HomeMy WebLinkAboutReso 002-92 NegDeclMassage RESOLUTION NO. 2 -92 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ADOPTING A NEGATIVE DECLARATION FOR PA 91-049 ZONING ORDINANCE AMENDMENT MASSAGE WHEREAS, at the July 22, 1991 City Council meeting, Council considered a request made by Ms. Veronica Krell, owner/operator of A Touch of Health located at 6995 Dublin Boulevard, to initiate an amendment to the Dublin Municipal Code, Chapter 4.20 Massage Establishments and Massage Services, Section 4.20.020 Exemptions; and WHEREAS, at the July 22, 1991 City Council meeting, the Council initiated the Zoning Ordinance Amendment study to allow massage establishments in a C-2, General Commercial District with Conditional Use Permit approval; and WHEREAS, a draft ordinance amending the Zoning Ordinance to include a definition of Massage Establishment and to identify Massage Establishment as a conditional use in the C-N, Neighborhood Business District; C-l, Retail Business District; and C-2, General Commercial District has been prepared; and WHEREAS, the Planning Commission held a public hearing on December 2, 1991, and approved two resolutions recommending City Council adoption of the said Draft Zoning Ordinance Amendment relating to massage establishment and the Negative Declaration for the Draft Ordinance Amendment; and .... WHEREAS, The California Environmental Quality Act (CEQA), State CEQA Guidelines and City Environmental Guidelines require that certain projects be reviewed for environmental impact and that environmental documentation be prepared; and WHEREAS, an Initial Study was conducted finding that the project, as proposed, would not have a significant effect on the environment; and WHEREAS, a Negative Declaration has been prepared for this project; and WHEREAS, public notice of the Negative Declaration was given in all aspects as required by State Law; and WHEREAS, the City Council did review and consider the Negative Declaration at a public hearing on January 13, 1992. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City Council does hereby find: That the project will not have a significant effect on the environment. That the Negative Declaration has been prepared and processed in accordance with State and local environmental laws and guideline regulations. 3. That the Negative Declaration is complete and adequate. BE IT FURTHER RESOLVED THAT THE Dublin City Council does hereby adopt the Negative Declaration for PA 91-049 Zoning Ordinance Amendment Massage.
