Request to Enter Negotiations for Sale of Surplus
Property: Public Storage

RECOMMENDATION: 1) Authorize Staff to enter into negotiations.
2) Adopt Resolution establishing surplus property.
FINANCIAL STATEMENT: Undetermined at this time.
DESCRIPTION:
Public Storage, who has purchased and intends to develop the property on San
Ramon Road formerly owned by Roy Moret, has submitted a letter requesting that
the City begin proceedings to allow Public Storage to purchase excess right-
of-way at the front of the property. The attached map indicates the location
of the property, the exact dimensions of which will be determined prior to
finalizing the sale. This transaction would be similar to those conducted
with the developers of Arbor Creek and of the Fishery Restaurant.
Section 54222 of the Government Code requires that the City offer this
property to any housing authorities, redevelopment agencies, park and
recreation departments, and the State resources agency before committing to
sell to a private party.
If the property is declared to be surplus and Staff is authorized to enter
into negotiations with the applicant, these agencies will be notified in
writing and will have 60 days to respond. If all agencies decline to purchase
the property or do not respond after 60 days, a resolution of intent to sell
may be adopted, and a public hearing may be held subsequently for final action
(Government Code Sections 37421 et. seq.).
It should be noted that while Mr. Tangney's letter mentions a specific cost
figure, adoption of the resolution declaring the property to be surplus does
not commit the City in any way to accepting this offer.
Staff recommends that the City Council authorize Staff to enter into
negotiations for the sale of the property and adopt the resolution declaring
the property to be surplus.

Dear Lee;
Per our phone conversation, enclosed is a map and legal
description of the city owned property which needs to be acquired
by Public Storage for setback and landscape purposes. The area
to be acquired amounts to 4,925 square feet and is irregular in
shape. Public Storage will agree to pay $53,337. for this
parcel, $10.83 per square foot. This per foot price is
discounted slightly from our purchase price with Mr. Moret for
two reasons. First, The similar piece of land purchased by the
Hayward Fishery not long ago was substantially less that $10.83
per foot. Second, Unlike the Fishery parcel, our parcel requires
a significant public improvement at our expense since we are
constructing and providing an easment for a pedestrian path for
public use along the creek. In view of these two facts I believe
the $53,337 price is a fair one.
You should now have the information you require to proceed
with this matter and present our proposal to City Council.
Public Storage will be prepared to complete this transaction
anytime after our closing is complete with Mr. Moret. Currently
the closing is scheduled to occur April 4th, 1990. Please
contact me if you require any additional information.

RESOLUTION NO. -90
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ESTABLISHING SURPLUS PROPERTY
AND DIRECTING STAFF TO NOTIFY APPROPRIATE AGENCIES
WHEREAS, Public Storage has requested the City to enter into
negotiations to sell approximately 4,925 square feet of City property adjacent
to San Ramon Road north of Amador Valley Boulevard in conjunction with
development of a public storage and retail facility on and adjacent to the
subject property; and
WHEREAS, the City Council has authorized Staff to enter into
negotiations for the sale of City property;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Dublin finds that approximately 4,925 square feet of vacant right-of-way
along San Ramon Road north of Amador Valley Boulevard as illustrated in the
attached Exhibit A is surplus land and determined to be no longer necessary
for the City's use.
BE IT FURTHER RESOLVED that the City Council directs Staff to
notify the appropriate agencies of the City's offer to sell the property.
