards and agencies, and, at the conclusion of that time, you will enter into direct negotiations with us over purchase price. Please keep me advised of the procedural steps that must be followed by us in this matter. Should you have any questions concerning technical information about the parcel we seek to purchase, please contact our engineer, Keith Angerman, at 924-0770. GRUBER pURL~C l '1: pU gLF"', RESOLUTION NO. -86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ESTABLISHING SURPLUS PROPERTY AND DIRECTING STAFF TO NOTIFY APPROPRIATE AGENCIES WHEREAS, The Fishery has requested the City to enter into negotiations to sell approximately .10 acre of City property adjacent to San Ramon Road north of Amador Valley Blvd. in conjunction with development of a restaurant on and adjacent to the subject property; and WHEREAS, the City Council has authorized Staff to enter into negotiations for the sale of City property; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin finds that approximately .10 acre of vacant right-of-way along San Ramon Road north of Amador Valley Blvd. as illustrated in the attached Exhibit A is surplus land and determined to be no longer necessary for the City's use. BE IT FURTHER RESOLVED that the City Council directs Staff to notify the appropriate agencies of the City's offer to sell the property. PASSED, APPROVED, AND ADOPTED this 22nd day of December, 1986.
