HomeMy WebLinkAboutPC Reso 86-074 PA86-105 LthrnCh RESOLUTION NO. 86 - 074 A RESOLUTION OF THE pLANNING C01~MISSION OF THE CITY OF DUBLIN APPROVIN~THERAN CHURCH OF THE RESURRECTION - PRESCHOOL NURSERY ~ARE FACILITY CONDITIONAL USE PERMIT HEQUEST, 7557 AMADOR VALLEY BOULEVARD WHEREAS, Lou Ann Dahl filed a Conditional Use Permit request to allow the extension and modification of Conditional Use Permit C-4086 to allow continued operation of a preschool nursery, while expanding it from a 96-child to a 136-child operation, and to allow the extension of Conditional Use Permit PA 83-068 to allow the continued operation of a 24-child child care facili~y within the Lutheran Church of the Resurrection at 7557 Amador Valley Boulevard; and WHEREAS, the adopted City of Dublin Zoning Ordinance provides, in part, for the establishment of child care facilities of seven or more children as a Conditional Use; and WHEREAS, the Planning Commission did hold public hearings on said application on December 1, 1986, and December 15, 1986; and ~EREAS, proper notice of said public hearing was given in all respects as required by law; and W~HEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and a Negative Declara- tion of Environmental Significance has been adopted (Planning Commission Resolution No. 86-073) for this project, as it will have no sio~nificant effect on the environment; and - ~EREAS, the Staff Report was submitted recommending that the Conditional Use Permit application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth; and ~]{EREAS, the proposed land use, if conditionally approved, is appropriate for the subject property in terms of being compatible to existing land uses in the area and will not overburden public services; NOW, THEREFORE, BE IT RESOLVED THAT THE Planning Commission finds: a) The continued operation of the Preschool Nursery and Child Care facility serves the public need by continuing to provide, in part, for an existing and growing need for preschool and child care facilities in the City of Dublin. b) The uses will be properly related to other land uses, and transportation and service facilities in the vicinity, as the proposed uses will be compatible to said land uses, and transportation and service facilities in the immediate vicinity. c) The uses will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detri- mental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met and as the use is operated within existing facilities that operates without detriment. d) The uses will not be contrary to the specific intent clauses or per- formance standards established for the district in which they are to be located as it is in conjunction with and is a valid conditional use in the District. -1- e) The project is consistent with the policies contained in the City's General Plan. BE IT FURTHER RESOLVED that the Planning Commission does hereby conditionally approve Conditional Use Permit application PA 86-105, as shown by materials labeled Exhibit C and Background Attachment 2 from the December 1, 1986, Staff Report for this item, and Attactzment 6 from the December 15, 1986, Staff Report, on file ~ith the Dublin Planning Department, subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Aooroval shall be comotied with prior to the establishment of the oroDosed land use activity and shall be subject to Planning Deoartment review and aooroval. 1) The maximum number of children present at the preschool nurse~f at any one time shall not exceed 48. The maximum number of children present at the preschool nursery over the course of a week shall not exceed 136 children. The maximum number of children present at the child care facility at any one time shall not exceed 24. 2) Ail School activities shall be restricted between the hours of 6:30 a.m. and 6:30 p.m. Monday through Friday with the exception of occasional evening meetings. 3) No outside activities may take place before 8:00 a.m. 4) Signage for this child care facility shall be limited to the existing 3'~ x 4'+__ wall mounted sign located at the southeast corner of the Church building. The existing signage for the preschool facility (3'± 4'~ material sign located on the play yard fence) shall be removed within 60 days of the effective date of this permit. A new, permanent wall mou~ted sig?. may be established for the preschool facility and shall be subject to review and approval by the Dublin Planning Department prior to installation. T~mporary signs used for special events or enrollment drives shall be subject to the process outlined in Sections 8-87.66 and 8-87.67 of the Ordinance (si~ requiring Administrative CondiTional Use Permit or Conditional Use Permit approval). 5) School noise shall be controlled so as not to create a nuisance to the adjoining residential neighborhood. 6) The Applicant shall annually submit evidence to the Planning Director that appropriate State licenses and permits are in place for the operation of the preschool nurse~/ and child care facility. 7) The School operator shall, at the minimum of a once-a-year basis, make arrangements to have the Dublin Police Se~ices Child Abuse Program, or an equivalent program, presented to the Staff and the children attending the ~o facilities. 8) An additional handicapped parking space shall be supplied on site to comply with Title 24 requirements of the S~aTe Building Code (three spaces minimum required for 81-120 on-site parking spaces). 9) Within 30 days of the effective da~e of this permit, the Appiicanz shall submit written documentation to the City that the requirements of the DSRSD Fire Department have been met. 10) Shrubs along the ~mador Valley Boulevard sidewalk shall be trimmed and maintained as appropriate to allow unrestricted pedestrian movement on the sidewalk. 11) The ground lighting fixture for the Church's low profile sign along the Amador Valley Boulevard frontage shall be repaired or removed within 60 days of the effective date of this permit. -2- 12) This approval is valid until December 11, 1991, and shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance.
