On June 27, 1988, the Planning Director
approved Site Development Review for First
Western Development to Construct a 10,000
square foot commercial retail building
On November 14, 1988, the Dublin City Council
approved a parcel map to subdivide an
existing parcel into two lots and a Variance
to allow a lot with insufficient frontage.
On December 7, 1989, the Planning Director
approved an Administrative Conditional Use
Permit for a construction trailer for First
Western Development.
On April 9, 1990, the Dublin city Council
approved a PD, Planned Development Rezoning
for First Western Development.
On March 4, 1990, the Planning Director
approved an Administrative Conditional Use
Permit for Kuppenheimer 30-day grand opening
banner.
On May 18, 1990, First Western Development
applied for a Conditional Use Permit for
Kuppenheimer east elevation wall sign. The
Applicant did not process the application
citing sign program needed for the entire
east building elevation. The application was
closed on September 24, 1990.
APPLICABLE REGULATIONS:
Resolution No. 34-90 for PA 89-050 PD Rezoning under
Subsection 9c, item 4, for Parcel B, specifies that east building
elevation may be considered a secondary building frontage for
City sign ordinance purposes if a Conditional Use Permit is
granted.

In order to grant a Conditional Use Permit for signage along
the east building elevation, the Planning Commission must find,
based upon facts that:
1) The color, size, shape, lighting intensity, and other
physical design characteristics of the signage will not have any
adverse effect on traffic safety conditions and safe traffic
operations on 1-680.
2) The signage will be proportionate with human scale as
visible to travelers on 1-680.
3) The signage meets all other applicable provisions of
the City Sign Ordinance with the exception that the projection of
the east building elevation need not be in a roadway or public
open space area such as private street, an open plaza or square,
or an auto parking area.
Section 8-87.33 Wall Signs and Projecting Signs establishes
maximum height, width and area permitted for wall signs and makes
provisions for increases in the limitations through the Site
Development Review process.
Section 8-94.0 states that conditional uses must be analyzed
to determine: 1) whether or not the use is required by the
public need; 2) whether or not the use will be properly related
to other land uses, transportation and service facilities in the
vicinity; 3) whether or not the use will materially affect the
health or safety of persons residing or working in the vicinity;
and 4) whether or not the use will be contrary to the specific
intent clauses or performance standards established for the
district in which it is located.
ENVIRONMENTAL REVIEW: This project has been found to be
Categorically Exempt from CEQA under Section 15311, Class ll(a)
of the California Environmental Quality Act guidelines. This use
consists of the placement of on-premise signs accessory to an
existing commercial facility.
NOTIFICATION: Public Notice of the March 4, 1991 hearing was
published in the local newspaper, mailed to adjacent property
owners, and posted in public buildings.
ANALYSIS:
The Applicant is requesting approval of a Conditional Use
Permit to allow wall signage along the east elevation of the
building facing the 1-680 freeway.
The Applicant proposes four (4) internally illuminated
individual channel lettered signs 21 inches in height and 10 feet

in length and the maximum area of each of the proposed signs will
be 17.5 square feet.
First Western Development Planned Development Rezoning PA
89-050 approved on April 9, 1990, established a provision that
the east building elevation may be considered a secondary
building frontage if a Conditional Use Permit is granted. In
order to grant a Conditional Use Permit for signage along the
east building elevation, the Planning Commission must make three
findings based upon facts in addition to the typical findings
required for Conditional Use Permit approvals. Staff's response
to these three additional findings are as follows:
1) The color, size, shape, lighting intensity, and other
physical design characteristics of the signage will not have any
adverse effect on traffic safety conditions and safe traffic
operations on 1-680. Staff has determined that the six colors
proposed (green, yellow, orange, blue, white and red), are
similar to those already existing on the building and with other
signs in the vicinity. Specific individual sign colors will be
subject to Planning approval in conformance with the color
samples shown on Exhibit A. The size and shape of the proposed
signs is consistent with the sign regulations in that they meet
the height and length requirements for secondary building
frontages. The lighting intensity of the signs will be at levels
consistent with existing signage on the building. The visibility
and legibility of the proposed signs will not obstruct or impede
traffic safety on 1-680.
2) The signage will be proportionate with human scale as
visible to travelers on 1-680. The proposed signs will be
similar in size, area and height to other secondary building
frontage signs approved on site and in the vicinity.
3) The signage meets all other applicable provisions of
the City Sign Ordinance with the exception that the projection of
the east building elevation need not be in a roadway or public
open space area such as private street, an open plaza or square,
or an auto parking area. The signs are in compliance with the
regulations of the Sign Ordinance.
The application has been reviewed by the applicable public
agencies and city departments and no comment/concerns were stated
or additional conditions required. Staff recommends approval of
the Conditional Use Permit for the proposed east elevation
building wall signs.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 91-009 CONDITIONAL USE PERMIT REQUEST FOR EAST ELEVATION
SIGN PROGRAM AT 7181-7199 AMADOR PLAZA ROAD
WHEREAS, Rick Hess, representing First Western Development, filed
an application for a Conditional Use Permit to allow new wall signs on
the east elevation building frontage at 7181-7199 Amador Plaza Road;
and
WHEREAS, the Planning Commission did hold a public hearing on
said application on March 4, 1991; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act (CEQA) and has
been found to be Categorically Exempt under Section 15311, Class lla);
and
WHEREAS, the Staff Report was submitted recommending the
application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
A. The use is required by the public need in that it provides
business identification to the general public for an existing
commercial retail building in the City of Dublin.
B. The use will be properly related to other land uses and
transportation and service facilities in the vicinity, as it will be
commensurate with the present use of properties in the PD Planned
Development zoning district.
C. The use, if permitted under all the circumstances and
conditions of this particular case, will not materially affect
adversely the health or safety of persons residing or working in the
vicinity or be materially detrimental to the public welfare or
injurious to property or improvements in the area as all applicable
regulations will be met.
D. The use will not be contrary to the specific intent clauses
or performance standards established for the district in which it is
to be located in that conditions have been applied to insure
conformance with the Zoning Ordinance.
EXHIBIT
E. The use is consistent with the intent of the zoning
district, the Downtown Specific Plan and the General Plan.
F. The color, size, shape, lighting intensity, and other
physical design characteristics of the signage will not have any
adverse effect on traffic safety conditions and safe traffic
operations on 1-680 in that the six colors proposed (green, yellow,
orange, blue, white and red), are similar to those already existing on
the building and with other signs in the vicinity. Specific
individual sign colors will be subject to Planning approval in
conformance with the color samples shown on Exhibit A. The size and
shape of the proposed signs is consistent with the sign regulations in

BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby approve PA 91-009 First Western Development Signs Conditional
Use Permit as shown on the plans consisting of two sheets, labeled
Exhibit A, dated received February 21 and 27, 1991, and on file with
the Dublin Planning Department, and subject to the following
conditions of approval.
CONDITIONS OF APPROVAL
Unless stated otherwise, all Conditions of Approval shall be complied
with prior to the issuance of building permits or establishment of
use, and shall be subject to Planning Department review and approval.
The following codes represent those departments/agencies responsible
for monitoring compliance of the conditions of approval. [PL]

Administration, [FIN] Finance, IF] Dougherty Regional Fire Authority,
[DSR] Dublin San Ramon Services District, [CO] Alameda County
Department of Environmental Health.
PA 91-009 Conditional Use Permit is approved for four (4)
internally illuminated individual channel lettered wall signs on
the east building elevation and shall generally conform to the
following dimensions and to Exhibit A, consisting of plans
prepared by Action/Don Cass Signs dated received February 21,
1991, and color samples for this application dated received
February 27, 1991: [B], [PL]
a. Maximum Sign Area: 17.5 square feet
b. Maximum Sign Height: 21 inches
c. Maximum Sign Length: 10 feet
Note: Ail approved existing wall signs on-site are not a part of
this Conditional Use Permit approval.
The approved wall signs cited in Condition #1 shall be mounted
directly to the building surface as shown on Exhibit A. [B]
The signs are to be well maintained in an attractive manner and
in accordance with the approved plans. [PL]
Subject to the satisfaction and approval of the Planning
Director, the lighting intensity of the signs shall not create
any off-site glare or distraction on 1-680 or to adjoining
properties. [PL]
Ail colors used for the individual signs shall be subject to
planning/zoning approval for compliance with approved colors
(Exhibit A). [PL]
Any additional signage utilized on this site shall be subject to
review and approval by the Planning Department prior to
installation. The use of banners, balloons, pennants or any
other type of promotional signage shall require a separate
approval by the Planning Department prior to installation of use.

Building permits for the approved signage shall be obtained prior
to installation of said signs. [B] [PL]
This use shall be subject to Zoning Investigator review and
determination as to compliance with the conditions of approval.
Any violation of the terms or conditions of this permit shall be
subject to citation. [PL]
This permit shall be revocable for cause in accordance with
Section 8-90.3 of the Dublin Zoning Ordinance. [PL]
PASSED, APPROVED AND ADOPTED this 4th day of March, 1991.
