HomeMy WebLinkAboutPC Reso 87-013 PA87-009 CrctCty RESOLUTION NO. 87 - 013 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 87-009.2 CIRCUIT CITY STORES CONDITIONAL USE PERMIT REQUEST FOR A FREESTANDING SIGN WITH A HEIGHT IN EXCESS OF 20 FEET LOCATED APPROXIMATELY 40 FEET FROM THE FRONT PROPERTY LINE AT 7450 AMADOR VALLEY BOULEVARD ~HEREAS, Herbert H. Horowitz, A.I.A., on behalf of Circuit City Stores, filed an application for a Conditional Use Permit to locate a 23 foot, 4 inch tall Freestanding Business Identification Sign, located approximately 40 feet from the front property line at 7450 Amador Valley Boulevard; and WHEREAS, a Site Development Review request was concurrently submitted requesting approval for the proposed refurbishing of the 51,600~ square foot Handyman Store at the subject property to accommodate the proposed occupancy by a Circuit City Store and a future, unnamed retail tenant(s); and WHEREAS, the Planning Commission held a public hearing on said applications on March 2, 1987~ and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEI~EAS, the applications have been reviewed in accordance with the provisions of the California Environmental Quality Act and a Negative Declaration of Environmental Significance has been adopted (Planning Commission Resolution No. 87 - 012) for these projects, as they will have no significant effect on the environment; and WHEREAS, a Staff Report was submitted recommending that the Site Development Review and Conditional Use Permit applications be conditionally approved~ and WHEREAS, the Planning Commission heard and considered all said reports, recommendations and testimony hereinabove set forth; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find: The use is required by the public need in that it provides visible identification to the general public for the Circuit City Store retail complex. The use would be properly related to other land uses and transportation and service facilities in the vicinity. The use, if permitted under all circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare, or injurious to property or improvements in the area, as all applicable regulations will be met. The use will not be contrary to the specific intent clause or perfor- mance standards established for the district in which it is to be located, in that conditions have been applied to insure conformance with the Zoning Regulations. BE IT FURTHER RESOLVED THAT THE Dublin Planning ComMission does hereby approve said application as shown on Exhibit "D" from the March 2, 1987, Staff Report prepared for this project, on file with the Dublin Planning Department and subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Aporoval shall be complied with prior to issuance of a buildin~ permit or the establishment of the oroposed land use activity and shall be subject to Plannin~ Department review and approval. 1. The sign cabinet for the subject Freestanding Sign shall conform to the following design criteria~ a) Maximum sign area - as generally depicted on the Revised Sign Eleva- tion Plans dated received February 23, 1987, with a maximum double- faced area of 300 square feet. b) Maximum sign height ~ 24 feet c) Maximum sign cabinet height = tl feet 4 inches d) Maximum sign cabinet width - 14 feet e) Copy size - 22 inch letters f) Sign location - as generally shown on the Staff Study Landscape Plan dated February, 1987 (observing a minimum setback of 40 feet from Amador Plaza Road and from Amador Valley Boulevard). The use and manner of lighting, either internal or external, of the new Freestanding Sign shall be subject to review and approval by the Planning Director prior to the sign's installation. The material used for the new Freestanding Sign shall be of a high architectural quality so as to compliment the design of the principle structure. 4. Any modifications to said sign shall be subject to review and approval of the Dublin Planning Department. The Applicant shall comply with all applicable Building Code requirements. Building permits for the proposed sign shall be secured and construction commenced within six months after the effective date of this permit or said approval shall be void. The existing Freestanding Sign (Handyman's 35 foot high sign) shall be removed prior to the commencement of installation of the new sign, but in no case later than occupancy of the southerly structure by Circuit City Stores. The design of the sign shall be modified to allow for an increase in the area devoted to copy for identification of the future retail tenant(s) of the 25,680~ square foot tenant lease space in the southerly structure to a minimum size of 40 square feet on each side of the sign. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. PASSED, APPROVED AND ADOPTED this 2nd day of March, 1987.
