HomeMy WebLinkAboutReso 120-92 LandUseAnalyPgmRESOLUTION NO. 120 - 92 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ADOPTING THE CITY OF DUBLIN LAND USE ANALYSIS PROGRAM, A COMPONENT OF THE ALAMEDA COUNTY CONGESTION MANAGEMENT PROGRAM (CMP) WHEREAS, Chapter 2.6, Section 65089 of the California Code requires congestion management programs to contain a program to analyze the impacts of land use decisions made by local jurisdictions on regional transportation systems; and WHEREAS, the October 24, 1991 Alameda County Congestion Management Program (CMP) requires local jurisdictions to adopt, by October 1, 1992, a land use program to analyze the impacts of land use decisions on the regional transportation system; and WHEREAS, the failure to comply with the provisions of the CMP law would put transportation revenues, such as local fuel subventions pursuant to Proposition 111 and State Transportation Improvement Program funds, at risk. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City Council adopts the Land Use Analysis Program (Exhibit A) and authorizes the City Manager or his designee to approve minor amendments to the program. BE IT FURTHER RESOLVED, that a copy of this resolution be transmitted to the Alameda County Congestion Management Agency. PASSED, APPROVED AND ADOPTED this 28th day of September, 1992. Councilmembers Burton, Howard, Jefferey, and Mayor Snyder None Councilmember Moffatt AYES: NOES: ABSENT: Ma or City ql~k City of Dublin Tier I, Land Use Analysis Program General Plan Amendment September 28, 1992 Background In June of 1990, California voters approved Propositions 108 and Ili that govern transportation planning in the state. The new legislation increased fuel tax by 9 cents per gallon and authorized bonds for rail transit. Under Proposition 111 local governments will receive the new fuel tax subventions by complying with Congestion Management Programs (CMPs) aimed at controlling traffic on California's transportation facilities. As a condition for receiving fuel tax subventions, the Alameda County Congestion Management Agency (CMA) in addition to other urban county CMAs in the state, is required to develop and annually update a CMP. The Alameda County CMP adopted on October 24, 1991 requires the City of Dublin and other Alameda County cities, to adopt a Land Use Analysis Program in compliance with the CMP. Proposition 111 gas tax subventions to the City may be withheld if the City fails to meet this requirement and provisions of the Land Use Analysis Program. The City of Dublin's Land Use Analysis Program intends to analyze the impacts of land use decisions made by the City of Dublin on regional transportation systems (I-580 and 1-680 Freeways within Dublin city limits) and estimate the costs associated with mitigating the impacts. Land development projects proposed by Dublin will be reviewed by the CMA to assure that appropriate mitigations are in place or underway at the time of project occupancy. The Land Use Analysis Program has two tiers. Tier I requires the City of Dublin to report General Plan Amendment (GPA) applications to the CMA. Tier II requires the City to annually update land use projections. Land Use Analysis Program Requirements - Tier I For each GPA application estimated to generate 100 or more additional p.m. peak hour trips above that assumed for the CMP target year 2000, the City of Dublin will submit to the CMA a complete GPA summary data sheet (see Attachment A-l). All relevant GPA data will be provided to the CMA within the initial scoping period specified by the CEQA. The data required by the CMA includes: ~ Description and map of the precise location of the project. Location of proposed street access and relationship to CMP roadway system. Description of types of uses in the project (e.g., single family dwelling units; low income senior housing units, etc.) E H BIT Qualification of the uses, such as numbeL of dwelling units, square feet of commercial use, number of jobs, etc. Traffic studies prepared for the project (if any). Expected occupancy date (year), If a multi-phase project, then the expected occupancy date of each phase. Degree of completion (ie., occupancy) by the CIP target year (2000).~ The CMA will model the subject GPA on the CMP roadway system (in isolation of other GPA applications) using the Tri-Va!ley Transportation Plan Model (CMA approved sub-area model). The City of Dublin will notify the CMA in writing their intention to use the sub-area model for the Tier I Land Use Analysis Program. The Tri-Valley Transportation Plan modelling data (consisting of travel speeds, traffic volumes, and volume to capacity ratios) will be sent to the City of Dublin Public Works Department within 14 calendar days of the CMA receiving a fully completed and acceptable GPA application. The Public Works Department will analyze the impacts and identify mitigation measures of the subject GPA on the CMP roadway system using the Tri-Valley Transportation Plan modelling data. The City of Dublin Planning and Public Works Departments will incorporate the traffic analysis and mitigation measures into the environmental documentation prepared for the subject GPA and submit the document to the CMA for review and comment. The minimum public review period for draft Environmental impact Reports (EIRs) is 30 days, or 45 days when the draft is submitted to the State Clearinghouse for review, and 21 days for Negative Declarations. The City of Dublin Planning Department will notify the CMA within 14 calendar days after the subject GPA has been approved. The CMA will then update the Countywide Travel Demand Model Land Use Database. Exceptions A GPA (that is estimated to generate 100 or more additional p.m. peak hour trips) is exempt from this Tier I GPA Land Use Analysis Program if: 1. it is adopted before October 1, 1992, and/or: a Notice of Preparation for a Draft Environmental Impact Report or Negative Declaration for the subject GPA has been distributed for public comment before October 1, 1992· ~A process to ensure analysis of GPA impacts beyond the level of completion by the target year will be developed during 1992-1993. - 2 - As stated in the CMP legislation (Section 650o~.3(c)(5)), "traffic generated by the provision of low and very low income housing" shall be excluded from the determination of conformance with Level of Service (LOS) standards. Therefore, vehicle trips generated by low or very low income housing may be discounted in determining the LOS on the CMP roadway system. The City of Dublin Public Works and Planning Departments will provide the CMA a written report describing the low income housing types, the number of low income housing vehicle trips that were subtracted and the methodology used to identify and subtract these trips. Attachment A-2 depicts the review process for assessing impacts of local land development decisions on the CMP network. - 3 - City of Dublin Tier II, Land Use Analysis Program Annual Forecast Land Use Projections Update September 28, 1992 Land Use Analysis Program Requirements - Tier II The City of Dublin Planning Department will update Dublin's forecast of land use projections annually for the CMP target year. The CMP target year is the last year covered in the seven year Capital improvement Program (CIP) for a given CMP. For the 1991 CMP, the target year is 1998. Since a 1998 land use database is not available, the CMA will use year 2000 forecasts as the target year forecasts for the first CMP cycle. For the first CMP year (1992) there will be only one data submittal. The Countywide Travel Demand Model's land use database will be updated accordingly. Model runs depicting operating conditions on the CMP roadway system will be generated by the CMA and distributed to the City of Dublin Public Works Department for analysis. Data Submittal Schedule Year 2000 and 2010 forecast land use prDjections will be submitted to the CMA no later than February 1, 1993. In future CMP years, year 2000 and 2010 forecast land use projections will be submitted annually to the CMA no later than August 1 of each year (beginning in 1994). The CMA will incorporate the land use changes into the Countywide Travel Demand Model's land use database. By September 1 of each year the CMA will prepare a countFide model run of operating conditions on the CMP roadway system using the revised land use database. The data from these model runs (consisting of traffic volumes, speeds, and Volume to Capacity ratios) will be distributed to the City of Dublin to be used in understanding the compounded effect of all projected land use changes of the roadway system. Data Requirements Annual land use updates must be transmitted to the C~MA. Land use updates should include all forecast land use projections anticipated to occur in addition to GPAs that have been approv.ed in the last year. The City should also take into account market trends. Adopted GPAs submitted to the CMA in connection with the Tier I, GPA Land Use Analysis Program, need not be resubmitted. If the City of Dublin does not have any forecast land use projections to submit to the CMA, this must be indicated in writing and submitted to the CMA. If the City of Dublin fails to submit either a land use projections update or letter stating there are no land use updates by the August deadline, Dublin may be found in nonconformance with the CMP.
