EXECUTIVE SUMMARY:
The City Council is being asked to consider a three -year Memorandum of Understanding (MOU)
with the Las Positas /Tri - Valley One -Stop Career Center for local and regional workforce
development activities.
FINANCIAL IMPACT:
The Tri - Valley One -Stop Career Center was appropriated $10,000 for Fiscal Year 2014/15 as
part of the City's Community Grants Program on February 18, 2014.
RECOMMENDATION:
Staff recommends that the City Council adopt a Resolution Approving the MOU with Las
Positas College /Tri - Valley One -Stop Career Center for Local and Regional Workforce
Development Activities.

The Tri - Valley One -Stop Career Center serves as the focal point for local and regional
workforce development activities and works to integrate workforce preparation services
addressing job, education, training and employment needs in the cities of Dublin, Livermore and
Pleasanton.
Since the creation of the Tri - Valley One -Stop Career Center in 1998, the City of Dublin has
partnered with the Center to assist with its operation and management. As a Partner, the City

agrees to continue to manage and integrate funding and resources for workforce development
services under the Workforce Investment Act of 1998, the guiding principles of California's One -
Stop delivery system and of EASTBAY Works.
The City's existing Memorandum of Understanding has expired and the Tri- Valley One -Stop
Career Center is proposing a new three -year MOU to continue collaborating resources for
workforce services within the three cities. By entering into this MOU, the City has the ability to
describe how the funding and institutional resources can be utilized to better serve the Dublin
community. The MOU will also memorialize the following services:

With respect to Dublin's responsibility under the MOU, the City will continue to assist with
marketing, layoff response and mitigation and business referrals. The proposed MOU is
substantially unchanged from the prior MOU. The term of the MOU will be for three -years
commencing on July 1, 2014 and ending on June 30, 2017.

WHEREAS, the Tri- Valley One -Stop Career Center ( "Center ") serves as the focal point for local
and regional workforce development activities and works to integrate workforce preparation services
addressing job, education, training and employment needs in the cities of Dublin, Livermore and

WHEREAS, since the creation of the Tri - Valley One -Stop Career Center in 1998, the City of

MISSION STATEMENT:
This Memorandum of Understanding (MOU) is for the Las Positas College /Tri - Valley One -Stop
Career Center located at 5020 Franklin Drive, Pleasanton, CA 94588.
The mission of the Tri- Valley One -Stop Career Center - Pleasanton is to serve as the focal point for
local and regional workforce development activities and to integrate workforce preparation services
to address the job, education, training, and employment needs in Pleasanton, Dublin and Livermore.
It is a seamless system that is based upon a comprehensive array of services, which meet our
customer needs, including job seekers, employed workers and employers, This MOU is entered into
in a spirit of cooperation for the purpose of collaborative operation and management of the
individual one -stop centers in the Alameda County Workforce Investment area. It is understood that
in entering into this agreement, the Partners agree to continue to manage and integrate funding and
resources for workforce development services under the Workforce Investment Act (WIA) of 1998
and guiding principles of California's One -Stop delivery system and of EASTBAY Works. The
One -Stop system is built on four guiding principles: to provide universal access, customer choice,
service integration, and accountability for which the customers, partners and stakeholders will take
ownership.
PURPOSE:
This agreement is entered into in a spirit of cooperation by the signatory agencies to describe how
their various funding and institutional resources can be utilized to better serve mutual customers.
The purpose of this agreement is to coordinate resources to ensure the effective and efficient
delivery of workforce services in Pleasanton, Dublin, and Livermore. This agreement will also
establish joint processes and procedures that will enable partners to integrate the current services
array of education, human services to customers,
OBJECTIVES:
The services of the Tri - Valley One -Stop Career Center will:
➢ Empower job seekers to actively achieve long -term economic self - sufficiency.
➢ Assist employers in meeting their present and future workforce needs.
➢ Be delivered in the most cost - effective and efficient manner.
➢ Strengthen the bonds between economic development and employment and training programs
by continual communication and coordination between the public and private sectors,
➢ Provide for universal access for all customers, including those with special needs and barriers
to employment.

➢ Provide for customer choice in the mechanism through which services are accessed and in the
services themselves, based on individual needs.
➢ Be monitored for the purpose Of continuous improvement to ensure the best possible services.
GENERAL PROVISIONS:
The partner agency agrees to commit to a set of ground rules that guide the One -Stop Career Center
in its work, These ground rules include:
Career Center Referrals: Partner agencies will refer clients — individual job seekers and
businesses - to the Career Center, when appropriate, and make provisions for co- enrollment of
clients by both agencies. Partners will familiarize their client- services staff with the resources
available at the Career Center.
The Las Positas College /Tri- Valley One - Stop Career Center and its partners agree to jointly
develop and implement processes and forms for common intake and referral among the One-
Stop Partners, and to modify such processes and forms, as necessary,
• Career Center Clients; Partner agencies will accept referrals from the Career Center. Services
will be provided to eligible clients to eligible clients when appropriate.
• Career Center Partnership ,Service Gaps: Partner agencies will assist the Las Positas College/
Tri - Valley One -Stop in the mobilization of resources in order to fill gaps in services to Career
Center customers,
• Reporting Systems: Partner agencies will adhere to a mutually agreed -upon reporting system
for client services provided through the One -Stop system, including use of the Career Center's
VOS (Virtual One -Stop) system.
• Job Match: Partner agencies will use the labor exchange system of the Employment
Development Department (EDD), CalJOBS, as their primary electronic job listing and or
browser resumes of job seekers who meet the specification of employment opportunities,

The Las Positas College/ Tri- Valley One -Stop Career Center and the City of Dublin shall share
customer information for the sole purpose of enrollment, referral or provision of services only.
Sanctions against staff for violating these polices consistent with Center and affiliated
partners' personnel policies and procedures will apply.
FINANCIAL RESPONSIBILITIES:
This agreement is non - financial in nature and binds no party or partner to financial obligations.
Specific studies, activities, programs, or projects which involve transfer or expenditure by any
party of any monies, services, or property will require execution of a separate agreement(s) or
contract(s).
SERVICES PROVIDED
The services provided by the Las Positas College/Tri- Valley One -Stop Career Center are
integrated, comprehensive, customer focused and performance based. All partners shall provide
services in accordance with applicable regulations and policies governing their organization.

Description of services that will be provided by the City of Dublin -- Economic
Development Department:
Marketing.- Assistance with distribution of business - services related marketing materials
created by Alameda County WIB to (new) local business. Assistances promoting programs
and services offered through the Las Positas College / Tri - Valley One -Stop Career Center
and the Alameda County Workforce Investment Board (ACWIB).
Layoff response and mitigation.- As appropriate, providing the Las Positas College/ Tri -
Valley One -Stop Career Center with early information concerning local layoffs and plant
closures prior to the formal issuance of WARN notices.
Referral.- Of business and individuals to the services at the Las Positas College/ Tri- Valley
One -Stop Career Center, as appropriate.
ANTI- DISCRIMINATION CLAUSE:
Las Positas College/ Tri - Valley One -Stop Career Center and the City of Dublin- Economic
Development Department- shall not unlawfully discriminate, harass, or allow harassment,
against any employee or customer for services because of sex, race, color, ancestry, religious
creed, national origin, physical disability(including HIV and AIDS), mental condition,
age(over40), or customers are free from such discrimination and harassment.
ADA COMPLAINCE
Las Positas College/ Tri - Valley Onc -Stop Career Center and the City of Dublin agree to comply
with the Americans With Disabilities Act (ADA) of 1990 (42 U.S.0 Section 12101 et seq.),
Section 504 of the Rehabilitation Act of 1973 (29 U.S.0 Section 794; and California Government
Code Section 11135 et seq., as well as the regulations which implement these Partners'
obligations otherwise would be Title I or Title III of the ADA. statutes, which prohibits
discrimination on the basis of disability. Partners specifically understand and agree that by
Las Positas College rri- Valley One Stop & City of Dublin 4 of 5
entering into this MOU they are obligated to comply with Title 11 of the ADA where the
obligations imposed by Title 11 are more stringent than the ADA.
Planning
The Las Positas College/ Tri-Valley One-Stop and the City of Dublin agree to collaborate as well
as to provide and receive referrals from the Career Center. By doing so, the City of Dublin will be
joining a network of organizations SLIch as other local cities, chambers of commerce, community
colleges, employers and other con-imunity based organizations in such partnership with the Las
Positas College/ Tri-Valley One-Stop.
Effective Date and Dut-ation of Agreement: This MOU is effective 7/01/14 through 6/30/17.
Each party reserves the right to discontinue its participation in this agreement upon 60 clays
written notice.
Modification of the Agreement: Nothing in this agreement shall violate existing contracts or
leases. Signatories reserve the right to modify the scope, direction, structure, and content of this
agreenient based on the need of management, legislative changes, governing board directives, and
funding availability. Requests to amend or modify this MOU must be submitted in writing at least
30 days prior to the effective date of change.
