Appointment of Dublin Crossing Community Park Task Force and the Agreement
for Landscape Architectural Services to Prepare the Park Master Plan

EXECUTIVE SUMMARY:
The City Council will consider the Mayor's proposed appointments to the Dublin Crossing
Community Park Task Force and the approval of an Agreement with SWA Group to provide
landscape architectural services to complete the Park Master Plan.
FINANCIAL IMPACT:
The proposed fee for services is $115,500. Sufficient funds are available in the FY 2014 -2015
Capital Improvement Program budget to approve the Agreement.
RECOMMENDATION:
Staff recommends that the City Council take the following actions-
1 . Confirm the Mayor's appointment of the 15 Community Members at Large and the City
Historian to the Task Force; and
2. Direct Staff on how to fill the position for an adult sports non - profit organization or delete the
position from the Task Force composition; and
3. Adopt the Resolution approving an Agreement with SWA Group to complete the Master Plan
for Dublin Crossing Community Park.

DESCRIPTION:
The 30 -acre Dublin Crossing Community Park will be centrally located in Dublin at the
intersection of Dublin Boulevard and the future Scarlett Drive extension on a portion of the
current Camp Parks property (see Land Use Plan — Attachment 1).

On April 15, 2014, the City Council approved the formation and composition of a Task Force to
participate in the development of a Park Master Plan and directed Staff to advertise the
openings. The City received 49 applications for 15 "Community Member At- Large" positions on
the Task Force. Attachment 2 includes copies of the applications received by the City. The
Mayor is recommending the following residents for those positions:

In addition the Task Force composition approved by the City Council on April 15, the Mayor is
recommending appointing the City Historian to the Task Force.
The position for an adult sports organization is vacant as there are no official Dublin -based adult
sports non - profit organizations. All rentals of City fields for adult sports at this time are by
casual groups. The only active adult sports rental group has been a casual group of cricket
players that live in and around the Positano development; however they are not an official non-
profit organization. The group has rented the field 29 times in the past year. Staff is seeking
direction on how to fill this position or to delete it from the Task Force composition.
AGREEMENT FOR CONSULTANT SERVICES TO PREPARE THE MASTER PLAN
In order to facilitate the master planning process, Staff solicited a Request for Proposals and
received proposals from 12 landscape architectural firms. Upon review of the 12 proposals Staff

selected five firms that best met the qualifications to complete the interview process. As a
result of the interview process and site visit to a representative project, Staff recommends
selecting SWA Group to work with a Task Force to prepare the Master Plan. The Task Force
appointments will be confirmed by the City Council on July 15, 2014.
SWA Group recently completed the Iron Horse Nature Park Master Plan for the City and
conducted a successful facilitation and public input process.
The scope of work for professional services includes site analysis and evaluation; background
studies; development of three alternative designs and a preferred conceptual plan; cost
estimates; and, facilitation of up to 10 task force and community meetings, and presentations at
Parks and Community Services Commission and City Council meetings. Attachment 3 is a
Resolution approving the Agreement between the City of Dublin and SWA Group. The
Consultant Services Agreement, which outlines the scope of work and fee schedule, is shown
as Exhibit A to the Resolution.
Following is the tentative schedule for the Master Plan project and Phase I of improvements as
approved in the 2014 -2019 Capital Improvement Program:

Explain why you are interested in serving on the Dublin Crossing Park Task Force ?: I was involved in the task
force that developed Dolan park. I have been on several committees for the city through the years including a
joint use taskforce for parks with the Dublin Unified School district, Zone 7 ground water management
committee, and Measure B citizens over site committee. I have also taken the city of Dublin citizen leadership
academy. I attended task force meetings for the biking masterplan for Dublin.
I have a good sense of which questions to ask and how to deal with consensus decisions. I can take in
information without bias.
Please explain how you currently use Dublin parks and what is your favorite park and why ?: Use Dolan park to
walk my dogs and play with my grandchildren.
When Shannon park is intact, I also use that with my grandchildren. I use the walking paths there with my
neighbor.

Explain why you are interested in serving on the Dublin Crossing Park Task Force ?: I want to become more
involved within the City. Specifically, I want to be involved with things that will have a lasting impact on
residents, especially kids growing up in Dublin and families.
Being a new parent I want to ensure that my son grows up in an amazing city and I see that this is a good
opportunity to get involved and help meet that goal.

taking our son to different parks around Dublin to spend weekend afternoons on the play structures and in the
sandboxes. We held our son's first birthday at Emerald Glen's picnic area.
Our favorite park in the Schaefer Ranch park because it has the great padded ground for the kids to run around
on and one of the best play structures around. It also a nice place for parents to hang around while the kids play
and is an awesome setting to play some games on the open park there.

Explain why you are interested in serving on the Dublin Crossing Park Task Force ?: I have been a Dublin
resident for 13 year and have enjoyed all the parks and facilities city has built over the years. My interest in
participating is to positively contribute towards the growth of the city, parks and facilities they have to offer. I
hope my participation can help build a park that could be used by all residents and of all ages. Also my interest

area for about 8 years. Now my children are at the age where they enjoy and explore the dublin parks and
recreational activities. As a law enforcement officer that lives on Camp Parks, I work hard to ensure that my
children are engaged in safe, natural, and appropriate recreational activities that encourage development and
high self esteem. Another reason that I would like to serve on the Dublin Crossing Park Task Force is that I am
outgoing and enthusiastic about reaching out to the target groups that will be served by the park.
Please explain how you currently use Dublin parks and what is your favorite park and why ?: We use the parks
for hiking, water play, general play, and picniking.
My children are ages 19, 9, 5, 3, and 1 years old.
We have not been to all of the parks in the area but our favorite park is Schaefer Ranch Park because it has
feautres suitable for various ages. It is clean and well maintained. The landscape of it allows you to keep an eye
on all of the children at once.

working toward a MA in Gerontology. I see the park as being all inclusive for all age groups and adaptive for
ADA. I'd like to see activities that appeal to various age groups.
1. I see several resting areas with shade and a circular walking trail with 1/4 miles marked and benches and
seating all around along with picnic tables.
2. several play grounds that are age appropriate from toddlers on up.
3. I'd like to see a Solar Warm weather pool for adult swimming and exercising.
4. There should be lots of solar lighting - so the park is multifunctional for day and evening activities.
5. lots of HC parking located all around the complex which can be divided into several pods - with an outdoor
stage and seating in one pod, play areas for toddlers up to older kids for climbing walls, etc.

bit and sitting and just enjoying the sun on my face. I enjoy the park on located Central Parkway and Tassahara,
in Dublin.

Nurse Association, American Society of Aging, and was trained to be a trainer of other nurses in Pain
Management and Palliative Care. Came in very helpful as a Case Manager for Hospice Care. I was involved in

in several Aging projects and Children's Health Education.

on this task force. I believe as a resident of Dublin for 11 years and a mother I can help evaluate what other
local residents with children would like to see. I also understand the value of parks through my studies with a
BA in Recreation Administration. I would like to serve my community and I currently have time to do so as a
stay -at -home mom.
Please explain how you currently use Dublin parks and what is your favorite park and why ?: With a child, we
use the playgrounds near our home often. We love the open area of Shannon Park where we can fly kites and
play soccer. We are thrilled with the fact that the City of Dublin connected the pathway near the Dublin Library
and we have enjoyed riding our bikes to the Farmers Market in Pleasanton. We are excited to see the final
results of Shannon Park. We love Heritage Park where my child takes Irish Dance and where we have gone to
events the City of Dublin has put on. My favorite park is Mape Memorial Park. It is close to where we live and
the playground is open for viewing kids. The amenities of the park such as seating, shelter, bathrooms and open
grass makes the park highly desirable to all ages of children. We also enjoy the connection it has to the pathway
along San Ramon Road so we can ride our bikes to and from.

Explain why you are interested in serving on the Dublin Crossing Park Task Force ?: I am a retired Certified
Public Accountant who was in public accounting for over 35 years and served as a two term City Auditor for
the City of Oakland. I have a strong background in public service to not for profit corporations and focal
commissions. Now I live in Dublin, since 2007, and I want to serve this community. This type of study and
evaluation would be most interesting for me and relates to my experience.

E�.plaiit -why you are interested in serving on the Dublin Crossing Park Task Force ?: Dublin is home. I love
Dublin and have been a resident since 1995. This is where my husband and I began our marriage, bought our
first house, and brought three great kids into the world. When we leave Dublin to go on vacation, I enjoy my
time away, but I enjoy coming home even more.
There have been several times over the years that we've entertained the idea of moving to neighboring cities,
and even Portland, OR once. But there was never a home or town that felt right. So in 2006, when our house
was bursting at the seams with a 4 year -old and a set of 2 year -old twins, we remodeled and added 1100 square
feet. This was a major investment in many things, including an investment in Dublin. We grew roots.
I would enjoy the opportunity to serve on the Dublin Crossing Park Task Force because I am heavily invested in
this community. I love that I live in a town with people from all over the world, people of different socio-
economic levels, religions, and political viewpoints. Having grown up in Berkeley and Oakland, I value
diversity. It would be a privilege to represent all of that in helping to shape a hub in Dublin.
As a stay -at -home parent, I have had the privilege to work in all three classrooms for each of my kids, for every
year of elementary school (currently 4th, 4th and 6th grades). I've been able to take on Executive Board
positions including school publicity officer and Vice President during my kids' time in co -op preschool. Many
have been the volunteer duties I've managed for Dublin Unified School district including Family Art Night,
Classroom parent, and FAME, to name a few. Currently I manage Spirit Wear for Dublin Elementary for the
second year in a row. My kids have participated in GATE program projects, Dublin Little League, Dublin
Soccer, Girl Scouts and lots of classes and camps offered through The Guide. All of this has given me
continued experience in working with administrators, teachers, school staff, and best of all, kids! Combining
this experience with my previous corporate experience with Sun Microsystems and the State of California has
taught me how to work with people.
As a member of the task force, I would be comfortable sharing ideas and collaborating.
Additionally, I've visited parks in London, England, parts of Australia, and Paris, France and have never
forgotten their amazing features.
Please explain how you currently use Dublin parks and what is your favorite park and why ?: Naming a favorite
is just..... unfair. We use most of the parks in Dublin, and go to different ones based on how much time we have,
the group we're with, our mood and activity level. Here's a list of what we like:
* Shannon Park - Walking the dog, play equipment, photo shoots, Shannon Center for classes /events
* Alamo Creek Park - Trail walks, running the hills, solar eclipse viewing, play equipment,
city campout
* Bray commons - Small dog, dog park
* Mape Park - the tire swing, fields, group playdates
Heritage Park - Drama Camp in the barn, best photo spot in Dublin, museum and cemetery
* Kolb Park Running on a soft surface, play structure, tennis courts

on the Dublin Crossing Park Task Force because I am passionate about our outdoor recreational facilities. I am
a first -time mother to a 16 -month old daughter and I want to do everything I can to ensure she has safe, dynamic

Dublin Sports Grounds. It's very close to our home, and my daughter adores watching bigger children play on
the field, and on the climbing structures. It's also the perfect size for her -- big enough for toddler stimulation,
but small enough so as to not be overwhelming. We love it.

and I use the parks a lot, my son is on the green gators swim team and dusl knights club team. I would like the
chance to weigh in on future parks. I have a lot of fun ideas and would to see what others have to offer.

close to our home. My son plays soccer there and I play softball. The parks needs finishing but is nice. Id like to
see the bmx track cleaned up and made smaller. Im looking forward to the new park next to kolb school, it

a resident of Dublin i feel it is my duty to make sure our City residents receive the right benefits that they expect

garbage cans and the bathrooms always well- maintained! My favorite park is Emerald Glen Park because is
well equipped with everything for all ages, my kids love the skate area and the unique playground with a rock
climbing area, and my husband & I like to play basketball and walk in the trail near Persimmon Drive & Central
Pwy.

the most fun for them. They enjoy riding their bikes along the paths, but a dedicated bike trail would be great, to
avoid pedestrians and pets. My girls will stop and get off their bikes when they see a dog coming. They enjoy
the swings, but barely get a turn. Rock structure they enjoy the most. We frequent Positano Hills Park, as it's
closer to our home. Positano is only useful if my girls want to run around, all the equipment is too small for

I am a licensed Architect and Dublin resident since 2001. My experience as an Architect (with Barry &
Volkmann Architects in Danville) is directly applicable to the work of the Task Force. But maybe more
important, my husband and I are fathers to a happy, beautiful 3 1/2 year old girl. Dublin's parks are central to
our lives as a family. Dahlia, our daughter, knows them by name, even at 3 1/2. We plan to remain active
Dublin residents as a family for many years to come, and for that reason I am especially interested in using my
experience as an Architect and father to help shape our own community. The Dublin Crossing Park Task Force
is a great opportunity to have that involvement.
Please explain how you currently use Dublin parks and what is your favorite park and why ?: Our family lives
around the corner from Mape Park in west Dublin. It is a pleasant 1 -block stroll that we have made countless
times since our daughter was born. Dahlia attends the KinderCare that is just across the bridge (next to
Anderson's Garden Center), and very often when we pick her up she is excited to run across the bridge and play
at the park. When we want a longer walk from home, Dahlia and I will venture over to Dolan Park (where years
ago I also played pick -up basketball games). She likes to pretend that the two play structures are our pirate
ships. We also love Shannon Park, with all it has to offer, including Saturday morning soccer for Dahlia. We
love the mix of active and passive activities there. During much of the year, we make a trip over to Emerald
Glen, often combined with Farmer's Market. Sometimes we caravan there with our neighbors who also have
young children. Last, I have to say that my favorite is Dublin Heritage Park, because of the many hours Dahlia
and I have spent there. She LOVES the "kitchen ", and knows the barn inside and out. She still talks about when
"Mr. Russell Kennedy" brought out the wagon and gave her a ride with her grandparents. Now she wants to
play checkers at the tables. (Of course I also love the park because I'm a recognized Historical Architect, and so
I appreciate the various structures and their restoration). When she's old enough, Dahlia wants to take the
ceramics class inside the potting shed of the old Kolb House.

48 years I've seen a lot of development and changes. A park within our community will not only be used by the
immediate residents but also other residents throughout Dublin. Community events held at this park maybe of

Historic Park and Shannon are my favorites as they are close to my home. My daughter recently had her
wedding at the Sunday School Barn and it was perfect. The reception was held at Shannon Community Center
which is quite beautiful after the remodel. The Shannon Center has fond memories as my wedding reception
was at this location and I also remember when the Historic Park was just St. Raymond's Church and the
graveyard. Both parks are part of Dublin's history for many longtime residents.

provide input and direction on the development of a comprehensive master plan for the 30 -acre Dublin Crossing Community
Park located on the former Camp Parks Army Base. The Task Force will also be charged with the following tasks:

Explain why you are interested in serving on the Dublin Crossing Park Task Force ?: Hi. I am interested in
serving on the task force for many reasons. One reason has to do with the fact that I have children, ages five and
eight. This is as much their community as it is mine. Second, I grew up in the Tri- valley area. My wife and I
chose Dublin as the place to start our family and we bought our first house here in Dublin. We have no plans of
leaving the Dublin community and Dublin's overall development is important to us. Lastly, being part of a plan
to develop parks for the children and residents of Dublin is an honor and a privilege and I would appreciate the
opportunity to lend my voice, ideas, and assistance in shaping those efforts.
Please explain how you currently use Dublin parks and what is your favorite park and why ?: I mostly use the
Emerald Glen Park as opposed to the other parks in Dublin as it is close to my home. I've played basketball
there with friends. I've used the Tennis courts for myself and for my children. The kids and I like to watch
Cricket matches in the part from time to time. We also watch and have flown kites in the park. My daughter
attends the Emerald Glen preschool as did my son when he was four to five years of age. The kids and I take
walks in the park, ride our bikes, watch the fourth of July fireworks, occasionally stroll around the farmer's
market on Thursdays, and showed up for a movie or two when they had movies in the park. We also enjoyed "A
Day on the Glen" when it was being held. My son spent time at the Shannon park in west Dublin playing soccer
when he was three. When I was young, I played soccer matches at the Dublin sports park across from what is
now the civic center. When I worked at Mcdonalds in Dublin over twenty years ago, we would frequent other
parks around Dublin after work to play Basketball. There's another park that I used to play Tennis at and attend
parties over near Cranford Lane (I have friends that live there — forgot the name of it). Still, Emerald Glen is my
favorite — perhaps because of the frequency of visits I pay to the park and my proximity to it.

resident of Dublin first living on the West side for 10 years and now on the east going on 7 years. I have seen
how the city has grown in all those years. Last year I participated in the Dublin Leadership Academy and this
year participating in the Dublin Police Services Citizen Academy. Since I moved here from Castro Valley and
now my daughter and family with a 21 month old daughter, I feel that I would have a good perspective on how I
would like to see this new community develop.

daughter we explore all the different parks and other activities in the neighborhood. We used the Emerald Glen
Park for my gran daughter's first birthday celebration and introduced our family to the beautiful park. We walk/

Explain why you are interested in serving on the Dublin Crossing Park Task Force ?: Like many of my
neighbors in Dublin, I love getting out in nature to hike, ski, mountain bike, climb, paddle, etc. To make the
most of these excursions, I need to live an active life at home and incorporate exercise into my daily routine.
Doing so is not a simple task given my commute to work, responsibilities at home, and other community service
activities. The size and location of this new Park makes it ideal for commuters like me and may be a real
opportunity to draw people in from surrounding towns, especially those who drive to Dublin/Pleasanton to pick
up BART.
Please explain how you currently use Dublin parks and what is your favorite park and why ?: I like all the parks
in Dublin for different reasons. Kolb Park is the park I use most since it is on the way to my daughter's school
and closest to my home (excluding the dog park and Stagecoach Park). Kolb is a great use of space that
provides a large grass area to play sports and have area for running and practicing skills that require open space.
The play area has a place dedicated for smaller children and has equipment for larger children that incorporates
climbing and swinging. The proximity of the bathrooms to the playground is critically important for my family.
I have used the pavilion several times for family, school and church events -- making the park practical and
useful for larger groups. When there with my kids, I am drawn to the track and exercise equipment and often
find that I can use some of my time at the park getting exercise myself. I don't play tennis, but the courts at the
park get a lot of use, from what I can tell, and make the park relevant for families with older children and adults.
Emerald Glen is the largest park in Dublin, I believe. It is a great place for large -scale events and sports.
Shannon Park may win the prize for best placement since it is next to my daughters preschool and the Shannon
Center.
Mape is an excellent neighborhood park. Smaller and tucked away allows for a more intimate feel. It has been
the ideal spot for the Easter Egg Hunt my church has put on the Saturday before Easter each year.
Stagecoach Park seems uni- dimensional -- meaning it is geared towards young children and has limited appeal to
older kids and adults. However, it is a small space with limited additional potential uses.
The dog park has been a great addition. I don't have a dog, but I see it being well used as I frequently drive by
or walk the Dublin hills. I also hear from my neighbors that that park is a good addition.
Complimenting the wonderful network of existing parks will be a fun and interesting challenge in designing a
new large -scale park in Dublin.

West Dublin for close to 25 years, I have witnessed the growth and diversity of the city /area with awe and
occasional disappointments to change.
My children and now grandchildren continue to utilize the parks, educational (love the Library) and retail
centers. As an aging resident, I am more open to opportunities for all residents and visitors to "our town" to
fully appreciate the recreational needs of all.
Please explain how you currently use Dublin parks and what is your favorite park and why ?: Family picnics,
camps and wanderings. Shannon Park is where my grandkids, and I spend most of our time. Sitting on the grass
reading (or just being still), and signing up the grands for Nature Camps, spring breaks. Walking distance from
my home is Heritage Park, love, love, love it.
We have also celebrated birthdays at the Farmer's Market park. Kohl Park, while small, is a nice neighborhood
park for meditative walks, or tennis matches. My grandson and son -in -law are big B -Ball players, unfortunately
Dublin High requires a car trip, would be nice to have courts on westside.

feedback forums that were held for Emerald Glen Park. I have children in both elementary and middle school

continue to have open space for everyone to enjoy. With the increased amount of housing that Dublin is
experiencing, we need to have a recreational space that offers various opportunities for people to get together in
a family- friendly environment.
Please explain how you currently use Dublin parks and what is your favorite park and why ?: Our favorite park
is Emerald Glen Park and we are there quite a bit. To begin with, I start most mornings walking in and around
the park and I'm always pleased that it is clean, well -kept and being enjoyed by many of my neighbors. We also
have had my son's soccer practices there and numerous tournaments over the years. I like how the park is
always being used for rugby, cricket and bocce in addition to all the baseball, soccer, tennis and football I see.
The kids have had parties there and meet their friends there to play basketball or ride bikes. We attend the
weekly farmers market when in season and fly our kites on windy days. We love to attend the annual Splatter
festival as well as movies, concerts and fireworks. I've been eager to see the final build out of the other
amenities for this park and I feel it's a great addition to Dublin.

new park could accommodate both active and passive areas. I also enjoy the public process in developing
projects that are designed to benefit the community as a whole. At times it can be challenging, but very
satisfying when a project successfully comes together in the end. I would be very honored to be selected to
serve on the task force developing the plan for one of the last major parks in the City of Dublin.
Please explain how you currently use Dublin parks and what is your favorite park and why ?: I currently use the
Dublin parks in a couple of ways. First, my 8 year old son is in Little League so we spend much time in the
parks practicing and playing baseball games. Second, we often use the parks on the weekends to practice
various sports with my son, including baseball, basketball, and tennis. We also often use the parks to meet up
with friends for playdates and attending birthday parties. My son also has used the parks in the summer at
various City Summer Camps. My favorite park is Emerald Glen Park because of all the diverse things to do
there. We love the playgrounds, water features, cool sand box with hidden dinosaurs and climbing "mountain ",
picnic pavilions, large open fields, places to fly kites, tennis and basketball courts, and nice wide "boulevards ".
We have even played Fall Dublin Little League Baseball there.

and love to let my kids explore the different types of parks and see how they interact with the differences in
environments. When we travel anywhere, we will try and visit local parks if we have time. During good weather
I am a very regular park user and typically frequent several different parks very frequently - Shannon, Kolb, and
Emerald Glen. There are numerous issues at each park which would be good not to recreate at a brand new
park -- block the wind, visibility, safety from the street, and maintainibility. As we frequent Numerous SF parks
there is a very diverse and high use of parks there that is not seen in Dublin -- but would be great if a'great' park
were available to bring even more Of Dublin together.
Please explain how you currently use Dublin parks and what is your favorite park and why ?: As I have two
children and a dog, our family spends a significant amount of time using parks and open space for recreation,
play, attending events such as the farmers markets, and hiking.
Our favorite Dublin Park is emerald glen as it includes numerous activities, water play, and has a non traditional
'adventure' type rock climbing area with slides that challenges kids.
Some of our favorite non Dublin parks include Mission Delores in SF, the new play area at the SF zoo, Happy

high level of insight to both the soccer specific usage of current and future parks, but as I've worked in the
youth sports field in Dublin for the past 5 years I have a strong sense of the needs of the community when it
comes to park space for youth activities. This looks like a very exciting project and I've enjoyed working with

resident since 1985. My husband and I have proudly raised our four children in Dublin. We have seen
tremendous growth, and change, over the years. It is a historical time, for our city, as we link the east and west
sides of Dublin.
I would like to be part of this exciting opportunity to be on the task force developing the master plan to design
the future Dublin Crossing Community Park.
I have a great interest in the future of Dublin and believe I can make a positive contribution to the efforts of this
important task force over the coming year.
Please explain how you currently use Dublin parks and what is your favorite park and why ?: As my children
grew up we spent a lot of time at Shannon Park as well as Mape Park. These parks provided a place for our kids
to be with friends and make new ones as well. As they grew it meant a place for soccer and T -ball practice.
Shannon Park provided lots of paths for bike riding and skating, an interactive playground, mature trees to
climb and a fun creek to explore. We also enjoyed a variety of enrichment classes over the years, at the Shannon
Community Center, such as Critters and Clay, Irish Dance, Terrific Two's and Terrific Three's.
I am enjoying our new parks and the array of community events they offer. The Farmers Market, at Emerald
Glen, is a wonderful time for friends to mingle. I am also enjoying many of the events at our new Heritage Park.
I am so proud of our city for it's positive growth and preserving our rich history!

number of outreach ministries. In response to a need in our community we created an inter -faith committee to

Explain why you are interested in serving on the Dublin Crossing Park Task Force ?: I moved to Dublin eighteen
years ago when I purchased my house near Wells Middle School and Camp Parks. Previous to that I lived and
grew up in San Ramon. I have lived in this valley all my life. I have a son who is now 22 years old who I raised
here in Dublin. I have seen Dublin grow from a small town in the 1970's to what it is today.
I want to serve on the Dublin Crossing Park Task Force because I feel I have a vested interest in helping shape
the city where I live, my neighborhood and surrounding area. I don't want to sit back, wish for a better
community and let other people do all the work — I want to help out! My way of helping would be to serve on
this task force.
I believe recreational parks are a very important part of a community because they are now to us what "town
squares" were to communities a century or so ago. Town squares are where people would meet, socialize and
have recreational activities. We still have main "town squares" for city (downtown area) but we need a smaller
ones for our neighborhoods. We need places that are within walking distance to our homes where we can meet
and socialize with our neighbors. When we get to know our neighbors then we care more about our
neighborhoods which is vitally important.
Please explain how you currently use Dublin parks and what is your favorite park and why ?: I attend the
Farmer's Market at the Emerald Glen Park. This park is fantastic and very large! I really enjoy going to the
Farmer's Market and also being able to walk around the park.
I walk to the Dougherty Hills Dog Park. This is a great park because it's the only one (besides Wells Middle
School) that is within walking distance of my house.
Shannon Park is a hidden gem that I love to go to. It's easy to get to and has easy parking. I remember going to
this park when I was very young!
Every year I attend the St. Patrick's Day Festival which is right next to the Dublin Sports Grounds. The Dublin
Sports Grounds is an important aspect of our city for our sports teams.
All of these are really great parks but my absolute favorite is the Dublin Heritage Park & Museum. I love
walking through the historic cemetery and looking all the pioneers who discovered this area. My favorite place
is the old St. Raymond Church which is beautiful and historic. I love that this old church is available for rental. I
think it is important for children (and adults) to discover the history and heritage of our city and area and they
can at this park.

resources that have the ability to enrich the quality of life for those living in the surrounding area as well as
those visiting our city. They are multifunctional and transformational, providing a public location for the Dublin
community to participate in activities,hold gatherings or display works of art. A City with a thriving system of
parks encourages and active community in both the physical and civic sense. will make it more appealing for
the community to congregate as well as others that are visiting. This park will be very important to the
community and have a diverse representation of community members on the Crossing task force is equally
important for making sure the multiple voices are represented.
Please explain how you currently use Dublin parks and what is your favorite park and why ?: My children, ages
9 and 13, are heavily involved in sports and so our family utilizes many of the Dublin parks often. My favorite
park is Fallon Park because it has top of the line soccer fields and the baseball fields. The basketball courts have
been put to great use by communities and basketball leagues. I have also observed that outside organizations use
Fallon for sports because the grounds are well maintained, of good quality and fulfill multiple sports needs well.
I'm proud of the future direction of Fallon.

involved with the local Parent Faculty Clubs gives me a sense of what our parents and children need within the

APPROVING AN AGREEMENT WITH SWA GROUP FOR THE
DUBLIN CROSSING COMMUNITY PARK MASTER PLAN
WHEREAS, the City has solicited proposals from landscape architectural firms to complete
the Dublin Crossing Community Park Master Plan and facilitate the community input process; and
WHEREAS, the City received twelve proposals, interviewed five firms and selected SWA
Group; and
WHEREAS, SWA Group has demonstrated ability to perform said Master Plan and
community input process; and
WHEREAS, SWA Group is available to perform work as specified.
NOW, THEREFORE, the City Council of the City of Dublin does RESOLVE to approve
the Agreement with SWA Group, attached hereto and authorize the City Manager to execute
the Agreement.

CONSULTING SERVICES AGREEMENT BETWEEN
THE CITY OF DUBLIN AND
SWA GROUP
THIS AGREEMENT for consulting services is made by and between the City of Dublin ( "City ") and
SWA Group ( "Consultant ") as of June 17, 2014.
Section 1. SERVICES. Subject to the terms and conditions set forth in this Agreement, Consultant
shall provide to City the services described in the Scope of Work attached as Exhibit A at the time and
place and in the manner specified therein. In the event of a conflict in or inconsistency between the terms
of this Agreement and Exhibit A, the Agreement shall prevail.
1.1 Term of Services. The term of this Agreement shall begin on the date first noted above
and shalt end on July 1, 2015, and Consultant shall complete the work described in Exhibit
A prior to that date, unless the term of the Agreement is otherwise terminated or extended,
as provided for in Section 8. The time provided to Consultant to complete the services
required by this Agreement shall not affect the City's right to terminate the Agreement, as
provided for in Section 8.
1.2 Standard of Performance. Consultant shall perform all services required pursuant to this
Agreement in the manner and according to the standards observed by a competent
practitioner of the profession in which Consultant is engaged in the geographical area in
which Consultant practices its profession. Consultant shall prepare all work products
required by this Agreement and shall conform to the standards of quality normally
observed by a person practicing in Consultant's profession.
1.3 Assignment of Personnel. Consultant shall assign only competent personnel to perform
services pursuant to this Agreement. In the event that City, in its sole discretion, at any
time during the term of this Agreement, desires the reassignment of any such persons,
Consultant shall, immediately upon receiving notice from City of such desire of City,
reassign such person or persons.
1.4 Time. Consultant shall devote such time to the performance of services pursuant to this
Agreement as may be reasonably necessary to meet the standard of performance
provided in Section 1.1 above and to satisfy Consultant's obligations hereunder.
Section 2. COMPENSATION. City hereby agrees to pay Consultant a sum not to exceed one
hundred and fifteen thousand and five hundred even ($115,500), notwithstanding any contrary indications
that may be contained in Consultant's proposal, for services to be performed and reimbursable costs
incurred under this Agreement. In the event of a conflict between this Agreement and Consultant's
proposal, attached as Exhibit A, regarding the amount of compensation, the Agreement shall prevail. City
shall pay Consultant for services rendered pursuant to this Agreement at the time and in the manner set
forth herein. The payments specified below shall be the only payments from City to Consultant for services
rendered pursuant to this Agreement. Consultant shall submit all invoices to City in the manner specified

herein, Except as specifically authorized by City, Consultant shall not bill City for duplicate services
performed by more than one person.
Consultant and City acknowledge and agree that compensation paid by City to Consultant under this
Agreement is based upon Consultant's estimated costs of providing the services required hereunder,
including salaries and benefits of employees and subcontractors of Consultant. Consequently, the parties
further agree that compensation hereunder is intended to include the costs of contributions to any pensions
and/or annuities to which Consultant and its employees, agents, and subcontractors may be eligible. City
therefore has no responsibility for such contributions beyond compensation required under this Agreement.
2.1 Invoices. Consultant shall submit invoices, not more often than once a month during the
term of this Agreement, based on the cost for services performed and reimbursable costs
incurred prior to the invoice date. Invoices shall contain the following information:
Serial identifications of progress bills; Le,, Progress Bill No. 1 for the first invoice,
etc.;
■ The beginning and ending dates of the billing period;
■ A Task Summary containing the original contract amount, the amount of prior
billings, the total due this period, the balance available under the Agreement, and
the percentage of completion;
At City's option, for each work item in each task, a copy of the applicable time
entries or time sheets shall be submitted showing the name of the person doing
the work, the hours spent by each person, a brief description of the work, and
each reimbursable expense;
■ The total number of hours of work performed under the Agreement by Consultant
and each employee, agent, and subcontractor of Consultant performing services
hereunder, as well as a separate notice when the total number of hours of work by
Consultant and any individual employee, agent, or subcontractor of Consultant
reaches or exceeds 800 hours, which shall include an estimate of the time
necessary to complete the work described in Exhibit A;
■ The Consultant's signature.
2.2 Monthly Payment. City shall make monthly payments, based on invoices received, for
services satisfactorily performed, and for authorized reimbursable costs incurred. City
shall have 30 days from the receipt of an invoice that complies with all of the requirements
above to pay Consultant.
2.3 Final Payment. City shall pay the last 10% of the total sum due pursuant to this
Agreement within sixty (60) days after completion of the services and submittal to City of a
final invoice, if all services required have been satisfactorily performed.
2.4 Total Payment. City shall pay for the services to be rendered by Consultant pursuant to
this Agreement. City shall not pay any additional sum for any expense or cost whatsoever
incurred by Consultant in rendering services pursuant to this Agreement, City shall make
no payment for any extra, further, or additional service pursuant to this Agreement.

In no event shall Consultant submit any invoice for an amount in excess of the maximum
amount of compensation provided above either for a task or for the entire Agreement,
unless the Agreement is modified prior to the submission of such an invoice by a properly
executed change order or amendment.
2.5 Hourly Fees. Fees for work performed by Consultant on an hourly basis shall not exceed
the amounts shown on the following fee schedule and in Exhibit B:

2.6 Reimbursable Expenses. Reimbursable expenses are specified in Exhibit A, and shall
not exceed ten thousand and five hundred dollars even ($10,500). Expenses not listed in
Exhibit A are not chargeable to City. Reimbursable expenses are included in the total
amount of compensation provided under this Agreement that shall not be exceeded.
2.7 Payment of Taxes. Consultant is solely responsible for the payment of employment taxes
incurred under this Agreement and any similar federal or state taxes.
2.8 Payment upon Termination. In the event that the City or Consultant terminates this
Agreement pursuant to Section 8, the City shall compensate the Consultant for all
outstanding costs and reimbursable expenses incurred for work satisfactorily completed as
of the date of written notice of termination. Consultant shall maintain adequate logs and
timesheets in order to verify costs incurred to that date.
2.9 Authorization to Perform Services. The Consultant is not authorized to perform any
services or incur any costs whatsoever under the terms of this Agreement until receipt of
authorization from the Contract Administrator.
Section 3. FACILITIES AND EQUIPMENT. Except as set forth herein, Consultant shall, at its sole
cost and expense, provide all facilities and equipment that may be necessary to perform the services
required by this Agreement. City shall make available to Consultant only the facilities and equipment listed
in this section, and only under the terms and conditions set forth herein.
City shall furnish physical facilities such as desks, filing cabinets, and conference space, as may be
reasonably necessary for Consultant's use while consulting with City employees and reviewing records and
the information in possession of the City. The location, quantity, and time of furnishing those facilities shall
be in the sole discretion of City. In no event shall City be obligated to furnish any facility that may involve
incurring any direct expense, including but not limited to computer, long- distance telephone or other
communication charges, vehicles, and reproduction facilities.

Section 4. INSURANCE REQUIREMENTS. Before beginning any work under this Agreement,
Consultant, at its own cost and expense, shall procure `occurrence coverage" insurance against claims for
injuries to persons or damages to property that may arise from or in connection with the performance of the
work hereunder by the Consultant and its agents, representatives, employees, and subcontractors.
Consultant shall provide proof satisfactory to City of such insurance that meets the requirements of this
section and under forms of insurance satisfactory in all respects to the City. Consultant shall maintain the
insurance policies required by this section throughout the term of this Agreement. The cost of such
insurance shall be included in the Consultant's bid. Consultant shall not allow any subcontractor to
commence work on any subcontract until Consultant has obtained all insurance required herein for the
subcontractor(s) and provided evidence thereof to City. Verification of the required insurance shall be
submitted and made part of this Agreement prior to execution.
4.1 Workers' Compensation. Consultant shall, at its sole cost and expense, maintain
Statutory Workers' Compensation Insurance and Employer's Liability Insurance for any
and all persons employed directly or indirectly by Consultant. The Statutory Workers'
Compensation Insurance and Employer's Liability Insurance shall be provided with limits of
not less than ONE MILLION DOLLARS ($1,000,000.00) per accident. In the alternative,
Consultant may rely on a self - insurance program to meet those requirements, but only if
the program of self- insurance complies fully with the provisions of the California Labor
Code. Determination of whether a self - insurance program meets the standards of the
Labor Code shall be solely in the discretion of the Contract Administrator. The insurer, if
insurance is provided, or the Consultant, if a program of self - insurance is provided, shall
waive all rights of subrogation against the City and its officers, officials, employees, and
volunteers for loss arising from work performed under this Agreement.
An endorsement shall state that coverage shall not be canceled except after thirty (30)
days' prior written notice by certified mail, return receipt requested, has been given to the
City. Consultant shall notify City within 14 days of notification from Consultant's insurer if
such coverage is suspended, voided or reduced in coverage or in limits.
4.2 Commercial General and Automobile Liability Insurance.
4.2.1 General requirements. Consultant, at its own cost and expense, shall maintain
commercial general and automobile liability insurance for the term of this
Agreement in an amount not less than ONE MILLION DOLLARS ($1,000,000.00)
per occurrence, combined single limit coverage for risks associated with the work
contemplated by this Agreement. If a Commercial General Liability Insurance or an
Automobile Liability form or other form with a general aggregate limit is used,
either the general aggregate limit shall apply separately to the work to be
performed under this Agreement or the general aggregate limit shall be at least
twice the required occurrence limit. Such coverage shall include but shall not be
limited to, protection against claims arising from bodily and personal injury,
including death resulting therefrom, and damage to property resulting from
activities contemplated under this Agreement, including the use of owned and non -
owned automobiles.

4.2.2 Minimum scope of coverage. Commercial general coverage shall be at least as
broad as Insurance Services Office Commercial General Liability occurrence form
CG 0001 (ed. 11188) or Insurance Services Office form number GL 0002 (ed. 1173)
covering comprehensive General Liability and Insurance Services Office form
number GL 0404 covering Broad Form Comprehensive General Liability.
Automobile coverage shall be at least as broad as Insurance Services Office
Automobile Liability form CA 0001 (ed. 12190) Code 8 and 9 ( "any auto "). No
endorsement shall be attached limiting the coverage.
4.2,3 Additional_ requirements. Each of the following shall be included in the
insurance coverage or added as an endorsement to the policy:
a. City and its officers, employees, agents, and volunteers shall be covered
as additional insureds with respect to each of the following: liability arising
out of activities performed by or on behalf of Consultant, including the
insured's general supervision of Consultant; products and completed
operations of Consultant; premises owned, occupied, or used by
Consultant; and - automobiles owned, leased, or used by the Consultant.
The coverage shall contain no special limitations on the scope of
protection afforded to City or its officers, employees, agents, or
volunteers.
b. The insurance shall cover on an occurrence or an accident basis, and not
on a claims -made basis.
An endorsement must state that coverage is primary insurance with
respect to the City and its officers, officials, employees and volunteers,
and that no insurance or self - insurance maintained by the City shall be
called upon to contribute to a loss under the coverage.
Any failure of CONSULTANT to comply with reporting provisions of the
policy shall not affect coverage provided to CITY and its officers,
employees, agents, and volunteers.
e. An endorsement shall state that coverage shall not be canceled except
after thirty (30) days' prior written notice by certified mail, return receipt
requested, has been given to the City, Consultant shall notify City within
14 days of notification from Consultant's insurer if such coverage is
suspended, voided or reduced in coverage or in limits.
4.3 Professional Liability Insurance. Consultant, at its own cost and expense, shall
maintain for the period covered by this Agreement professional liability insurance for
licensed professionals performing work pursuant to this Agreement in an amount not less

than ONE MILLION DOLLARS ($1,000,000) covering the licensed professionals' negligent
errors and omissions.
4.3.1 Any deductible or self - insured retention shall not exceed $150,000 per claim.
4.3.2 An endorsement shall state that coverage shall not be suspended, voided,
canceled by either party, reduced in coverage or in limits, except after thirty (30)
days' prior written notice by certified mail, return receipt requested, has been given
to the City.
4.3.3 The policy must contain a cross liability or severability of interest clause.
4.3.4 The following provisions shall apply if the professional liability coverages are
written on a claims -made form:
a. The retroactive date of the policy must be shown and must be before the
date of the Agreement.
b. Insurance must be maintained and evidence of insurance must be
provided for at least five years after completion of the Agreement or the
work, so long as commercially available at reasonable rates.
If coverage is canceled or not renewed and it is not replaced with another
claims -made policy form with a retroactive date that precedes the date of
this Agreement, Consultant must provide extended reporting coverage for
a minimum of five years after completion of the Agreement or the work.
The City shall have the right to exercise, at the Consultant's sole cost and
expense, any extended reporting provisions of the policy, if the Consultant
cancels or does not renew the coverage.
A copy of the claim reporting requirements must be submitted to the City
prior to the commencement of any work under this Agreement.
4.4 All Policies Requirements.
4.4.1 Acceptability of insurers. All insurance required by this section is to be placed
with insurers with a Bests' rating of no less than A:VII.
4.4.2 Verification of coverage. Prior to beginning any work under this Agreement,
Consultant shall furnish City with certificates of insurance and with original
endorsements effecting coverage required herein. The certificates and
endorsements for each insurance policy are to be signed by a person authorized
by that insurer to bind coverage on its behalf. The City reserves the right to
require complete, certified copies of all required insurance policies, at any time.

4.43 Subcontractors. Consultant shall include all subcontractors as insureds under its
policies or shall furnish separate certificates and endorsements for each
subcontractor. All coverages for subcontractors shall be subject to all of the
requirements stated herein.
4.4.4 Variation. The City may approve a variation in the foregoing insurance
requirements, upon a determination that the coverages, scope, limits, and forms of
such insurance are either not commercially available, or that the City's interests
are otherwise fully protected.
4.4.5 Deductibles and Self - Insured Retentions. Consultant shall disclose to and
obtain the approval of City for the self - insured retentions and deductibles before
beginning any of the services or work called for by any term of this Agreement.
During the period covered by this Agreement, only upon the prior express written
authorization of Contract Administrator, Consultant may increase such deductibles
or self-insured retentions with respect to City, its officers, employees, agents, and
volunteers. The Contract Administrator may condition approval of an increase in
deductible or self - insured retention levels with a requirement that Consultant
procure a bond, guaranteeing payment of losses and related investigations, claim
administration, and defense expenses that is satisfactory in all respects to each of
them,
4.4.6 Notice of Reduction in Coverage. In the event that any coverage required by
this section is reduced, limited, or materially affected in any other manner,
Consultant shall provide written notice to City at Consultant's earliest possible
opportunity and in no case later than five days after Consultant is notified of the
change in coverage.
4.5 Remedies. In addition to any other remedies City may have if Consultant fails to provide
or maintain any insurance policies or policy endorsements to the extent and within the time
herein required, City may, at its sole option exercise any of the following remedies, which
are alternatives to other remedies City may have and are not the exclusive remedy for
Consultant's breach:
■ Obtain such insurance and deduct and retain the amount of the premiums for such
insurance from any sums due under the Agreement;
■ Order Consultant to stop work under this Agreement or withhold any payment that
becomes due to Consultant hereunder, or both stop work and withhold any payment,
until Consultant demonstrates compliance with the requirements hereof; and/or
■ Terminate this Agreement.

Section 5. INDEMNIFICATION AND CONSULTANT'S RESPONSIBILITIES. Consultant shall
indemnify, defend and hold harmless the City and its officials, officers and employees from and against any
and all losses, liability, claims, suits, actions, damages, and causes of action arising out of any personal
injury, bodily injury, loss of life, or damage to property, or any violation of any federal, state, or municipal
law or ordinance, to the extent caused, in whole or in part, by the willful misconduct or negligent acts or
omissions of Consultant or its employees, subcontractors, or agents, by acts for which they could be held
strictly liable, or by the quality or character of their work. The foregoing obligation of Consultant shall not
apply when (1) the injury, loss of life, damage to property, or violation of law arises from the negligence or
willful misconduct of the City or its officers, employees, agents, or volunteers and (2) the actions of
Consultant or its employees, subcontractor, or agents have contributed in no part to the injury, loss of life,
damage to property, or violation of law. It is understood that the duty of Consultant to indemnify and hold
harmless includes the duty to defend as set forth in Section 2778 of the California Civil Code. Acceptance
by City of insurance certificates and endorsements required under this Agreement does not relieve
Consultant from liability under this indemnification and hold harmless clause. This indemnification and hold
harmless clause shall apply to any damages or claims for damages whether or not such insurance policies
shall have been determined to apply. By execution of this Agreement, Consultant acknowledges and
agrees to the provisions of this Section and that it is a material element of consideration.
Notwithstanding the foregoing, to the extent that this Agreement is a "construction contract" as defined in
California Civil Code section 2783, as amended from time to time, such duty to indemnify shall not apply
when to do so would be prohibited by California Code section 2782.
In the event that Consultant or any employee, agent, or subcontractor of Consultant providing services
under this Agreement is determined by a court of competent jurisdiction or the California Public Employees
Retirement System (PERS) to be eligible for enrollment in PERS as an employee of City, Consultant shall
indemnify, defend, and hold harmless City for the payment of any employee andfor employer contributions
for PERS benefits on behalf of Consultant or its employees, agents, or subcontractors, as well as for the
payment of any penalties and interest on such contributions, which would otherwise be the responsibility of
City.
Section 6. STATUS OF CONSULTANT.
6.1 Independent Contractor. At all times during the term of this Agreement, Consultant shall
be an independent contractor and shall not be an employee of City. City shall have the
right to control Consultant only insofar as the results of Consultant's services rendered
pursuant to this Agreement and assignment of personnel pursuant to Subparagraph 1.3;
however, otherwise City shall not have the right to control the means by which Consultant
accomplishes services rendered pursuant to this Agreement. Notwithstanding any other
City, state, or federal policy, rule, regulation, law, or ordinance to the contrary, Consultant
and any of its employees, agents, and subcontractors providing services under this
Agreement shall not qualify for or become entitled to, and hereby agree to waive any and
all claims to, any compensation, benefit, or any incident of employment by City, including
but not limited to eligibility to enroll in the California Public Employees Retirement System
(PERS) as an employee of City and entitlement to any contribution to be paid by City for
employer contributions and/or employee contributions for PERS benefits.

6.2 Consultant No Agent. Except as City may specify in writing, Consultant shall have no
authority, express or implied, to act on behalf of City in any capacity whatsoever as an
agent. Consultant shall have no authority, express or implied, pursuant to this Agreement
to bind City to any obligation whatsoever.
Section 7. LEGAL REQUIREMENTS.
7.1 Governing Law. The laws of the State of California shall govern this Agreement.
7.2 Compliance with Applicable Laws. Consultant and any subcontractors shall comply with
all laws applicable to the performance of the work hereunder.
7.3 Other Governmental Regulations. To the extent that this Agreement may be funded by
fiscal assistance from another governmental entity, Consultant and any subcontractors
shall comply with all applicable rules and regulations to which City is bound by the terms of
such fiscal assistance program.
7.4 Licenses and Permits. Consultant represents and warrants to City that Consultant and
its employees, agents, and any subcontractors have all licenses, permits, qualifications,
and approvals of whatsoever nature that are legally required to practice their respective
professions. Consultant represents and warrants to City that Consultant and its
employees, agents, any subcontractors shall, at their sole cost and expense, keep in effect
at all times during the term of this Agreement any licenses, permits, and approvals that are
legally required to practice their respective professions. In addition to the foregoing,
Consultant and any subcontractors shall obtain and maintain during the term of this
Agreement valid Business Licenses from City.
7.5 Nondiscrimination and Equal Opportunity. Consultant shall not discriminate, on the
basis of a person's race, religion, color, national origin, age, physical or mental handicap or
disability, medical condition, marital status, sex, or sexual orientation, against any
employee, applicant for employment, subcontractor, bidder for a subcontract, or participant
in, recipient of, or applicant for any services or programs provided by Consultant under this
Agreement. Consultant shall comply with all applicable federal, state, and local laws,
policies, rules, and requirements related to equal opportunity and nondiscrimination in
employment, contracting, and the provision of any services that are the subject of this
Agreement, including but not limited to the satisfaction of any positive obligations required
of Consultant thereby.
Consultant shall include the provisions of this Subsection in any subcontract approved by
the Contract Administrator or this Agreement.
Section 8. TERMINATION AND MODIFICATION.

8.1 Termination. City may cancel this Agreement at any time and without cause upon written
notification to Consultant.
Consultant may cancel this Agreement upon thirty (30) days' written notice to City and
shall include in such notice the reasons for cancellation.
In the event of termination, Consultant shall be entitled to compensation for services
performed to the effective date of termination; City, however, may condition payment of
such compensation upon Consultant delivering to City any or all documents, photographs,
computer software, video and audio tapes, and other materials provided to Consultant or
prepared by or for Consultant or the City in connection with this Agreement.
8.2 Extension. City may, in its sole and exclusive discretion, extend the end date of this
Agreement beyond that provided for in Subsection 1.1. Any such extension shall require a
written amendment to this Agreement, as provided for herein. Consultant understands and
agrees that, if City grants such an extension, City shall have no obligation to provide
Consultant with compensation beyond the maximum amount provided for in this
Agreement. Similarly, unless authorized by the Contract Administrator, City shall have no
obligation to reimburse Consultant for any otherwise reimbursable expenses incurred
during the extension period.
8.3 Amendments. The parties may amend this Agreement only by a writing signed by all the
parties.
8.4 Assignment and Subcontracting. City and Consultant recognize and agree that this
Agreement contemplates personal performance by Consultant and is based upon a
determination of Consultant's unique personal competence, experience, and specialized
personal knowledge. Moreover, a substantial inducement to City for entering into this
Agreement was and is the professional reputation and competence of Consultant.
Consultant may not assign this Agreement or any interest therein without the prior written
approval of the Contract Administrator. Consultant shall not subcontract any portion of the
performance contemplated and provided for herein, other than to the subcontractors noted
in the proposal, without prior written approval of the Contract Administrator.
8.5 Survival. All obligations arising prior to the termination of this Agreement and all
provisions of this Agreement allocating liability between City and Consultant shall survive
the termination of this Agreement.
8.6 Options upon Breach by Consultant. If Consultant materially breaches any of the terms
of this Agreement, City's remedies shall included, but not be limited to, the following;
8.6.1 Immediately terminate the Agreement;
8.6,2 Retain the plans, specifications, drawings, reports, design documents, and any
other work product prepared by Consultant pursuant to this Agreement;

8.6.3 Retain a different consultant to complete the work described in Exhibit A not
finished by Consultant; or
8.6.4 Charge Consultant the difference between the cost to complete the work
described in Exhibit A that is unfinished at the time of breach and the amount that
City would have paid Consultant pursuant to Section 2 if Consultant had
completed the work.
Section 9. KEEPING AND STATUS OF RECORDS.
9.1 Records Created as Part of Consultant's Performance, Provided Consultant has been
paid for its services in accordance with this Agreement, all reports, data, maps, models,
charts, studies, surveys, photographs, memoranda, plans, studies, specifications, records,
files, or any other documents or materials, in electronic or any other form, that Consultant
prepares or obtains pursuant to this Agreement and that relate to the matters covered
hereunder shall become the property of the City. Consultant hereby agrees to deliver
those documents to the City upon termination of the Agreement. It is understood and
agreed that the documents and other materials, including but not limited to those described
above, prepared pursuant to this Agreement are prepared specifically for the City and are
not necessarily suitable for any future or other use. City and Consultant agree that, until
final approval by City, all data, plans, specifications, reports and other documents are
confidential and will not be released to third parties without prior written consent of both
parties.
9.2 Consultant's Books and Records. Consultant shall maintain any and all ledgers, books
of account, invoices, vouchers, canceled checks, and other records or documents
evidencing or relating to charges for services or expenditures and disbursements charged
to the City under this Agreement for a minimum of three (3) years, or for any longer period
required by law, from the date of final payment to the Consultant to this Agreement.
9.3 Inspection and Audit of Records. Any records or documents that Section 9.2 of this
Agreement requires Consultant to maintain shall be made available for inspection, audit,
and/or copying at any time during regular business hours, upon oral or written request of
the City. Under California Government Code Section 8546.7, if the amount of public funds
expended under this Agreement exceeds TEN THOUSAND DOLLARS ($10,000.00), the
Agreement shall be subject to the examination and audit of the State Auditor, at the
request of City or as part of any audit of the City, for a period of three (3) years after final
payment under the Agreement.
Section 10
MISCELLANEOUS PROVISIONS.
10.1 Attorneys' Fees. If a party to this Agreement brings any action, including an action for
declaratory relief, to enforce or interpret the provision of this Agreement, the prevailing
party shall be entitled to reasonable attorneys' fees in addition to any other relief to which

that party may be entitled. The court shall set such fees in the same action or in a
separate action brought for that purpose.
10.2 Venue. In the event that either party brings any action against the other under this
Agreement, the parties agree that trial of such action shall be vested exclusively in the
state courts of California in the County of Alameda or in the United States District Court for
the Northern District of California.
10.3 Severability. If a court of competent jurisdiction finds or rules that any provision of this
Agreement is invalid, void, or unenforceable, the provisions of this Agreement not so
adjudged shall remain in full force and effect. The invalidity in whole or in part of any
provision of this Agreement shall not void or affect the validity of any other provision of this
Agreement.
10.4 No Implied Waiver of Breach. The waiver of any breach of a specific provision of this
Agreement does not constitute a waiver of any other breach of that term or any other term
of this Agreement.
10.5 Successors and Assigns. The provisions of this Agreement shall inure to the benefit of
and shall apply to and bind the successors and assigns of the parties.
10.8 Use of Recycled Products. Consultant shall prepare and submit all reports, written
studies and other printed material on recycled paper to the extent it is available at equal or
less cost than virgin paper.
10.7 Conflict of Interest. Consultant may serve other clients, but none whose activities within
the corporate limits of City or whose business, regardless of location, would place
Consultant in a "conflict of interest," as that term is defined in the Political Reform Act,
codified at California Government Code Section 81000 of seq.
Consultant shall not employ any City official in the work performed pursuant to this
Agreement. No officer or employee of City shall have any financial interest in this
Agreement that would violate California Government Code Sections 1090 et seq.
Consultant hereby warrants that it is not now, nor has it been in the previous twelve (12)
months, an employee, agent, appointee, or official of the City. If Consultant was an
employee, agent, appointee, or official of the City in the previous twelve months,
Consultant warrants that it did not participate in any manner in the forming of this
Agreement. Consultant understands that, if this Agreement is made in violation of
Government Code §1090 et.seq., the entire Agreement is void and Consultant will not be
entitled to any compensation for services performed pursuant to this Agreement, including
reimbursement of expenses, and Consultant will be required to reimburse the City for any
sums paid to the Consultant. Consultant understands that, in addition to the foregoing, it
may be subject to criminal prosecution for a violation of Government Code § 1090 and, if
applicable, will be disqualified from holding public office in the State of California.

10.8 Solicitation. Consultant agrees not to solicit business at any meeting, focus group, or
interview related to this Agreement, either orally or through any written materials.
10.9 Contract Administration, This Agreement shall be administered by the City Manager
( "Contract Administrator "). All correspondence shall be directed to or through the Contract
Administrator or his or her designee.
10.10 Notices. Any written notice to Consultant shall be sent to:

FEES FOR PROFESSIONAL SERVICES
Services outlined tinder the Scope of Services shall be provided for the fixed sum stipulated In the Agreement for

REIMBURSABLE COSTS
The following costs shall be reimbursed at cast plus ten percent (10 %) and are not included In the Fee for
Professional Services;
A. Cost of copies of drawings, specifications, reports and cost estimates; xerography and photographic
reproduction of drawings and other documents furnished or prepared In connection with the warn of this
contract.
B. Coast of commercial carrier and public transportation, lodging, car rental and parking. Private automobile
travel at the IRS- allowable rate at the time of traveling.

Dear Justin:
Thank you for Including BKF on your team for the new Dublin Crossings Community Park
Project.
Based on the RFP and subsequent discussions regarding the scope of our services for tills
project, we would propose the following scope and fees:
CONCEPTUAL DESIGN
A. During the conceptual design phase we will provide civil consulting support on up
to three conceptual plan alternatives to be considered. We will coordinate with
the consulting team to prepare a rough grading plan, integrate a regional
development storm water detention area (to be designed by others), review off -
site street parking, and layout a new parking lot and entry drives into the park.
(Allow 26 hours)
B. We will provide a conceptual plan and earthwork estimate of the rough grading
design based on the preferred plan. (Allow 12 hours)
C. We wilil Identify the possible points of utility service, utility transmission

Charges for outside services, equipment, and facilities not furnished directly by BKF Engineers will be billed at
cost plus 1.0`x. Such charges may Include, but shall not be limited to printing and reproduction services;
shipping, delivery, and courier charges; subconsultant fees and expenses; special fees, permits, and Insurance;
transportation on public carriers, meals, and lodging; and consumable materials. Mileage will be charged at
the prevailing IRS rate per mile.
Monthly invoices are due within 30 days from Invoice date. Interest will be charged at 0.833` per month on
past due accounts.
Expert witness /litigation rates are available upon request.
