EXECUTIVE SUMMARY:
D.R. Horton Bay, Inc. has constructed the improvements for Tract 8083, Neighborhood D -3,
Positano /Fallon Village in accordance with their Tract Improvement Agreement. It is now
appropriate for the City to accept these improvements and approve the regulatory traffic control
devices.
FINANCIAL IMPACT:
D.R. Horton Bay, Inc. has provided a Warranty Bond (Bond No. 09152790) in the amount of
$189,672.00, issued by Fidelity and Deposit Company of Maryland, to guarantee the
improvements associated with Tract 8083 for one year. Upon acceptance of the improvements,
the City will incur annualized maintenance costs estimated to be $25,000 for street sweeping
and street lighting (monthly), slurry seal (every five years) and asphalt concrete pavement
overlay (every 20 years).
RECOMMENDATION:
Staff recommends that the City Council adopt a Resolution Accepting the Improvements for
Tract 8037, Neighborhood D -3, Positano /Fallon Village and Approving the Regulatory Traffic
Control Devices.

D.R. Horton Bay, Inc. (D.R. Horton) entered into a Tract Improvement Agreement with the City
of Dublin on December 6, 2011, for the construction of street and other tract improvements
associated with Tract 8083, also known as Neighborhood D -3 of the Positano development
within the area covered by the Fallon Village Specific Plan. These improvements included

construction of the streets internal to Neighborhood D -3, including Palazzo Drive, Montese
Court, Fortezza Court, Fortezza Street, Contrada Court, and Avanti Avenue between Valentano
Drive and Forino Drive. In addition, the Tract Improvement Agreement for Tract 8083 also
covered the construction of Valentano Drive between Forino Drive and La Strada Drive,
adjacent to Neighborhood D -3. D.R. Horton provided a Faithful Performance Bond and a Labor
& Materials Bond to guarantee construction of these improvements.
The tract improvements for Tract 8083 are now complete and the developer is requesting that
the bonds for this work be released.
The construction of Valentano Drive between Forino Drive and La Strada Drive was bonded for
by both Tract 8083 (Neighborhood D -3) and Tract 8082 (Neighborhood D -2). Tract 8082
(Neighborhood D -2) is still currently under construction. Therefore, although the bonds posted
by D.R. Horton for the construction of Valentano Drive will be released at this time, the
improvements on Valentano Drive between Forino Drive and La Strada Drive will not be
accepted with this tract (Tract 8083), but will instead be accepted with the improvements for
Tract 8082 (Neighborhood D -2).

D.R. Horton has provided a Warranty Bond in the amount of $189,672.00 (Bond No. 09152790)
issued by Fidelity and Deposit Company of Maryland. The bond amount is equal to twenty five
percent (25 %) of the full cost of completion of the improvements.
The following regulatory traffic control devices will be accepted and approved as part of this
project and added to the City of Dublin Traffic Code:
A. "STOP" signs and markings installed at the following intersections:
• Avanti Avenue and Valentano Drive
• Palazzo Drive and Avanti Avenue
• Fortezza Street and Avanti Avenue
• Contrada Court and Fortezza Court
• Montese Court and Palazzo Drive
• Palazzo Drive and Valentano Drive
B. "NO PARKING" signs at the east side of Avanti Avenue between Forino Drive and
Fortezza Court
C. 15 MPH" curve left sign at the east side of Palazzo Drive near Montese Court
D. 15 MPH" curve right sign at the south side of Palazzo Drive between Valentano Drive
and Montese Court

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTANCE OF TRACT IMPROVEMENTS FOR TRACT 8083, NEIGHBORHOOD D -3,
POSITANO/ FALLON VILLAGE AND APPROVAL OF REGULATORY TRAFFIC CONTROL
DEVICES (D.R. HORTON BAY, INC.)
WHEREAS, D.R. Horton Bay, Inc., the developer of Tract 8083, previously entered into a
Tract Improvement Agreement dated December 6, 2011, Resolution No. 200 -11, with the City
of Dublin, to complete tract improvements associated with Tract 8083, in accordance with plans
on file with the City Engineer; and
WHEREAS, the developer provided a Faithful Performance Bond and a Labor and
Materials Bond, each in the amount of $758,688.00 to guarantee the installation of these
improvements; and
WHEREAS, the improvements are complete in accordance with said plans, and any
approved modifications thereto, to the satisfaction of the City Engineer, and
WHEREAS, certain traffic regulatory devices have been installed as part of the tract
improvements; and
WHEREAS, the Faithful Performance Bond and Labor and Materials Bond can be
released, in accordance with the authority contained in Section 66499.7 of the Government
Code of the State of California, "Manner of Release of the Security," and replaced with a
Warranty Bond to guarantee the completed work for a one -year period; and
WHEREAS, D.R. Horton Bay, Inc., has provided a Warranty Bond in the amount of
$189,672.00, issued by Fidelity and Deposit Company of Maryland (Bond No. 09152790) to
guarantee the improvements for a one -year period.
NOW, THEREFORE, BE IT RESOLVED that:
1. The tract improvements for Tract 8083 are hereby approved and accepted subject
to a one -year guarantee period.
2. The submitted Warranty Bond issued by Fidelity and Deposit Company of
Maryland in the amount of $189,672.00 (Bond No. 09152790) for the tract
improvements for Tract 8083, be accepted as security for the aforesaid one -year
warranty period, said period to commence on this date and terminate on the 19th
day of August, 2015; and
3. The original Faithful Performance Bond issued by Fidelity and Deposit Company
of Maryland (Bond No. 09065396) in the amount of $758,688.00 for the tract
improvements be released.

4. The original Labor and Materials Bond issued by Fidelity and Deposit Company of
Maryland (Bond No. 09065396) in the amount of $758,688.00 for the tract
improvements be released in accordance with the requirements of Section
66499.7 of the Government Code of the State of California.
5. The traffic regulatory devices installed by the developer within the development
are hereby included in the City of Dublin Traffic Code, said regulatory devices to
include the following:
A. "STOP" signs and markings installed at the following intersections:
• Avanti Avenue and Valentano Drive
• Palazzo Drive and Avanti Avenue
• Fortezza Street and Avanti Avenue
• Contrada Court and Fortezza Court
• Montese Court and Palazzo Drive
• Palazzo Drive and Valentano Drive
B. "NO PARKING" signs at the east side of Avanti Avenue between Forino Drive
and Fortezza Court
C. 15 MPH" curve left sign at the east side of Palazzo Drive near Montese Court
D. 15 MPH" curve right sign at the south side of Palazzo Drive between
Valentano Drive and Montese Court
