HomeMy WebLinkAboutReso 140-95 EBRPD-IronHorse RESOLUTION NO. 140 - 95 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN SUPPORT OF EAST BAY REGIONAL PARK DISTRICT' S APPLICATION FOR ISTEA FUNDING BICYCLE PATH ALONG IRON HORSE TRAIL DOUGHERTY ROAD TO EAST DUBLIN BART STATION WHEREAS, the United States Congress enacted the Intermodal Surface Transportation Efficiency Act of 1991, which is intended to provide over $200 million in federal dollars over a six year period as matching funds to local, state, and federal agencies and nonprofit entities for transportation enhancement activities; and WHEREAS, the Califomia Department of Transportation has established the procedures and criteria for reviewing proposals and is required to submit to the Califomia Transportation Commission a list of recommended projects from which the recipients will be selected; and WHEREAS, said procedures and criteria established by the California Department of Transportation requires a resolution certifying the approval of the application by the applicant' s goveming body before submission of said application to the Metropolitan Transportation Commission and the State of Califomia; and WHEREAS, the East Bay Regional Park District is applying for ISTEA funding to construct a bicycle path along a portion of the Alameda County property adjacent to the Southem Pacific railroad right of way; and WHEREAS, the City of Dublin is not required to contribute financially to this project, either during construction or for future maintenance; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin' supports East Bay Regional Park District' s application for ISTEA funding for a bicycle path along the "Iron Horse Trail" (Alameda County property) from Dougherty Road to the East Dublin BART Station under the following conditions: 1. The local matching funds are to be provided by the East Bay Regional Park District, the Livermore Amador Valley Transit Authority, and/or BART. 2. The bicycle path is to be maintained by the East Bay Regional Park District. 3. If, in the future, the County relinquishes its right-of-way, the City will assume ownership of the right of way and will have the right to relocate the bicycle path if said bicycle path conflicts with a future City street. PASSED, APPROVED AND ADOPTED this 281h day of November, 1995.
