Authorize Staff to accept maintenance bond at a future date
FINANCIAL STATEMENT:
Maintenance bonds to guarantee against defects will be provided to
the City in the following amounts: $37,500 for landscaping, and
other improvements.
Street lighting maintenance costs for public street lighting will be
paid by the Citywide Street Light Maintenance Assessment District.
Maintenance of street-side landscaping along Starward Drive will be
paid by the Homeowner' s Association.
DESCRIPTION: This project is located west of Starward Drive, south of the
Alameda County Flood Control channel, east of San Ramon Road, and north of the Shamrock Village
Shopping Center. The site was developed by Schuler Homes and consists of 31 lots plus common
areas. The streets within Tract 7029 are private; however, the storm drain, curb inlets, curb and gutter,
and street lights constructed along Starward Drive will be maintained by the City. Improvements in
Tract 7029 have been inspected by the City Engineer and have been determined to be complete.
At the time the City and the developer executed the contract for the Tract improvements, the developer
was required to provide a performance bond in the amount of $300,000, and labor and materials bonds
in the amount of $150,000 for on-site/off-site improvements to provide the necessary security for'
performance of the work. In addition, the developer contributed a parkland in-lieu fee in the amount of
$85,073 for neighborhood parks and $43,896 as the community park component of the City's Community
Facilities Fee. As the work is now complete, the performance security requirement can be reduced, in
accordance with the authority contained in section 66499.7 of the Government Code, to an amount
necessary to guarantee maintenance of the work for a one-year period following acceptance of the work.

The developer may provide a new maintenance bond in the amount of $37,500 for landscaping or retain
the initial performance bond.
Staff recommends adopting the Resolution to accept work completed on Tract 7029, Starward
DevelOpment, and authorize Staff to accept a maintenance bond in the amount of $37,500, if submitted,
at a future date.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTING IMPROVEMENTS FOR TRACT 7029 (STARWARD)
WHEREAS, the owner-subdivider of the aforesaid Tract previously entered into a contract with the
City of Dublin to improve said Tract in accordance with plans and specifications on file with the City
Engineer, said Tract identified as follows:

WHEREAS, said improvements have been completed in accordance with said plans-and
specifications, and any approved modifications thereof, to the satisfaction of said City Engineer of the City
of Dublin; and
WHEREAS, as a condition of said contract, subdivider is required to guarantee the improvements and
to maintain the completed work for a period of one year following acceptance of the work by the said City of
'Dublin;
WHEREAS, as improvements are now completed, the original performance bond security
requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the
Government Code of the State of California, to an amount found necessary to guarantee maintenance of the
completed work for the aforesaid one-year period.
NOW, THEREFORE, BE IT RESOLVED that:
The improvements completed within the said Tract be, and they are hereby approved and
accepted subject to the aforesaid one-year guarantee; and

The said original performance bonds in the amounts of $300,000 and $150,000 posted in
connection with the work involved in the construction of said Tract be released upon
acceptance of said maintenance bond in the amount of $37,500.
