THE AIRPORT LAND USE COMMISSION OF ALAMEDA COUNTY
HAYWARD/ CA
RESOLUTION 01-2014 - AT MEETING HELD MAY 21, 2014
WHEREAS, County Airport Land Use Commissions (ALUCs) were established pursuant to
the State ALUC law (Public Utilities Code Article 3.5, State Aeronautics Act, Section
21661.5, Section 71670 et yaq., and Government Code Section 653O7.3 et seq.} to protect
the public health, safety, and welfare by promoting orderly expansion of airports and
adoption of land use measures by local public agencies bz minimize exposure to excessive
noise and safety hazards near airports; and
WHEREAS, state law authorizes ALUCsto coordinate planning at the state, regional and
local levels; to prepare and adopt Airport Land Use Compatibility Plans; and to review and
make recommendations concerning specified plans, regulations and other actions of local
agencies and airport operators including General and Specific Plan amendments, adoption of
a Zoning Ordinance orRezoning, adoption of Building Regulations, revision of Airport Master
Plans, and approval of plans to construct a new airport/he|iport; and
WHEREAS, the Airport Land Use Commission u[Alameda County commenced an update to
the 1986 Airport Land Use Policy Plan for the Livermore Municipal Airport in 2002; and
WHEREAS, the Airport Land Use Compatibility Plan (ALUCP) for the Livermore Municipal
Airport was adopted by the Airport Land Use Commission of Alameda County on July 18,
2012; and
WHEREAS, in accordance with the provisions of Government Code Section 65302.3 (n) -
(c)), and Section 21676 of the Public Utilities Coda once an airport {and use commission has
adopted or amended an ALU[P, within 180'days local jurisdictions must l) amend general
plans and any applicable specific plans to be consistent with theALUCP; or 2) make findings
in accordance with state law and overrule the ALUCP in whole or in part; and 3) achieve
two thirds City Council vote in support of the overrule; and
WHEREAS, the 180-day review period for jurisdictions that are located in whole or in part
within the Livermore Municipal Airport's Airport Influence Area (AIA) commenced October 1,
2012 and ended March 29, 2013; and
WHEREAS, on March 4, 2Ol4 the City ofDublin City Council approved Agenda Item No.
8.5—the proposed General Plan and Zoning Ordinance Amendments and authorized staff to
submit these to the Alameda County ALUC fora Consistency Determination; and
WHEREAS, the City ofDublin, in compliance with this review requirement submitted
proposed General Plan and Zoning Ordinance Amendments to the ALUC for consistency
review with the ALU[P for the Livermore Municipal Airport; and
WHEREAS/ the Airport Land Use Commission of Alameda County reviewed the Dublin
General Plan and Zoning Ordinance Amendments at the May 21, 2014 ALU[ meeting; and
WHEREAS' the Airport Land Use Commission of Alameda County accepts the proposed
amendments Lo incorporate the Compatibility Plan policies into the Land Use, Noise, and

Safety and Seismic Safety Elements of the City of Dublin General Plan (adopted 1985;
amended 2Ol3); and
WHEREAS, the City o[ Dublin has assigned the General Plan and Zoning Ordinance
Amendments referred to in this Resolution with the following identifier moving forward:
PLPA-2014-00028; and
WHEREAS, the staff and members of the Airport Land Use Commission of Alameda County
have reviewed the General Plan and Zoning Ordinance Amendments as approved by the
Dublin City Council on March 4, 2O14;
NOW, THEREFORE BE IT RESOLVED that the Airport Land Use Commission ofAlameda
County finds as follows:
1. General Plan and Zoning Ordinance Amendments PLPA-2014-80028, as approved by
the Dublin City Council on March 4, 2014 and submitted by the City ofDublin to the
ALUC are consistent with the policies and provisions of the 2012 Airport Land Use
Compatibility Plan for the Livermore Municipal Airpn,t,
NOW, THEREFORE BE IT FURTHER RESOLVED that the Airport Land Use Commission of
Alameda County took the following action at its May 21, 2014 regularly scheduled ALUC
meeting:
1. Adopted Resolution O1-Z014 making this Consistency Determination in accordance
with applicable law.

Proposed General Plan Amendments
Airport Land Use Compatibility Plan
Land Use Element
Staff is proposing that the following policies be added to the Land Use Element for the Eastern
Extended Planning Area to address land use compatibility with the Livermore Municipal
Airport:
Guiding Policy: All land uses within the Livermore Municipal Airport, Airport Influence
Area (AIA) shall be reviewed for consistency with the compatibility policies of the
Livermore Municipal Airport, Airport Land Use Compatibility Plan (ALUCP).
Implementing Policy: Adopt an Airport Overlay Zoning District to ensure that all
development within the Airport Influence Area (AIA) is reviewed for consistency with all
applicable Livermore Municipal Airport, Airport Land Use Compatibility Plan (ALUCP)
policies.
Seismic Safety and Safety Element
Staff is proposing that the following policies be added to the Seismic Safety and Safety
Element for the Eastern Extended Planning Area to address safety associated with the
Livermore Municipal Airport:
Guiding Policy: All land uses within the Airport Influence Area (AIA) shall be reviewed
for consistency with the safety compatibility policies and airspace protection policies of
the Airport Land Use Compatibility Plan (ALUCP) for the Livermore Municipal Airport.
Implementing Policy: Adopt an Airport Overlay Zoning District to ensure that all
development within the Airport Influence Area (AIA) is reviewed for consistency with all
applicable Livermore Municipal Airport, Airport Land Use Compatibility Plan (ALUCP)
policies.
Noise Element
Staff is proposing that the following policies be added to the Noise Element for the Eastern
Extended Planning Area to address noise associated with the Livermore Municipal Airport:
Guiding Policy: All land uses within the Airport Influence Area (AIA) shall be reviewed
for consistency with the noise compatibility policies and overflight policies of the Airport
Land Use Compatibility Plan (ALUCP) for the Livermore Municipal Airport.
Implementing Policy: Adopt an Airport Overlay Zoning District to ensure that all
development within the Airport Influence Area (AIA) is reviewed for consistency with all
applicable Livermore Municipal Airport, Airport Land Use Compatibility Plan (ALUCP)
policies.
