HomeMy WebLinkAboutItem 3.4 St. Philip CUP J l C j D 1113 CIA AGENDA STATEMENT CITY COUNCIL MEETING DATE: May 23, 1983 SUBJECT: St. Philip Lutheran Church, Second Modification of Conditional Use Permit C-4031 EXHIBITS ATTACHED: Letter from St. Philip Lutheran Church RECOMMENDATION: Approve subject to condition FINANCIAL STATEMENT: None DESCRIPTION: At its August 23, 1982, meeting, the City Council modified the St . Philip Lutheran Church Conditional Use Permit to allow: 1 . Occupancy of the newly-constructed church facility on the condition that a Letter of Credit be delivered to the City to assure installation of the approved landscaping. 2 . Landscaping to be completed by June 1, 1983 . 3 . City to use funds covered by Letter of Credit for landscaping if church fails to complete landscaping by June 1, 1983 . 4 . City to partially release funds as portions of the landscaping are completed. The Church states in their letter that they are unable to complete the landscaping due to the inordinate amount of rainfall. They are requesting a 30-day extension until July 1, 1983 . Staff recommends that Council approve the second modification of Conditional Use Permit C-4031 to allow a 30-day extension until July 1, 1983 , subject to the condition that: Prior to June 1, 1983, St. Philip Lutheran Church shall provide the City of Dublin an amended letter of credit acknowledging the second modification of C-4031 . Box 2340 Dublin, California 94568 RE: St. Philip Lutheran Church Construction Project • Dear Mr. Tong, Our landscape contractor (Spring Landscapes, Sacramento) started work in December, 1982 , and was able to install sprinkler distribution lines before weather conditions prevented further work. The subsequent inordinate rains have pre- vented any progress beyond that point. The soil is only now sufficiently dry to begin soil preparation and grading (the next construction step) . However, in view of the work remaining, it does not seem feasible to finish by the June 1 deadline. We therefore ask for your con- sideration in extending the completion date to July 1, 1983 .
