A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
DENYING AN EXEMPTION FROM MANDATORY GARBAGE SERVICE
SERGIO HERNANDEZ, 7081 ALLEGHENY DRIVE
WHEREAS, the City Council of the City of Dublin adopted Ordinance
2-92, amending the Solid Waste Management Ordinance to provide for
Mandatory Garbage collection and procedures for collection of
delinquent garbage service bills; and
WHEREAS, the City Council also adopted Administrative Procedures
for exemption from Mandatory Garbage Service; and
WHEREAS, a resident can initiate an exemption from garbage
service by completing an application form and submitting it to the
City Managers Office;
WHEREASs the City of Dublin Ordinance 2-92 identifies criteria
for approval of exemptions; and
WHEREAS, after an on-site inspection of the property the City
Manager makes a determination to approve or deny the application for
exemption; and
WHEREAS, if the applicant is denied by the City Manager, the
applicant can appeal the determination to the City Council; and
WHEREAS, the City Council accepts testimony in a public hearing
and makes findings on the appeal of the application for exemption from
Mandatory Garbage Service; and
WHEREAS, the City Council conducted a public hearing on August
24, 1992 related to an appeal from a resident at 7081 Allegheny Drive.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Dublin hereby denies the application for exemption from mandatory
garbage service. The applicant shall initiate service within 15 days
of this action.
