On March 26, 1962, the Alameda County
Planning Commission approved a Conditional
Use Permit to erect and operate a Church
facility, and an adjustment to operate the
facility in such a manner as to reduce the
number of off street parking spaces from 215
to 186 spaces.
On June 6, 1973, the Alameda County Zoning
Administrator approved a Conditional Use
Permit request to operate a Preschool with a
capacity of 48 children in a R-S-D-3
District.
On October 10, 1973, the Alameda County
Zoning Administrator approved the expanded
use of the existing Church facility by the
addition of a youth counseling office in an
R-S-D-15 Suburban Residential District.
On September 22, 1976, the Alameda County
Zoning Administrator approved a Conditional
Use Permit to continue operation of a
Preschool facility in a R-S-D-3 Suburban
Residential District.
On March 18, 1981, the Alameda County Zoning
Administrator approved a Variance and a
Conditional Use Permit to allow a subdivision
sign in an R-S-D-3 Suburban Residential
District.
On September 16, 1981, the Alameda County
Zoning Administrator approved a Conditional
Use Permit to continue operation of a
Preschool in a R-S-D-3 Suburban Residential
District.

On January, 7, 1982, the Alameda County Board
of Supervisors approved the petitioned
reclassification of the property at 7557
Amador Valley Boulevard from R-S-D-15 to a PD
(Planned Development) District allowing C-O
(Administrative Office) District uses.

On April 21, 1982, the Alameda County Zoning
Administrator approved a Conditional Use
Permit to allow a temporary directional sign
for a subdivision in a PD (Planned
Development) District.

On July 6, 1982, the Alameda County Planning
Director conditionally approved a Site
Development Review for an office building on
the site of 7557 Amador Valley Boulevard (new
structure numbered 7567).
PA 83-030:
On June 23, 1983, the City of Dublin Planning
Director approved Site Development Review for
the new Resurrection Lutheran Church building
at 7557 Amador Valley Boulevard.
PA 83-068:
On November 21, 1983, the Dublin Planning
Commission approved a Conditional Use Permit
for the continued operation of a Child Care
Center in a different location on the
original site.

On December 15, 1986, the Dublin Planning
Commission approved a Conditional Use Permit
for the continued operation and a new
expansion of the Preschool facility.
On May 25, 1989, the City of Dublin Planning
Director approved an Administrative
Conditional Use Permit for the use of a
temporary promotional banner related to the
Preschool facility. Similar applications were
approve~ in 1990 and 1991.
APPLICABLE REGULATIONS:
Section 8-46.2 (a) of the Dublin Zoning Ordinance states
that church and school uses in the C-O zoning are subject to
approval of a Conditional Use Permit.
Section 8-94.0 states that conditional uses must be analyzed
to determine: 1) whether or not the use is required by the
public need; 2) whether or not the use will be properly related
to other land uses, transportation and service facilities in the
vicinity; 3) whether or not the use will materially affect the

health or safety of persons residing or working in the vicinity;
and 4) whether or not the use will be contrary to the specific
intent clauses or performance standards established for the
district in which it is located.
ENVIRONMENTAL REVIEW: The project has been found to be
Categorically Exempt from CEQA under Section 15301, Class 1 of
the California Environmental Quality Act guidelines. This use
consists of the continued operation of an existing public
facility involving no expansion of use beyond that previously
existing.
NOTIFICATION: Public Notice of the February 18, 1992 hearing was
published in the local newspaper, mailed to adjacent property
owners, and posted in public buildings.
ANALYSIS:
The Applicant is requesting Conditional Use Permit approval
to continue to operate a Preschool and a Child Care facility
(community facility) at 7557 Amador Valley Boulevard in a PD,
Planned Development District allowing C-O Administrative Office
District uses. This request is made necessary by the December
11, 1991 expiration of Conditional Use Permit PA 86-105 for the
operation of the Preschool facility and Child Care Center. A
Preschool has been a conditionally permitted use at the Lutheran
Church of the Resurrection since 1973, allowing a maximum of 48
children at any one time (a total of four separate sessions, with
two classes each, are utilized). The Child Care Center has been a
conditionally permitted use since 1983 and has a limit of 24
children. Both facilities operate concurrently for a total on
site maximum of 72 children at one time. The current application
does not represent an expansion of previously approved facilities
by increasing the maximum number of children allowed on the site
at any time.
There are no scheduling or parking conflicts created by
these uses on the site. All activity related to these two uses on
the site are confined between the hours of 6:30 a.m. and 6:30
p.m.. Church services occur only on Sundays; other Church related
special interest meetings are scheduled after 7:30 p.m..Previous
Site Development Reviews and reviews by other departments have
determined that there is adequate parking on site for faculty,
parents, and Church office personnel.
The project has been routed to other City Departments and
the Department of Social Services of the State of California for
review and comment. No concerns were expressed by any agency.
Conditions are included in the Draft Resolution (Exhibit B)
requiring continued verification of appropriate licensing and
yearly participation in a Child Abuse Prevention Program approved
by Dublin Police Services.
The project is in compliance with the Zoning Ordinance and
the General Plan. Staff recommends approval of the Applicant's
Conditional Use Permit request to allow the continued operation
of the Preschool and Child Care facilities at the site of the
Lutheran Church of the Resurrection at 7557 Amador Valley
Boulevard subject to the conditions specified in the Draft
Resolution (Exhibit B).

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 92-002 RESURRECTION LUTHERAN PRESCHOOL CONDITIONAL USE
PERMIT REQUEST TO ALLOW THE CONTINUED OPERATION OF A PRESCHOOL AND A
CHILD CARE FACILITY (COMMUNITY FACILITIES) AT 7557 AMADOR VALLEY
BOULEVARD IN A PD, PLANNED DEVELOPMENT DISTRICT
WHEREAS, Stan Adams, Church Council President and Susan Holley,
Child Care Center Director submitted an application requesting
approval of a Conditional Use Permit for the continued operation of a
Preschool and a Child Care facility at 7557 Amador Valley Boulevard in
a PD District; and
WHEREAS, the Planning Commission did hold a public hearing on
said application on February 18, 1992; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act (CEQA) and was
found to be Categorically Exempt under Section 15301, Class 1 of the
State CEQA Guidelines; and
WHEREAS, the Staff Report was submitted recommending that the
application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
The continued operation of the Preschool and Child Care
facilities will serve a public need by continuing to
provide, in part, for an existing need for preschool and
child care facilities in the City of Dublin.
The uses will be properly related to other land uses and
transportation and service facilities in the vicinity, as
the proposed uses will be compatible to the type and nature
of operations typically found in the neighborhood.
The uses, under all circumstances and conditions of this
particular case, will not materially adversely affect the
health or safety of persons residing or working in the
vicinity, or be materially detrimental to the public welfare
or injurious to property or improvements in the
neighborhood, as all applicable regulations will be met.

BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby conditionally approve PA 92-002, Resurrection Lutheran
Preschool Conditional Use Permit application, as generally depicted by
materials labeled Exhibit A, stamped approved and on file with the
Dublin Planning Department, subject to the following conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied
with prior to the issuance of buildinq permits or establishment of
use, and shall be subject to Planninq Department review and approval.
The followinq codes represent those departments/aqencies responsible

This Conditional Use Permit approval for PA 92-002 is to allow
the continued operation of a Preschool and a Child Care facility
on the site of the Lutheran Church of the Resurrection at 7557
Amador Valley Boulevard in a PD Planned Development District.
This approval shall generally conform to the plans stamped
approved, labeled Exhibit A, consisting of a Site Plan and Floor
Plans (2 sheets) dated received by the Planning Department
January 10, 1992. [PL]
The maximum number of children present at the Preschool nursery
at any one time shall not exceed 48. The maximum number of
children present at the Child Care facility shall not exceed 24.
The maximum number of children, as a combined total from both
facilities, present on site at any time shall not exceed 72. [PL]

School noise shall be controlled so as not to create a nuisance
to the adjoining residential neighborhood. No outside activities
shall take place before 8:00 a.m. [PL, PO]
On a continuous basis, the Applicant shall provide the City of
Dublin Planning Department with current operating licenses issued
by the State of California Department of Social Services for the
Child Care Center and the Preschool. [PL]
The Preschool and Child Care facilities director shall, at the
minimum of a once-a-year basis, make arrangements to have the
Dublin Police Services Child Abuse Prevention Program, or an
equivalent program approved by Dublin Police Services, presented
to the Staff and children attending the two facilities. A
certification of the presentation of such a program shall be
presented to the Planning Department on a yearly basis. [PL, PO]

This use shall comply with all applicable Planning, Building,
Dougherty Regional Fire Authority, Police Department, and State
of California Department of Social Services regulations and

This use shall be subject to zoning investigator review and
determination as to compliance with the conditions of approval.

At any time during the effectiveness of this approval, the
approval shall be revocable for cause in accordance with Section
8-90.3 of the Dublin Zoning Ordinance. Any violation of the
terms or conditions of this permit shall be subject to citation.

STATEMENT FOR CONDITIONAL USE PERMIT
Quality infant and child care is an important resource for families in our community.
Resurrection Lutheran Child Care Center offerers full time care for infants and children in
our community. We operate on a non-discriminatory basis w/thout regard to race, color,
religious background, national origin, or ancestry. Children are enrolled on a first come first
served basis.
We are licensed for a total capacity of twenty-four children ages six weeks to four
years old. The hours of operation are 7:00 a.m. to 6:00 p.m. Monday through Friday.
Currently we are at capacity with twenty-four children enrolled. We also maintain an active
waiting list. During our eleven hours per .day of operation we employ ten paid staff
members. At this time we are the only child care center in Dublin who serves families with
infants and toddlers.
We use the physical plant and parking lot of the Lutheran Church of the
Resurrection. We use the facility during the week when the church is not using them.
Parking is more than adequate for our needs. As an outreach of the Lutheran Church of
the Resurrection, we are providing an important community service.
